This agreement establishes specific dates in December 2022 and throughout 2023 that are considered non-business days for administrative acts and procedures before the National Banking and Securities Commission, in addition to Saturdays and Sundays. Deadlines for the Commission to acknowledge or resolve procedures are suspended during these non-business periods, including a specific suspension of natural day deadlines between December 17, 2022, and January 1, 2023. The agreement enters into force the day following its publication in the Official Gazette of the Federation.

AGREEMENT by which the days that will be considered as non-business days are determined for effects of the administrative acts and procedures that are processed or must be processed before the National Banking and Securities Commission by the entities and persons subject

The National Banking and Securities Commission based on articles 14 and 16, first paragraph, section I of the Law of the National Banking and Securities Commission, and in terms of what is provided by articles 4 and 28, second paragraph of the Federal Law of Administrative Procedure, as well as in the Third Article, numeral 76 of the Agreement by which the Provisions in matters of Human Resources and the Professional Career Service are issued, as well as in the Administrative Manual of General Application in matters of Human Resources and Organization and the Manual of the Professional Career Service, published in the Official Gazette of the Federation on July 12, 2010 and its reforms, and
WHEREAS
That the Federal Law of Administrative Procedure is the legal ordinance that regulates the acts, procedures and resolutions of the Federal Public Administration, including those of its decentralized administrative bodies, establishing in its article 28, second paragraph the days that will not be considered business days, which include those in which the competent authorities have general vacations or those in which work is suspended, all previous days must be made known to the public through publication in the Official Gazette of the Federation, and
That with the purpose of giving certainty and legal security to the entities and individuals subject to the supervision of the National Banking and Securities Commission, as well as to other authorities and the general public regarding the administrative acts and procedures that are carried out before this Commission, it is necessary to establish the days that will be considered non-business and the deadlines and terms within said procedures will not run, it has resolved to issue the following:
AGREEMENT BY WHICH THE DAYS THAT WILL BE CONSIDERED AS NON-BUSINESS DAYS ARE DETERMINED FOR EFFECTS OF THE ADMINISTRATIVE ACTS AND PROCEDURES THAT ARE PROCESSED OR MUST BE PROCESSED BEFORE THE NATIONAL BANKING AND SECURITIES COMMISSION BY THE ENTITIES AND PERSONS SUBJECT TO THE SUPERVISION OF SAID COMMISSION, AS WELL AS BY THE AUTHORITIES AND GENERAL PUBLIC
SOLE.- The following days will be considered as non-business days for effects of the administrative acts and procedures that are processed or must be processed before the National Banking and Securities Commission, in addition to Saturdays and Sundays:
I. From 19 to 23 of December and from 26 to 30 of December of 2022.
II. The 1st of January of 2023.
III. The first Monday of February of 2023 in commemoration of February 5th.
IV. The third Monday of March of 2023 in commemoration of March 21st.
V. The 6th and 7th of April of 2023.
VI. The 1st of May of 2023.
VII. The 5th of May of 2023.
VIII. The 16th of September of 2023.
IX. The 2nd of November of 2023.
X. The third Monday of November of 2023 in commemoration of November 20th.
In the days and non-business periods comprised in this Agreement the deadlines for the Commission to take knowledge or resolve what is conducive regarding the procedures or proceedings that are managed before it will be understood as suspended.
In the period comprised between December 17, 2022 to January 1, 2023, the deadlines fixed in natural days for the Commission to resolve what is conducive regarding the procedures or proceedings that are managed before it and that are in the process of attention will be understood as suspended.
TRANSITORY PROVISIONS
FIRST.- Publish in the Official Gazette of the Federation.
SECOND.- This Agreement will enter into force the day following its publication in the Official Gazette of the Federation.
