AMENDATORY CIRCULAR 14/23 TO THE UNIQUE CIRCULAR FOR INSURANCE AND SURETY

AMENDATORY CIRCULAR 14/23 TO THE UNIQUE CIRCULAR FOR INSURANCE AND SURETY

(Annexes 34.1.21-b and 34.4.3.)

The National Commission for Insurance and Surety, based on the provisions of articles 107, 108, 256, 366, sections II and X, 372, sections VI, IX and XLII, 373 and 381 of the Law of Insurance and Surety Institutions, and:

CONSIDERING

That in terms of the provisions of article 107 of the Law of Insurance and Surety Institutions, in accordance with Chapter 34.1. of the Unique Circular for Insurance and Surety, it is the competence of the National Commission for Insurance and Surety to maintain the General Register of Foreign Reinsurers in which appear the first-order foreign reinsurers that meet the solvency and stability requirements to carry out operations and comply with the diversification of liabilities that insurance and surety institutions, as well as mutual insurance societies of the country assume; which implies following up, among others, on the acts of inscription, cancellation and changes of the legal situation presented by such foreign entities, and whose registration will be made known through Annex 34.1.21-b of the aforementioned Circular.

That in terms of the provisions of article 108 of the Law of Insurance and Surety Institutions, in relation to Provision 34.4.3. of the Unique Circular for Insurance and Surety, the information regarding the Representative Offices of Foreign Reinsurers authorized by the National Commission for Insurance and Surety to establish themselves in the United Mexican States, will be made known through Annex 34.4.3 of the mentioned Circular.

That in virtue of the foregoing, it is necessary to update Annexes 34.1.21-b and 34.4.3. of the Unique Circular for Insurance and Surety with the information regarding the granting of inscription in the General Register of Foreign Reinsurers of the first-order foreign reinsurers that meet the solvency and stability requirements to carry out operations and comply with the diversification of liabilities that insurance and surety institutions, as well as mutual insurance societies of the country assume, as well as changes of the legal situation presented by such foreign entities; likewise, on the information that said reinsurers provide to the National Commission for Insurance and Surety regarding the Representative Offices authorized by the National Commission for Insurance and Surety to establish themselves in the United Mexican States, in accordance with article 108 of the Law of Insurance and Surety Institutions.

Based on the foregoing, the National Commission for Insurance and Surety has resolved to issue the following modification to the Unique Circular for Insurance and Surety in the following terms:

UNIQUE. - Annexes 34.1.21-b and 34.4.3. of the Unique Circular for Insurance and Surety are modified.

TRANSITORY PROVISIONS

FIRST. - Publish in the Official Gazette of the Federation.

SECOND. - This Amendatory Circular shall enter into force on the day following its publication in the Official Gazette of the Federation.
