SUBJECT: INTERNATIONAL OPERATIONS MANAGEMENT – REVOKE BOARD RESOLUTION NO. 064/2021 OF APRIL 21, 2021.

CONSIDERING:
That Article 327 of the Political Constitution of the State establishes that the BCB is a public law institution, with legal personality, whose function is to maintain the stability of the internal purchasing power of the currency to contribute to economic and social development.

That Article 1 of Law No. 1670 provides that the BCB is the sole monetary and exchange authority of the country, with administrative, technical, and financial competence and specialized normative powers of general application.
That Articles 44 and 54(a) of Law No. 1670 establish that the highest authority of the BCB is its Board of Directors, which is responsible for defining its policies, specialized norms of general application, and internal rules; as well as establishing the BCB's administrative, operational, and financial strategies, with one of its attributions being to issue norms and adopt general decisions necessary for the BCB to fulfill the functions, competencies, and powers assigned to it by the aforementioned Law.
That Article 3 of Law No. 1990 establishes that the National Customs is the institution responsible for monitoring and supervising the passage of goods through the country's borders, ports, and airports, intervening in international trade in goods for the purpose of collecting taxes levied on them and generating statistics on that movement, without prejudice to other attributions or functions assigned by laws.
That Supreme Decree No. 29681 aims to establish the obligation of natural or legal persons, public, private, or mixed, national or foreign, to declare the physical import and export of foreign currency from the national territory, as well as to regulate the registration and control of such operations.
That Article 3 of Supreme Decree No. 29681, modified by Paragraph II of Article 2 of Supreme Decree No. 5404, establishes that the physical import of foreign currency into the national territory, in amounts between $10,000.00 (TEN THOUSAND 00/100 UNITED STATES DOLLARS) and $50,000.00 (FIFTY THOUSAND 00/100 UNITED STATES DOLLARS) or its equivalent in another currency, and the physical export of foreign currency from the national territory, in amounts between $10,000.00 (TEN THOUSAND 00/100 UNITED STATES DOLLARS) and $20,000.00 (TWENTY THOUSAND 00/100 UNITED STATES DOLLARS) or its equivalent in another currency, will require registration on a form provided by the National Customs, which must include, among other things, data on the origin and destination of the funds.
That Board Resolution No. 064/2021 approved the "Sworn Declaration of Accompanied Luggage and Ingress and Egress of Foreign Currency" Form.

That Item 1) of Article 5 and Item 1) of Article 10 of the Issuer Entity Statute determine that the BCB has normative competence to issue specialized norms in the fields assigned to it by Law, and the Board of Directors has, among others, the attribution to approve general decisions and issue norms necessary for the BCB to fulfill the functions, competencies, and powers assigned to it by Law.
That the report BCB-GOI-SOEXT-INF-2025-6 from the GOI concludes that Supreme Decree No. 5404 of May 23, 2025, which aims to modify Articles 2, 3, and 4 of Supreme Decree No. 29681 of August 20, 2008, modified by Supreme Decree No. 4492 of April 21, 2021, regarding the physical import and export of foreign currency to and from the national territory, establishes that registration on a form provided by the National Customs (AN) will be required; therefore, the BCB is no longer responsible for providing the "Sworn Declaration of Accompanied Luggage and Ingress and Egress of Foreign Currency" Form, which now corresponds to the AN; recommending that the BCB Board of Directors revoke Board Resolution No. 064/2021 of April 21, 2021, which approved the same.
That the report BCB-GAL-SANO-DLBCI-INF-2025-160 from the GAL concludes that Paragraph II of Article 2 of Supreme Decree No. 5404 modifies Article 3 of Supreme Decree No. 29681, modified by Supreme Decree No. 4492, providing that the physical import of foreign currency into the national territory, in amounts between $10,000.00 and $50,000.00 or its equivalent in another currency, and the physical export of foreign currency from the national territory, in amounts between $10,000.00 and $20,000.00 or its equivalent in another currency, will require registration on a form provided by the National Customs, which must include, among other things, data on the origin and destination of the funds; therefore, it corresponds to revoke Board Resolution No. 064/2021 of April 21, 2021, which approved the "Sworn Declaration of Accompanied Luggage and Ingress and Egress of Foreign Currency" Form; recommending that the BCB Board of Directors revoke the aforementioned Board Resolution.
THEREFORE, THE BOARD OF DIRECTORS OF THE CENTRAL BANK OF BOLIVIA RESOLVES:
Article 1.- Revoke Board Resolution No. 064/2021 of April 21, 2021.
