AGREEMENT to deincorporate from the regime of public domain of the Federation, the federal property with a surface area of 67,000

At the margin, a seal with the National Coat of Arms, which says: United Mexican States.- FINANCE.- Ministry of Finance and Public Credit.- Institute of Administration and Appraisal of National Assets.- AD-003-2024.

AGREEMENT to deincorporate from the regime of public domain of the Federation,

the

federal property with a surface area of 67,000.00 square meters, named "Fraccion B

El

Tormento", located in Block X, of the Rural Zone Campeche-Escárcega, Municipality of Escárcega,

State of Campeche, with Federal Real Estate Registry number 4-3434-8 and authorizes its donation in

favor of the Coordinating Body of Universities for the Well-being Benito Juarez Garcia.

VÍCTOR JULIÁN MARTÍNEZ BOLAÑOS, President of the Institute of Administration and Appraisal of National

Assets, Decentralized Administrative Body of the Ministry of Finance and Public Credit, with

basis in what is provided by articles 1, 2 fraction I, 17, 26 and 31 fractions XXIX and XXX of the Organic

Law of the Federal Public Administration; 2 fractions II, IV and VII, 3 fraction III, 4 paragraphs first and

second, 6 fraction XXI, 11 fraction I, 28 fraction I, 29 fractions I, II and VI, 84 fraction V, 95 and 101 fraction VI

of the General Law of National Assets; 1, 4 section G, fraction V, 48 and 49 of the Internal Regulations of the

Ministry of Finance and Public Credit and; 1, 3 fraction X, 4 fraction I, subsection a) and 6 fraction XXXIII of the

Regulations of the Institute of Administration and Appraisal of National Assets; and

C O N S I D E R I N G

FIRST.- That among the assets subject to the regime of public domain of the Federation, the

federal property with a surface area of 67,000.00 square meters, named "Fraccion B

El

Tormento", located in Block X of the Rural Zone Campeche-Escárcega, Municipality of Escárcega,

State of Campeche, with Federal Real Estate Registry number 4-3434-8.

SECOND.- That the ownership of the federal property described in the preceding Consideration is accredited

by Declaration number D.R.-004-2023 dated December 4, 2023, by which it was determined that

the property reverted to the patrimony of the Federation, published in the Official Gazette of the Federation on December 12

of 2023, registered in the Federal Property Registry under Folio Real 50246/3 dated

December 12, 2023.

THIRD.- That by letter number OCUBBJG/DG/314/2023 dated July 28, 2023, the

General Director of the Coordinating Body of Universities for the Well-being Benito Juarez Garcia,

requested the donation of the federal property described in the First Consideration, with the object of providing,

developing, coordinating and orienting services for the provision of quality higher education, through the

installation of an educational headquarters in the Municipality of Escárcega, State of Campeche, in which the

Agroforestry Engineering degree will be taught.

FOURTH.- That by Land Use License dated August 14, 2023, the Directorate of Public

Works, Urban Development and Environment of the Municipality of Escárcega, State of Campeche, authorized the

use of the property subject to this instrument, for experimental and educational field.

FIFTH.- That by Alignment Certificate dated August 14, 2023, the Directorate of

Public Works, Urban Development and Environment of the Municipality of Escárcega, State of Campeche, made

it known that the location of the property subject to this Agreement, is in Block X, of the Rural Zone

Campeche-Escárcega, Municipality of Escárcega, State of Campeche.

SIXTH.- That by letter number 1580-C/1184 dated September 18, 2023, the Directorate of

Architecture and Conservation of Immovable Artistic Heritage of the National Institute of Fine Arts and

Literature, informed that the property subject to this Agreement, is not considered as

artistic monument or of artistic value.

SEVENTH.- That by letter number 401.3S.17-2023/3102 dated October 2, 2023, the Directorate of

the INAH Campeche Center of the National Institute of Anthropology and History, informed that the property subject to

the present Agreement, is not a historical monument, is not adjacent to a historical monument and is not located

in a zone of historical monuments, nor archaeological.

EIGHTH.-

That the surface area, measurements and boundaries of the property subject to this Agreement are

recorded in topographic plan number TOP-01, prepared at scale 1:1000, approved, registered and

certified by the Directorate of Public Registry and Real Estate Control, attached to the General Directorate of

Real Estate Policy and Management of the Institute of Administration and Appraisal of National Assets, under number

DRPCI/7211/4-3434-8/2023/T, on October 11, 2023.

NINTH.- That by agreement dated January 15, 2024, the property subject to

this Agreement was assigned to the Coordinating Body of Universities for the Well-being Benito Juarez Garcia,

for the installation of an educational headquarters in the Municipality of Escárcega, State of Campeche, in which

the Agroforestry Engineering degree is taught, registered in the Federal Property Registry in the

Folio Real 50246/4 dated January 29, 2024.

