Board Resolution No. 146/2008 Approving the Central Bank of Bolivia's 2009 Service Commission and Fine Tables

This resolution revokes Board Resolutions No. 152/2007 and No. 033/2008, along with any contrary provisions. BOARD RESOLUTION NO. 146/2008

SUBJECT: INTERNATIONAL OPERATIONS MANAGEMENT - APPROVES THE TABLE OF COMMISSIONS FOR SERVICES AND THE TABLE OF FINES OF THE CENTRAL BANK OF BOLIVIA FOR THE 2009 MANAGEMENT PERIOD.

HAVING SEEN:

Law No. 1670 of October 31, 1995, of the Central Bank of Bolivia (BCB).

The Statute of the BCB approved by Board Resolution No. 128/2005 of October 21, 2005, and subsequent modifications.

Board Resolution No. 152/2007 of December 11, 2007, which approves the Table of Commissions for Services and the Table of Fines of the BCB for the 2008 management period.

Board Resolution No. 033/2008 of March 18, 2008, which modifies one of the commissions in the Table approved with B.R. No. 152/2007.

Reports from the International Operations Management (GOI) No. 015/2008 and No. 016/2008 of December 4 and 12, 2008, respectively.

Report from the Legal Affairs Management (SANO) No. 354/2008 of December 5, 2008.

CONSIDERING:

That according to Article 54, subsection n) of Law No. 1670, it is within the authority of the Board to formulate policies regarding the internal management of the BCB, supervising their execution.

That according to Article 11, numeral 45) of the BCB Statute, the Board has among its faculties the power to set annually the table of commissions to be charged for the services it provides.

That the International Operations Management, according to Reports GOI Nos. 015/2008 and 016/2008, states that the commissions charged by the BCB for the provision of banking and financial services are intended to cover their respective operating costs, and therefore it is necessary to periodically adjust these commissions in order to adapt them to current market conditions.

That as expressed in Report SANO No. 354/2008, in the opinion of the Legal Affairs Management, there is no legal impediment for the Board to consider the approval of the Service Commission Tables and the Fines Table of the BCB for the 2009 management period.

THEREFORE,

THE BOARD OF DIRECTORS OF THE CENTRAL BANK OF BOLIVIA

RESOLVES:

Article 1.- Approve the Table of Commissions for Services and the Table of Fines of the Central Bank of Bolivia for the 2009 management period, which forms part of the present Resolution as an annex and which will enter into force as of January 2, 2009.

Article 2.- As of January 2, 2009, Board Resolutions Nos. 152/2007, 033/2008, and all provisions contrary to the present Resolution are hereby repealed.

Article 3.- The Presidency and General Management are charged with the execution and compliance of the present Resolution.
