Agreement to Decommission Federal Property 'Terreno Paseo del Angel' and Authorize Its Sale via Public Bidding

The Institute of Administration and Appraisals of National Assets decommissions a federal property measuring 635.68 square meters located in Tecámac, State of Mexico, from the public domain regime and authorizes its sale through public bidding. The sale price must be paid in full by the purchaser and cannot be lower than the value determined in an appraisal issued by the Institute. If the property is not sold during the bidding process, the provisions of Article 85 of the General Law of National Assets apply.

AGREEMENT BY WHICH THE FEDERAL REAL ESTATE WITH A SURFACE AREA OF 635.68 SQUARE METERS, NAMED "TERRENO PASEO DEL ÁNGEL", LOCATED AT CALLE PASEO DEL ÁNGEL NUMBER 1, LOT 11, BLOCK 2, OJO DE AGUA SUBDIVISION, POSTAL CODE 55770, MUNICIPALITY OF TECÁMAC, STATE OF MÉXICO, WITH FEDERAL REAL ESTATE REGISTRY 15-9588-9, IS DECOMMISSIONED FROM THE FEDERATION'S PUBLIC DOMAIN REGIME AND ITS SALE FOR VALUE VIA PUBLIC BIDDING IS AUTHORIZED.

President of the Institute of Administration and Appraisals of National Assets, Decentralized Administrative Body of the Secretariat of Treasury and Public Credit, with basis in what is provided by articles 1, 2 fraction I, 17, 26 fraction VI and 31 fractions XXIX and XXX of the Organic Law of the Federal Public Administration; 2 fractions II, IV and VII, 3 fraction III, 4, first and second paragraphs, 6 fraction XXI, 11 fraction I, 13, 28 fraction I, 29 fractions I, II and VI, 84 fraction I, 85, 88, 95 and 101 fraction VI of the General Law of National Assets; 1, 4 section G, fraction V, 48 and 49 of the Internal Regulations of the Secretariat of Treasury and Public Credit and; 1, 3 fraction X, 4 fraction I, subparagraph a) and 6 fraction XXXIII of the Regulations of the Institute of Administration and Appraisals of National Assets, and

CONSIDERING

FIRST.- That among the assets subject to the public domain regime of the Federation is the federal real estate with surface area of 635.68 square meters, named "Terreno Paseo del Ángel", located at Calle Paseo del Ángel number 1, Lot 11, Block 2, Subdivision Ojo de Agua, Postal Code 55770, Municipality of Tecámac, State of México, with Federal Real Estate Registry 15-9588-9.

SECOND.- That ownership of the real estate referred to in the preceding Consideration is accredited through Contract number CD-A-41/99 dated July 9, 1999, in which the free, absolute and simple donation was recorded, entered into by the legal entity named Mexican Corporation of Radio and Television, S.A. de C.V. in its capacity as donor and by the Federal Government in its capacity as donee, regarding the property located at Paseo del Ángel Street, Block 02, Lot 11, of the subdivision named Ex-Hacienda Ojo de Agua, Municipality of Tecámac, State of México, with surface area of 635.68 square meters, registered in the Public Registry of Property of the Municipality of Otumba, State of México under Part number 512 of Volume 82, First Book, First Section, dated June 9, 2000, and in the Federal Public Registry of Property under Real Folio number 51837 dated August 13, 1999.

THIRD.- That the surface area, measurements and boundaries of the real estate subject to this Agreement are set forth in topographic plan number SC-330-2012, prepared on a scale of 1:150, approved and registered on August 27, 2012, under number DRPCI-4343-2012-C and certified on March 31, 2023, by the Directorate of Public Registry and Real Estate Control, attached to the General Directorate of Policy and Real Estate Management of the Institute of Administration and Appraisals of National Assets.

FOURTH.- That by letter number 401.4S.15-2023/0379 dated February 16, 2023, the Subdirectorate of Catalog and Zones, attached to the National Coordination of Historical Monuments of the National Institute of Anthropology and History, informed the General Directorate of Administration of Federal Real Estate Heritage that the real estate subject to this Agreement, "... is not a Historical Monument, does not border a Historical Monument and is not within a Zone of Historical Monuments."

FIFTH.- That by letter number 0400-C/0310 dated March 28, 2023, the Directorate of Architecture and Conservation of Inmable Artistic Heritage of the National Institute of Fine Arts and Literature, informed the General Directorate of Administration of Federal Real Estate Heritage that the real estate subject to this Agreement, "... is not considered as artistic monument or of artistic value ...".