TENTH.- That by Opinion dated January 23, 2024, the General Directorate of Administration

of Federal Real Estate Heritage, attached to this Institute of Administration and Appraisal of National

Assets, determined that it is not required to carry out the dissemination provided for in article 49 of the General Law of

National Assets and in numeral 118 of the Agreement by which the provisions in matter of

Material Resources and General Services are established, published in the Official Gazette of the Federation on July 16 of

2010 and last reform published in the same dissemination organ on April 5, 2016, regarding the property

subject to this Agreement, in virtue of that by its characteristics it is not suitable to be destined to the

service of any other Dependency, Entity or Public Institution, different from the one using it, since

it is currently used as an educational headquarters in the Municipality of Escárcega, State of Campeche, in which

the Agroforestry Engineering degree is taught, so it does not appear as "available" in the System of

Federal and Paraestatal Real Estate Information.

ELEVENTH.- That the Real Estate Utilization Committee of this Institute of Administration and

Appraisal of National Assets, in its Second Extraordinary Session 2024, held on February 16,

2024, approved agreement number 06/2024 CAI, agreeing to grant the property in question as a donation in favor

of decentralized organisms of federal character whose object is educational, in accordance with what is established in

article 84 fraction V, of the General Law of National Assets.

TWELFTH.- That by letter number DGPGI/222/2024 dated March 20, 2024, the

General Directorate of Real Estate Policy and Management attached to this Institute of Administration and Appraisal of

National Assets issued Opinion number DAAD/2024/005 in which it considered that the property object of the

present, not being cataloged as a good of common use, in accordance with what is established by the

article 7 of the General Law of National Assets, the normative hypothesis provided for in article

84 of the Law of the matter is updated, so that actions of administration and disposition

established in the various fractions of the invoked article may be procedent.

Attending to the content of the letter cited in this consideration, in the concrete case, it is

applicable fraction V of article 84 of the General Law of National Assets.

THIRTEENTH.- That the legal documentation was duly integrated and compared with that which works

in the Federal and Paraestatal Real Estate Information System.

FOURTEENTH.- That the General Directorate of Administration of Federal Real Estate Heritage of

this Institute, in accordance with what is provided by article 11, fraction V of the Regulations of this Institute,

knew and reviewed from the technical-legal point of view, the deincorporation from the regime of public domain

of the Federation and the donation of the federal property subject to this Agreement. The legal and

technical documentation that supports the legal and administrative situation of the property, as well as of this agreement, works in the

processing file integrated by said General Directorate.

That based on article 9 fraction XIV of the Regulations of the Institute of Administration and Appraisal of

National Assets, the Legal Unit reviewed and issued a favorable opinion regarding this Agreement; so that based on the considerations referred and being the purpose of the Federal Executive to give to the patrimony

federal real estate the optimal utilization, I have deemed it appropriate to issue the following:

A G R E E M E N T

FIRST.- It is deincorporated from the regime of public domain of the Federation and the donation is authorized in

favor of the Coordinating Body of Universities for the Well-being Benito Juarez Garcia, of the federal

property with a surface area of 67,000.00 square meters, named "Fraccion B El Tormento", located in the

Block X of the Rural Zone Campeche-Escárcega, Municipality of Escárcega, State of Campeche, with

Federal Real Estate Registry number 4-3434-8, in order that it continues to use it as an educational headquarters in

that Municipality of Escárcega, in the State of Campeche, for the provision of the Agroforestry

Engineering degree.

SECOND.- The Institute of Administration and Appraisal of National Assets will exercise on behalf of and

representation of the Federation, the corresponding acts to carry out the operation that is authorized.

THIRD.- If the Coordinating Body of Universities for the Well-being Benito Juarez Garcia

stops using the property whose donation is authorized, gives it a use different from that established in this

Agreement, without the prior authorization of this Institute, or if it stops needing it, said property with all

its improvements and accessions will revert to the patrimony of the Federation. This precaution must be inserted in the

title of property that is issued for this effect.

FOURTH.- The taxes, rights, fees and expenses that originate with the motive of the operation

that is authorized, will be paid by the Coordinating Body of Universities for the Well-being Benito

Juarez Garcia.

FIFTH.- The Institute of Administration and Appraisal of National Assets within the scope of its attributions

through the General Directorate of Administration of Federal Real Estate Heritage, will monitor the strict

compliance of this Agreement.

SIXTH.- If within the year following the entry into force of this Agreement, the

corresponding contract for the operation that is authorized has not been celebrated, for causes attributable to the Coordinating Body of

Universities for the Well-being Benito Juarez Garcia, determined by the Institute of Administration and

Appraisal of National Assets, this Agreement will become without effect, this Institute must publish in the Official

Gazette of the Federation a notice in which this circumstance is made known, as well as notify it

to that

Organism.

This Agreement will enter into force the day after its publication in the Official Gazette of the Federation.
