The National Financial Market Commission (CNPF) of Moldova has initiated the drafting of four regulatory acts to transpose specific EU Delegated and Implementing Regulations (EU) 2017/389, 390, 392, and 394 into national law. These new regulations will establish parameters for calculating monetary sanctions for failed settlements, define prudential and operational standards for central securities depositories (CSDs), and standardize authorization and supervision procedures for CSDs and designated credit institutions providing ancillary banking services. Stakeholders are invited to submit proposals and suggestions regarding these drafts by April 10, 2026, via postal mail or email to support the alignment of Moldovan legislation with the EU acquis under the 2025-2029 National Accession Programme.
The National Financial Market Commission (CNPF), pursuant to Article 20(1)(a) of Law No. 100/2017 on normative acts, announces the initiation of the process for drafting the following regulatory acts:
Regulation on the parameters for calculating monetary sanctions for failed settlements and operations of central securities depositories in host states;
Regulation on the regulatory technical standards concerning prudential requirements for central securities depositories and designated credit institutions providing ancillary banking services;
Regulation on regulatory technical standards regarding authorization, supervision, and operational requirements for central securities depositories;
Regulation on the implementing technical standards for standard forms, templates, and procedures for the authorization, examination, and assessment of central securities depositories.
The drafting of these regulatory acts stems from commitments undertaken by the Republic of Moldova through the National Programme for the Accession of the Republic of Moldova to the European Union for 2025-2029, approved by Government Decision No. 306/2025, to undertake measures to transpose and align national legislation with the European Union (EU) acquis, namely:
Delegated Regulation (EU) 2017/389 supplementing Regulation (EU) No 909/2014 of the European Parliament and of the Council as regards parameters for calculating monetary sanctions for failed settlements and operations of CSDs in host member states;
Commission Delegated Regulation (EU) 2017/390 of 11 November 2016 supplementing Regulation (EU) No 909/2014 as regards regulatory technical standards relating to certain prudential requirements for central securities depositories and designated credit institutions providing ancillary banking services;
Delegated Regulation (EU) 2017/392 supplementing Regulation (EU) No 909/2014 as regards regulatory technical standards regarding authorization, supervision, and operational requirements for central securities depositories;
Implementing Regulation (EU) 2017/394 laying down implementing technical standards as regards standard forms, templates, and procedures for the authorization, examination, and assessment of central securities depositories, for cooperation between the home and host member state authorities, for consultation of authorities involved in the authorization process for providing ancillary banking services, for access involving central securities depositories, as well as regarding the format of records to be kept by central securities depositories in accordance with Regulation (EU) No 909/2014.
