Agreement Eliminating and Establishing Administrative Simplification and Improvement Actions for Procedures Before the Ministry of Finance and Public Credit

This Agreement updates the names of three administrative procedures, eliminates the requirement to submit free-form written requests for ten specific procedures in favor of standardized physical forms, and merges two interpretation procedures into a single unified procedure. It also reduces maximum resolution deadlines for three procedures: from 180 to 90 days for amendments to constitutive deeds of non-affiliated agricultural and rural insurance funds, from 90 to 70 days for authorizing the issuance of 'L' series shares, and from 90 to 60 days for registering as an Integrating Body. Additionally, it removes two procedures from the Citizen Portal inventory and mandates that existing files not require additional documentation.

AGREEMENT BY WHICH ACTIONS ARE ELIMINATED AND ESTABLISHED FOR THE SIMPLIFICATION AND ADMINISTRATIVE IMPROVEMENT OF PROCEDURES CARRIED OUT BEFORE THE MINISTRY OF FINANCE AND PUBLIC CREDIT.

ÉDGAR ABRAHAM AMADOR ZAMORA, Secretary of Finance and Public Credit, based on what is provided in articles 25, last paragraph of the Political Constitution of the United Mexican States; 26, fraction VI and 31 of the Organic Law of the Federal Public Administration; 6, 18, 20, 81, 85 and 123 of the Law to Regulate Financial Groups;

9 and 46 of the Law of Agricultural and Rural Insurance Funds;

118, fraction XXVI, 144, fraction XIX and 341 fraction XIII of the Law of Insurance and Surety Institutions;

1, 2, 6, 7 fraction I, 8, 9, fractions IX and XII, 10, fractions II, III, V and IX,

19 and 24 of the National Law to Eliminate Bureaucratic Procedures;

4 of the Federal Administrative Procedure Law;

3, 6, fraction XXXVII and 16 of the Internal Regulations of the Ministry of Finance and Public Credit, and 23, 170, 171, 172, 173 and 174 of the Guidelines for the Implementation of the National Model to Eliminate Bureaucratic Procedures, and

CONSIDERING

That the last paragraph of article 25 of the Political Constitution of the United Mexican States establishes, among other aspects, that authorities of all levels of government must implement public policies for administrative simplification and digitalization of procedures and services, good regulatory practices, development and strengthening of public technological capacities and other objectives established by the National Law in this matter;

That within the framework of the National Development Plan 2025-2030, Transversal Axis 2, Objectives T2.1 and T2.2, contemplates the implementation of a national model for the simplification, digitalization and reduction in resolution times of administrative procedures, which promotes efficiency in attention to citizens;

That the National Law to Eliminate Bureaucratic Procedures provides, among obligated subjects, the dependencies of the Federal Public Administration, and that such subjects will govern their actions in accordance with the principles of legal certainty, citizen trust, proportionality, publicity, transparency, among others;

That, in terms of article 24 of the National Law to Eliminate Bureaucratic Procedures, procedures and services provided for in laws, regulations, manuals, guidelines or any other provision, may be simplified through general agreements published in the corresponding dissemination medium; likewise, fractions II and V of said article provide that the cited general agreements will have as their object to establish response times shorter than those maximum provided and implement any other action of improvement, simplification and digitalization of procedures and services;

That the representation, processing and resolution of matters within the competence of the Ministry originally corresponds to the head thereof, and that, through the Unit of Insurance, Pensions and Social Security, it will resolve matters related to the application of the regulations governing the subjects, among others, social security, insurance, sureties and retirement savings systems, as well as insurance and mutual insurance companies;

surety institutions;

agricultural and rural insurance funds;

organizations integrating agricultural and rural insurance funds;

retirement fund administrators;

public institutions performing functions equivalent to those of retirement fund administrators;

investment companies specialized in retirement funds;

financial groups in which it is determined that they will be subject to the supervision of the National Commission of Insurance and Sureties or the National Commission of the Retirement Savings System;

controlling and sub-controlling companies of said financial groups, and fintech institutions corresponding to their competence.

That in accordance with what is provided in articles 22 and 23 of the Guidelines for the Implementation of the National Model to Eliminate Bureaucratic Procedures, Simplification and Digitalization actions are considered those concrete measures that Obligated Subjects implement with the object of reducing bureaucratic costs, fulfilling an obligation or obtaining a benefit provided for in the applicable legal provisions, which include, among others, the reduction of resolution or response times for procedures, the decrease or elimination of requirements, the elimination of procedures, the fusion of procedures that are related to each other, as well as any other action that contributes to the administrative simplification of procedures and regulatory efficiency.

That, for the above reason, and with the purpose of providing legal certainty and security to the general public and contributing to promote regulatory improvement in the simplification of procedures and services offered by the Ministry of Finance and Public Credit, I have deemed it appropriate to issue the following:

AGREEMENT BY WHICH ACTIONS ARE ELIMINATED AND ESTABLISHED FOR THE SIMPLIFICATION AND ADMINISTRATIVE IMPROVEMENT OF PROCEDURES CARRIED OUT BEFORE THE MINISTRY OF FINANCE AND PUBLIC CREDIT

ARTICLE FIRST.

The denomination of the following procedure is updated:

TRANSITORY PROVISIONS

FIRST. This Agreement shall enter into force on the day of its publication in the Official Gazette of the Federation.

SECOND. Procedures entered prior to the publication of this Agreement shall be resolved in accordance with the applicable regulations in effect at the time of their presentation.

THIRD. The Ministry of Finance and Public Credit, in accordance with this Agreement, will not request additional requirements beyond those provided for, nor documentation that is already in its physical or electronic files.

FOURTH. The Ministry of Finance and Public Credit will carry out the necessary adjustments to the Law of Agricultural and Rural Insurance Funds and to the General Rules of Financial Groups, if necessary, linked to this Agreement, within a maximum period of one year counted from its entry into force.

FIFTH. The Ministry of Finance and Public Credit will update the information of the procedures mentioned in this Agreement on the Single Citizen Portal of Procedures and Services, in accordance with articles 53 and 54 of the National Law to Eliminate Bureaucratic Procedures.
