The agreement removes the federal property 'La Franja Colonia San Felipe de Jesús' from the federal public domain regime and transfers it gratuitously to the National Institute of Sustainable Land for the regularization of human settlements. The transfer is subject to the condition that the property reverts to the Federation if the Institute fails to use it for the authorized purpose or ceases to need it. The Institute of Administration and Appraisal of National Assets is responsible for executing the transfer and monitoring compliance, while the National Institute of Sustainable Land bears all associated taxes, fees, and expenses. The agreement becomes effective the day after its publication in the Official Gazette and expires if the transfer contract is not signed within one year.

MADERO MAYORALTY, MEXICO CITY, WITH FEDERAL REAL ESTATE REGISTRY 9-71388-6.
Dr. Pablo Israel Escalona Almeraya, President of the Institute of Administration and Appraisal of National Assets, a Decentralized Administrative Body of the Secretariat of Treasury and Public Credit, based on the provisions of Articles 27 of the Political Constitution of the United Mexican States, 1, 2, fraction I, 17, 26, fraction VI, 31, fractions XXIX and XXX of the Organic Law of the Federal Public Administration; 2, fractions II and IV, 3, 6, 28, fraction I, 29, fractions I, VI and XV, 84, fraction III, 93, second paragraph, 95 and 101, fractions VI and X of the General Law of National Assets; 1, 4, section G, fraction V, 48 and 49 of the Internal Regulations of the Secretariat of Treasury and Public Credit and; 1, 3, fractions VIII and XXV, 4, fraction I, subparagraph a) and 6, fractions XXIX, XXXVI and XLVII of the Internal Regulations of the Institute of Administration and Appraisal of National Assets; and
CONSIDERING
FIRST.- That Article 27 of the Political Constitution of the United Mexican States establishes that the ownership of the lands and waters included within the limits of the national territory belongs originally to the Nation, which has the right to transmit the ownership thereof to individuals, constituting private property.
SECOND.- That the General Law of National Assets in its articles 3, 6 and 7, fraction X, establishes that national assets and are subject to the federal public domain regime, those indicated in the article 27, paragraphs fourth, fifth and eighth of the Political Constitution of the United Mexican States, among which are the riverbanks.
THIRD.- By Declaration dated April 8, 1922, published in the Official Gazette of the Federación on May 19, 1922, it was recorded that the waters and channels of the canals, ravines, creeks, rivers, lakes and lagoons included within the Valley of Mexico and linked to the drainage works, are of public utility and, therefore, property of the Nation; subsequently, said Declaration was confirmed by Decree, published in the Official Gazette of the Federación on June 06, 1931, both registered in the Federal Public Property Registry under real folio 61227, dated October 12, 2001.
FOURTH.- That among the assets subject to the federal public domain regime, is the federal property named "La Franja Colonia San Felipe de Jesús", located at Anillo Periférico, Colonia San Felipe de Jesús, Postal Code 07510, Gustavo A. Madero Mayoralty, Mexico City, with Federal Real Estate Registry number 9-71388-6 and a surface area of 35,171.9483 square meters.
FIFTH.- That the surface area, measurements and boundaries of the property subject to this Agreement, are recorded in the Topographic Plans approved and registered by the Public Registry and Real Estate Control Directorate, attached to the General Directorate of Real Estate Policy and Management of this Institute, under numbers DRPCI/7437/9-71388-6/2024/T-1/2 and DRPCI/7437/9-71388-6/2024/T-2/2, both dated December 20, 2024, which indicate surface areas of 10,464.0610 square meters and 24,707.8873 square meters, respectively, being a total surface area of 35,171.9483 square meters.
SIXTH.- That with the aim of contributing to the fulfillment of objective 2.9 of the National Development Plan 2025-2030, consisting of "Guarantee the right to adequate and sustainable housing that improves the quality of life of the Mexican population, contributing to close gaps in social and territorial inequality", strategy 2.9.4 "Promote legal certainty to protect the assets of Mexican people, through actions that facilitate the titling of housing", the Federal Government has promoted a "massive housing titling program", in which the National Institute of Sustainable Land participates.
