Amending Circular 19/16 of the Single Insurance and Surety Circular

AMENDING CIRCULAR 19/16 OF THE SINGLE INSURANCE AND SURETY CIRCULAR

(Annex 8.6.3.)

The National Commission of Insurance and Sureties, based on the provisions of articles 366, section II, 372, sections VI and XLII, 373 and 381 of the Law of Insurance and Surety Institutions, and

CONSIDERING

That in accordance with the provisions of the first paragraph of article 247 of the Law of Insurance and Surety Institutions (LISF), insurance institutions and surety institutions must invest their assets, as well as the resources related to the operations referred to in articles 118, sections XXI to XXIII, and 144, section XVII, of the LISF, adhering to the investment policy that, in terms of the provisions of article 70 of the aforementioned Law, is approved by their board of directors.

That the Single Insurance and Surety Circular (CUSF) establishes in its Provision 8.6.3. that information regarding Private Equity Funds and Trusts that have as their purpose to capitalize companies in the country, authorized as instruments susceptible to be considered for the coverage of the Investment Base of insurance and surety institutions, will be made known through Annex 8.6.3. of the CUSF.

That in order to provide legal certainty to insurance and surety institutions, it is necessary to update Annex 8.6.3. of the CUSF, to make known the names of private equity funds and trusts that have as their purpose to capitalize companies in the country, authorized to be considered in the coverage of the Investment Base of the aforementioned institutions.

For the aforementioned reasons, the National Commission of Insurance and Sureties has resolved to issue the following modification to the Single Insurance and Surety Circular in the following terms:

SOLE.- Annex 8.6.3. of the Single Insurance and Surety Circular is modified.

TRANSITORY

SOLE.- This Amending Circular will enter into force the day following its publication in the Official Gazette of the Federation.

The foregoing is made known to you, based on articles 366, section II, 372, sections VI and XLII, 373 and 381 of the Law of Insurance and Surety Institutions.
