This Agreement disincorporates the Tabasco State Penitentiary Center, a federal property of 751,068.77 square meters, from the Federal Public Domain and authorizes its donation to the Government of the State of Tabasco for use as a state penitentiary. The Institute of Administration and Appraisal of National Assets is tasked with executing the donation, while the State Government must cover all associated taxes and expenses. The property reverts to the Federal Government if the State fails to use it for the designated purpose, uses it differently without authorization, or no longer needs it, and the donation contract must be executed within one year of the Agreement's entry into force.

AGREEMENT TO DISINCORPORATE FROM THE FEDERAL PUBLIC DOMAIN AND AUTHORIZE ITS DONATION IN FAVOR OF THE GOVERNMENT OF THE STATE OF TABASCO,
THE FEDERAL PROPERTY WITH AN AREA OF 751,068.77 SQUARE METERS, NAMED
TABASCO STATE PENITENTIARY CENTER, LOCATED 358.111 METERS FROM FEDERAL HIGHWAY
RAUDALES DE MALPASO-EL BELLOTE WITHOUT A NUMBER, KILOMETER 73.5, VILLA ESTACIÓN
CHONTALPA, LOCALITY OF CHICOACÁN, POSTAL CODE 86440, MUNICIPALITY OF HUIMANGUILLO,
STATE OF TABASCO, WITH FEDERAL REAL ESTATE REGISTRY 27-10121-8.
DR. PABLO ISRAEL ESCALONA ALMERAYA, President of the Institute of Administration and Appraisal of
National Assets, an Administrative Decentralized Body of the Secretariat of Treasury and Public Credit,
based on the provisions of Articles 1, 2, fraction I, 17, 26, fraction VI, and 31, fractions XXIX and XXX
of the Organic Law of the Federal Public Administration; 2, fractions II, IV, and VII, 3, fraction III, 4, paragraphs
first and second, 6, fraction XXI, 11, fraction I, 28, fraction I, 29, fractions I, II, and VI, 84, fraction X, 95, and 101
fraction VI of the General Law of National Assets; 1, 4, section G, fraction V, 48, and 49 of the Internal
Regulation of the Secretariat of Treasury and Public Credit; and 1, 3, fraction X, 4, fraction I, subsection a), and 6, fraction
XXXIII of the Regulation of the Institute of Administration and Appraisal of National Assets; and
C O N S I D E R I N G
FIRST.- That among the assets subject to the Federal Public Domain regime is the federal property with an area of 751,068.77 square meters, named Tabasco State Penitentiary Center, previously named Federal Center for Social Readaptation No. 6 "Southeast",
located 358.111 meters from Federal Highway Raudales de Malpaso-El Bellote without a number, kilometer 73.5,
Villa Estación Chontalpa, Locality of Chicoacán, Postal Code 86440, Municipality of Huimanguillo, State
of Tabasco, with Federal Real Estate Registry 27-10121-8.
SECOND.- That ownership of the property referred to in the First Consideration is evidenced by
Contract CD-A 012/2009
dated October 28, 2009, which records the free, pure, and simple donation made by the Executive Branch of the Free and Sovereign State of Tabasco in favor of the Federal Government,
registered in the Federal Property Registry under Real Folio number 94755 dated November 6,
THIRD.- That the area, measurements, and boundaries of the property subject to this Agreement are
recorded in topographic plan number 01, prepared at a scale of 1:4000 dated April 2009, approved and
registered on August 19, 2009, under number DRPCPF-2946-2009-T/; by the then Directorate of
Federal Property Public Registry and Cadastre, attached to the then General Directorate of Federal Real Estate Assets, and certified on April 7, 2021, by the Directorate of Public Registry and Real Estate Control,
attached to the General Directorate of Policy and Real Estate Management of the Institute of Administration and
Appraisal of National Assets.
FOURTH.- That by administrative act dated May 28, 2021, the physical, legal, administrative, and provisional delivery of the property subject to this Agreement was recorded, which was carried out by
the Secretariat of Security and Citizen Protection in favor of the Secretariat of Treasury and Public Credit through
the Institute of Administration and Appraisal of National Assets, who in the same act, delivered it
under the same terms to the Government of the State of Tabasco, registered in the Federal Property Registry
under real folio number 94755/2 dated June 1, 2021.
FIFTH.-
That by letter number SAIG/0032/2023 dated January 16, 2023, the then
Secretary of Administration and Governmental Innovation of the State of Tabasco, requested the donation of the
property subject to this Agreement, to occupy it as a state penitentiary center.
SIXTH.- That by letter number 401.6C-22-2023/486 dated May 26, 2023, the Director of the INAH
Tabasco Center of the National Institute of Anthropology and History, ruled that the property subject to
this Agreement, "... IS NOT a historical property; nor is it located within a polygon declared as a Historic
Center. "
SEVENTH.- That by letter number 0783-C/0562 dated June 9, 2023, the Director of Architecture and
Conservation of Immovable Artistic Heritage of the National Institute of Fine Arts and Literature, informed that
the property subject to this Agreement, "... is not considered as artistic monuments or of
artistic value ..." (sic).
EIGHTH.- That by Agreement number DST-06/2023 dated June 20, 2023, the
property subject to this Agreement was assigned to the Secretariat of Security and Citizen Protection of the Government of the
State of Tabasco, to be used as a State Penitentiary Center, registered in the Public Registry of
Federal Property in Real Folio 94755/3 dated June 30, 2023.