SEVENTH.- That the National Institute of Sustainable Land, through official letter number 1.0/423/2025 dated December 19, 2025, signed by the Head of the General Directorate, requested the disincorporation from the federal public domain regime and authorization for gratuitous alienation in favor of that Decentralized Public Agency, regarding the federal property subject to this Agreement, for the regularization of the human settlements established there.
EIGHTH.- That by Administrative Act, dated January 28, 2026, the legal and administrative delivery was recorded, which was carried out by the National Water Commission, a Decentralized Administrative Body of the Secretariat of Environment and Natural Resources, in favor of the Institute of Administration and Appraisal of National Assets, a Decentralized Administrative Body of the Secretariat of Treasury and Public Credit, which at the same act receives and delivers in a legal and administrative manner to the National Institute of Sustainable Land, regarding the property subject to this Agreement, which is registered in the Public Registry of Federal Property under Real Folios number 3411 page 32, 51567 page 1, 61227 page 1 of date February 23, 2026.
NINTH.- That by official letter number 0094-C/0094 dated January 30, 2026, the Directorate of Architecture and Conservation of Immovable Artistic Heritage of the National Institute of Fine Arts and Literature, informed regarding the property subject to this Agreement as follows: "... it is not considered as an Artistic Monument and is also not included in the INBAL List of Properties with Artistic Value, nor is it adjacent to any property included in the INBAL List of Properties with Artistic Value".
TENTH.- That by Opinion dated February 09, 2026, the General Directorate of Administration of Federal Real Estate Assets, determined not to carry out the dissemination provided for in article 49, fraction II of the General Law of National Assets and in numeral 118 of the Agreement by which the provisions in matter of Material Resources and General Services are established, published in the Official Gazette of the Federación on July 16, 2010 and last reform published in the same dissemination organ on April 5 of 2016, regarding the property subject to this Agreement, "... in virtue of that in the same already (sic) established human settlements, so it does not appear as "available" in the Federal and Para-State Real Estate Information System".
ELEVENTH.- That by official letter number 401.6C.17-2025/0165 dated February 13, 2026, the National Coordination of Material Resources and Services of the National Institute of Anthropology and History, extended official letter number 401.4S.15-2026/0321 dated January 11 of the same month and year, the Subdirectorate of Catalog and Zones, Attached to the National Coordination of Material Resources and Services, informed regarding the property subject to this Agreement that, "... no coincidence of cataloged historical property was found at the indicated address, it is not adjacent to a Historical Monument and we (sic) are not located in the polygon of protection of Zone of Historical Immovable Monuments. For the above, the property is outside the competence of this Institute".
TWELFTH.- That the Real Estate Exploitation Committee of the Institute of Administration and Appraisal of National Assets, in its First Extraordinary Session held on February 23, 2026, issued Agreement 01/2026 CAI, through which it determined the actions for the best use and exploitation of the federal property subject to this Agreement, for its disincorporation and gratuitous alienation in favor of the National Institute of Sustainable Land, in terms of what is provided in article 84, fraction III of the General Law of National Assets.
THIRTEENTH.- That by official letter number DGPGI/056/2026 dated February 27, 2026, the General Directorate of Real Estate Policy and Management, issued the OPINION/02/2026, in which it determined that the property object of this Agreement is not cataloged as one of the assets of common use, related in article 7, fraction X of the General Law of National Assets, therefore, based on the request and justification presented by the National Institute of Sustainable Land for its disincorporation from the federal public domain regime and subsequent gratuitous alienation, for the regularization of land tenure, through a massive housing titling program, the determination adopted by the Real Estate Exploitation Committee proved appropriate, considering that in the concrete case, the normative hypothesis provided for in fraction III of article 84 of the cited Law is met.