SIXTH.- That the Real Estate Utilization Committee of the Institute of Administration and Appraisals of National Assets, in its Fourth Ordinary Session 2023, held on December 12, 2023, unanimously approved Agreement 09/2023 CAI, determining the actions for the best use and utilization of the real estate subject to this Agreement, for its sale for value, in terms of article 84 fraction I of the General Law of National Assets.

SEVENTH.- That by letter number DGPGI/046/2024 dated January 19, 2024, the General Directorate of Policy and Real Estate Management communicated to the General Directorate of Administration of Federal Real Estate Heritage, both of this Institute of Administration and Appraisals of National Assets, the Opinion for Acts of Administration and/or Disposition number DAAD/2024/001, in which it considered that, since the real estate subject to this Agreement is not found categorized as a good of common use, in accordance with what is established by article 7 of the General Law of National Assets, the normative hypothesis provided for in article 84 of the aforementioned Law is met, whereby the actions of administration and disposition established in the various fractions of the cited article could be appropriate. Considering the content of the aforementioned letter in this Consideration, in the specific case, fraction I of article 84 of the General Law of National Assets is applicable.

EIGHTH.- That by Land Use License number DDU-I/LUS/3212/2024 dated May 17, 2024, the Directorate of Urban Development and Housing attached to the General Directorate of Planning, Administration and Regulation of Territory of the H. Town Council of Tecámac, State of México, stated that the applicable land use for the real estate subject to this Agreement is Residential.

NINTH.- That by Certificate of Alignment and Official Number number DDU-I/CANO/3212/2024 dated May 17, 2024, the Directorate of Urban Development and Housing attached to the General Directorate of Planning, Administration and Regulation of Territory of the H. Town Council of Tecámac, State of México, stated that the real estate subject to this Agreement is located at Calle Paseo del Ángel number 1, Lot 11, Block 2, Subdivision Ojo de Agua, Municipality of Tecámac, State of México.

TENTH.- That by letter number DPI/1588/2024 dated September 9, 2024, the Directorate of Real Estate Planning attached to the General Directorate of Policy and Real Estate Management of the Institute of Administration and Appraisals of National Assets informed that the real estate subject to this Present Agreement was published on the Institutional website, in the section of Real Estate Availability, "Portfolios of Available Federal Real Estate" from January to July 2023.

ELEVENTH.- That the General Directorate of Administration of Federal Real Estate Heritage of this Institute, in accordance with what is provided by article 11, fraction V of the Regulations of this Institute, knew and reviewed from a technical-juridical point of view the decommissioning from the public domain regime of the Federation and authorization to sell the federal real estate named "Terreno Paseo del Ángel". The legal and technical documentation supporting the juridical and administrative situation of the real estate, as well as of this Agreement, is contained in the procedural file integrated by said General Directorate and was duly compared with that found in the Federal and Paraestatal Real Estate Information System. With basis in article 9, fraction XIV, in relation with article 11, fraction V of the Regulations of the Institute of Administration and Appraisals of National Assets, the Legal Unit issued an opinion finding the present Agreement appropriate; therefore, based on the aforementioned considerations and being the purpose of the Federal Executive to give optimal utilization to federal real estate heritage, I have deemed it fit to issue the following:

AGREEMENT

FIRST.- It is decommissioned from the public domain regime of the Federation and the sale for value via public bidding is authorized, the federal real estate with surface area of 635.68 square meters, named "Terreno Paseo del Ángel", located at Calle Paseo del Ángel number 1, Lot 11, Block 2, Subdivision Ojo de Agua, Postal Code 55770, Municipality of Tecámac, State of México, with Federal Real Estate Registry 15-9588-9.

SECOND.- The sale price will be covered by the purchaser in a single payment and may not be lower than that determined in the corresponding appraisal, which for such effect shall be issued by the Institute of Administration and Appraisals of National Assets, through the respective appraisal. If after the public bidding the said real estate has not been sold, the provisions of article 85 of the General Law of National Assets shall apply.

THIRD.- The Institute of Administration and Appraisals of National Assets will carry out, on behalf and representation of the Federation, the corresponding acts to carry out the operation that is authorized.

FOURTH.- The taxes, rights, fees and expenses that arise as a result of the operation that is authorized will be covered by the purchaser in accordance with what is established in the respective legal provisions.

FIFTH.- The Institute of Administration and Appraisals of National Assets within the scope of its attributes, through the General Directorate of Administration of Federal Real Estate Heritage, will oversee strict compliance with this Agreement. This Agreement will enter into force the day following its publication in the Official Journal of the Federation.