NINTH.- That by Opinion dated January 23, 2024, the General Directorate of Administration
of Federal Real Estate Assets, attached to this Institute of Administration and Appraisal of
National Assets, ruled not to carry out the dissemination provided for in Article 49, fraction II of the General Law of
National Assets and in numeral 118 of the Agreement by which the provisions in the matter of
Material Resources and General Services are established, published in the Official Journal of the Federation on July 16 of
2010 and last reform published in the same dissemination organ on April 5, 2016, regarding the property
subject to this Agreement, "... in view of that by its characteristics it is not suitable to be assigned to the
service of any other Dependency, Entity, or Public Institution, as it is currently assigned to
the Secretariat of Security and Citizen Protection of the Government of the State of Tabasco, so it does not appear
as "available" in the Federal and Parastatal Real Estate Information System "
TENTH.- That the Real Estate Utilization Committee of the Institute of Administration and Appraisal of
National Assets, in its First Ordinary Session 2024, held on March 21, 2024, approved the
agreement 11/2024 CAI by unanimous vote, determining the actions for the best use and utilization of the
property subject to this Agreement, to grant it in donation in favor of the Government of the State of
Tabasco, in accordance with what is established in Article 84, fraction X of the General Law of
National Assets.
ELEVENTH.- That by letter DGPGI/314/2024 dated April 26, 2024, the Directorate
General of Policy and Real Estate Management, attached to this Institute of Administration and Appraisal of National
Assets, issued the Opinion for Administrative Acts and/or Disposition number DAAD/2024/008, in
which it considered that, since the property subject to this Agreement is not cataloged as a common use asset, in accordance with what is established by Article 7 of the General Law of National Assets, the
normative hypothesis provided for in Article 84 of the referred Law is met, so that
administrative and disposition actions established in the various fractions of the article
cited could be appropriate.
Attending the content of the letter cited in this Consideration, in the specific case, it is
applicable fraction X of Article 84 of the General Law of National Assets.
TWELFTH.- That by letter number DOOTSM/DVU/OF/0651/2025 dated February 24,
2025, issued by the Directorate of Works, Territorial Planning and Municipal Services, of the Constitutional City Council of Huimanguillo, Tabasco, observed the "FEASIBILITY OF LAND USE:
INFRASTRUCTURE AND PUBLIC SERVICE"
regarding the property subject to this instrument.
THIRTEENTH.- That the General Directorate of Administration of Federal Real Estate Assets of
this Institute, in accordance with what is provided for in Article 11, fraction V of the Regulation of this Institute,
know and reviewed from a technical-legal point of view, the disincorporation from the Federal Public Domain
regime and authorization for the donation to the Government of the State of Tabasco, of the federal property
named Tabasco State Penitentiary Center. The legal and technical documentation that supports the situation
legal and administrative of the property, as well as of this Agreement, is in the processing file integrated by
said General Directorate and was duly compared with that found in the System of
Federal and Parastatal Real Estate Information.
Based on Article 9, fraction XIV of the Regulation of the Institute of Administration and Appraisal of
National Assets, the Legal Unit issued an opinion regarding the present Agreement; therefore, based on the considerations referred to and being the purpose of the Federal Executive to give to the patrimony
federal real estate the optimal utilization, I have deemed it appropriate to issue the following:
A G R E E M E N T
FIRST.- The federal property with an area of 751,068.77 square meters, named Tabasco State Penitentiary Center, located at
358.111 meters from Federal Highway Raudales de Malpaso-El Bellote without a number, kilometer 73.5,
Villa
Estación Chontalpa, Locality of Chicoacán, Postal Code 86440, Municipality of Huimanguillo, State of
Tabasco, with Federal Real Estate Registry 27-10121-8, is disincorporated from the Federal Public Domain regime, and its donation is authorized in favor of the Government of the
State of Tabasco, to be used as a State Penitentiary Center.
SECOND.- The Institute of Administration and Appraisal of National Assets will exercise on behalf of and
representation of the Federation, the corresponding acts to carry out the operation that is authorized.
THIRD.- If the Government of the State of Tabasco ceases to use the property whose donation is
authorized, gives it a use different from that established in this Agreement, without the prior authorization of this
Institute, or if it ceases to need it, said property with all its improvements and accessions will revert to the
patrimony of the Federation. This condition must be inserted in the corresponding contract that is issued for this purpose.
FOURTH.- The taxes, fees, honoraria, and expenses that arise from the operation that
is authorized, will be covered by the Government of the State of Tabasco.
FIFTH.- The Institute of Administration and Appraisal of National Assets within the scope of its attributions
through the General Directorate of Administration of Federal Real Estate Assets, will monitor the strict
compliance of this Agreement.
SIXTH.- If within the year following the entry into force of this Agreement, the
corresponding contract for the operation that is authorized has not been celebrated, due to causes attributable to the Government of the State of
Tabasco, determined by the Institute of Administration and Appraisal of National Assets, this Agreement
will become void, and this Institute must publish in the Official Journal of the Federation a notice in which it
makes known this circumstance, as well as notify it to the Government of the State of Tabasco.
This Agreement will enter into force the day after its publication in the Official Journal of the Federation.