FOURTEENTH.- That the General Directorate of Administration of Federal Real Estate Assets, in conformity with what is provided in article 10, fraction IV of the Internal Regulations of this Institute, authorized from the technical point of view, the operation that is authorized. The administrative documentation of the property, as well as of this Agreement, is in the processing file integrated by said General Directorate and was duly checked with that which is found in the Federal and Para-State Real Estate Information System.
Based on article 8, fraction XIV of the Internal Regulations of the Institute of Administration and Appraisal of National Assets, the Legal Unit issued an opinion regarding the present; therefore, based on the considerations referred to, I have deemed it appropriate to issue the following:
AGREEMENT
FIRST.- The federal public domain regime is disincorporated, for its gratuitous alienation in favor of the National Institute of Sustainable Land, the federal property named "La Franja Colonia San Felipe de Jesús", with Federal Real Estate Registry 9-71388-6, for the regularization of the human settlements established there, which is identified and described below:
Location: Anillo Periférico, Colonia San Felipe de Jesús, Postal Code 07510, Gustavo A. Madero Mayoralty, Mexico City.
Total Surface Area: 35,171.9483 square meters.
Number of plans: DRPCI/7437/9-71388-6/2024/T-1/2 and DRPCI/7437/9-71388-6/2024/T-2/2, both of date December 20, 2024, approved and registered by the Directorate of Public Registry and Real Estate Control, attached to the General Directorate of Real Estate Policy and Management of this Institute.
Measurements and Boundaries: Starting from Vertex 1 with a bearing to N 67°23'58.92" W, distance of 004.3608 meters, we arrive at Vertex 2. Starting from Vertex 2 with a bearing to N 65°15'10.44" W, distance of 162.0742 meters, we arrive at Vertex 3. Front (V6 to V11): Borders with Anillo Periférico. Right Side (V10 to V11): Borders with Avenida Villa Alto, at the limit with the State of Mexico. Left Side (V6 to V8): Borders with Avenida León de los Aldama. Back (V8 to V10): No boundaries.
SECOND.- The Institute of Administration and Appraisal of National Assets will exercise on behalf of and representation of the Federation, the corresponding acts to carry out the fulfillment of this Agreement in the terms presented.
THIRD.- In case construction, reconstruction, modification, adaptation, conservation, maintenance, repair and demolition works are projected in the property whose gratuitous alienation is authorized, prior to its realization, the National Institute of Sustainable Land, must manage before local and federal authorities, the obtaining of licenses, permits, authorizations or any other similar that is required.
FOURTH.- If the National Institute of Sustainable Land ceases to use the property whose gratuitous alienation is authorized, gives it a use different from that established in this Agreement, without the prior authorization of this Institute, or if it ceases to need it, said property with all its improvements and accessions will revert to the patrimony of the Federation. This condition must be inserted in the contract corresponding that is issued for this effect.
FIFTH.- The Institute of Administration and Appraisal of National Assets within the scope of its attributions through the General Directorate of Administration of Federal Real Estate Assets, will monitor the strict compliance of this Agreement.
SIXTH.- The taxes, rights, fees and expenses that arise from the operation that is authorized, will be covered by the National Institute of Sustainable Land.
SEVENTH.- If within the year following the entry into force of this Agreement, the corresponding contract for the operation that is authorized has not been celebrated, due to causes attributable to the National Institute of Sustainable Land, determined by the Institute of Administration and Appraisal of National Assets, this Agreement will become void, this Institute must publish in the Official Gazette of the Federación a notice in which it gives notice of this circumstance, as well as notify it to the National Institute of Sustainable Land.
EIGHTH.- Publish this Agreement in the Official Gazette of the Federación and register it in the Federal Public Property Registry and in the Public Registry of Property and Commerce of the Mexico City.
This Agreement will enter into force the day after its publication in the Official Gazette of the Federación.
