Agreement establishing actions for elimination, simplification, and administrative improvement of procedures before the National Commission for the Retirement Savings System

AGREEMENT ESTABLISHING ACTIONS FOR ELIMINATION, SIMPLIFICATION, AND ADMINISTRATIVE IMPROVEMENT OF PROCEDURES CARRIED OUT BEFORE THE NATIONAL COMMISSION FOR THE RETIREMENT SAVINGS SYSTEM.

The President of the National Commission for the Retirement Savings System, based on the provisions of Article 25, last paragraph, of the Political Constitution of the United Mexican States; Articles 1, 2, 5, fractions I, II, and XVI, and 12, fractions I, II, VIII, and XVI, 19, 21, and 40 of the Law of Retirement Savings Systems; Article 4 of the Federal Administrative Procedure Law; Articles 1, 2, 5, 6, 7, fraction I, 8, 9, fractions IX, XII, and XIII, 10, fractions II, III, V, and IX, 19, 24, and 74 of the National Law to Eliminate Bureaucratic Procedures; and Article 2, fraction III, and 8, first paragraph, of the Internal Regulations of the National Commission for the Retirement Savings System, and

CONSIDERING

That Article 25, last paragraph, of the Political Constitution of the United Mexican States, establishes that authorities of all levels of government, within the scope of their competence, must implement public policies for administrative simplification, which allow for the simplification of procedures, services, good regulatory practices, and other objectives established by the general law in this matter.

That, in accordance with the provisions of the Political Constitution of the United Mexican States, under Article 73, fraction XXIX-Y, the National Law to Eliminate Bureaucratic Procedures was issued, which includes within its objectives, enabling the National Model to Eliminate Bureaucratic Procedures, enabling the National Model for Digitalization, and establishing the obligations of authorities of the three levels of government to guarantee its compliance;

That, within the framework of the National Development Plan 2025-2030, Transversal Axis 2, Objectives T2.1 and T2.2, contemplates the implementation of a national model for the simplification and digitalization of administrative procedures, which allows citizens efficient access to services and speeds up online procedures, reducing time and costs for Mexican society;

That, to comply with what is provided in the Political Constitution of the United Mexican States and in the objectives set forth in the National Development Plan 2025-2030, the Organic Law of the Federal Public Administration in its Article 42 Ter, grants powers to the Agency for Digital Transformation and Telecommunications to coordinate the digitalization of procedures and services under the responsibility of dependencies, decentralized bodies, and entities of the Federal Public Administration;

That, in accordance with Article 3, fraction XXXIV of the National Law to Eliminate Bureaucratic Procedures, the National Commission for the Retirement Savings System (CONSAR) as an administrative decentralized body of the Ministry of Finance and Public Credit, has the status of Obligated Subject for the effects of the simplification of procedures and services provided for in said Law;

That, the objectives of the regulatory improvement policy are to simplify and modernize procedures and services, which may be simplified through general agreements published in the corresponding dissemination medium by the heads of the Obligated Subjects, in accordance with what is provided in Article 24 of the National Law to Eliminate Bureaucratic Procedures;

That, Article 2 of the Law of Retirement Savings Systems establishes that the coordination, regulation, supervision, and oversight of retirement savings systems are the responsibility of the National Commission for the Retirement Savings System and that, within its powers established in Article 5th, is the power to regulate, through general provisions, matters related to the operation of retirement savings systems, as well as to issue those to which participants in retirement savings systems must adhere, regarding their constitution, organization, operation, and participation in retirement savings systems;

That the President of CONSAR, as the highest administrative authority of said body and in concordance with what is provided by the National Law to Eliminate Bureaucratic Procedures, has the attribute to coordinate and promote regulatory improvement actions within the scope of its competence, such as simplifying and modernizing Procedures and Services, this Commission has seen fit to issue the following:

A college of professionals in the matter of actuarial science that is a member of the International Actuarial Association, or; II. The Society of Actuaries (SOA by its initials in English), which includes, among the topics that have been the object of favorable examination, the valuation of contingent labor liabilities (retirement benefits).

ARTICLE EIGHT.- In compliance with the principles of legal certainty, simplification, publicity and transparency,

established in the National Law to Eliminate Bureaucratic Procedures, and with the aim of contributing to the objectives of an

effective simplification policy, the National Commission for the Retirement Savings System identified various activities

that are carried out by the regulated subjects of the Retirement Savings Systems sector, which do not constitute requests to

access a right, obtain a benefit or initiate an administrative procedure before the Commission itself, but rather

correspond to the commitment assumed by the regulated subjects upon obtaining authorization to operate as Participants

in the Retirement Savings Systems, as they constitute elements that are necessary for their operation, at

being provided for in the applicable regulations and, consequently, subject to the supervisory powers of the Commission

in terms of the applicable legal provisions.

In this sense and since the Law of the Retirement Savings Systems empowers the Commission to issue

general provisions, rules or guidelines to regulate the operation of its regulated entities, as well as to

supervise compliance with them, and as part of the simplification actions carried out in its capacity as

Obligated Subject, the following registrations are eliminated from the Citizen Portal for Procedures and Services, without this affecting

the validity of the norms on which they are based, implying the repeal, modification or relaxation of the obligations of

TRANSITORY PROVISIONS

FIRST. This Agreement will enter into force on the next business day following its publication in the

Official Gazette of the Federation.

SECOND. The procedures entered into prior to the publication of this Agreement, will be resolved in

accordance with the applicable regulations in force at the time of their presentation.

THIRD.- The National Commission for the Retirement Savings System, within the maximum term of one year, counted from

the entry into force of this Agreement, within the scope of its competence, will carry out the actions

conducive, in order to carry out the corresponding adjustments to the General Provisions in

financial matters of the Retirement Savings Systems; CONSAR Circular 54-1, through which the

general rules are made known; General provisions in matters of publicity and promotion of the Retirement Savings Systems;

General provisions applicable to pension plans; General provisions in

matters of operations of the Retirement Savings Systems; which are linked to the present

Agreement.

To this effect, what is provided in article 24, second paragraph, of the National Law to Eliminate Bureaucratic

Procedures will be applicable, with the purpose of guaranteeing the coherence and harmonization of the provisions, as well as the update of

the regulatory frameworks that are modified or affected by the reforms and provisions provided for herein.

FOURTH.- The National Commission for the Retirement Savings System will update the information on the procedures and

services referred to in this Agreement, on the Citizen Portal for Procedures and Services, in accordance with

articles 53 and 54 of the National Law to Eliminate Bureaucratic Procedures.
