The Bank of Mexico modifies the Transitory Articles Second and Third of the Rules governing the Electronic Attention Module (MAE) to mandate exclusive electronic interaction. Starting June 5, 2009, multiple banking institutions and brokerage houses must submit all requests to the Bank exclusively through the MAE. From September 1, 2009, the Bank will only communicate responses to these requests via the MAE, requiring entities to comply with the designated representative and operator provisions to access such responses.

TO MULTIPLE BANKING INSTITUTIONS AND
BROKERAGE HOUSES:
SUBJECT: RESOLUTION MODIFYING THE RULES OF THE ELECTRONIC ATTENTION MODULE.
The Bank of Mexico, based on Articles 28 of the Political Constitution of the United Mexican States, paragraphs sixth and seventh; 24 of the Bank of Mexico Law; 22 of the Law for Transparency and Ordering of Financial Services; as well as Articles 8, third and seventh paragraphs, 10, 14, in relation to Article 25 fraction II and 17 fraction I, which provide for the attributions of the General Directorate of Financial System Analysis, through the Financial System Analysis Directorate, and the Central Banking Provisions Directorate, to participate in the issuance of provisions, respectively, all of them of the Internal Regulations of the Bank of Mexico; as well as the Unique Agreement of Affiliation of the Administrative Units of the Bank of Mexico, fractions III and IV, in order to promote the use of the Electronic Attention Module by multiple banking institutions and brokerage houses, considering that: i) the operational problems faced by some of them have been overcome, or ii) they have had a reasonable timeframe to overcome such problems; has resolved to modify Transitory Articles Second and Third of the “Rules to which multiple banking institutions and brokerage houses must adhere regarding authorization and consultation requests they submit to the Bank of Mexico through the Electronic Attention Module”, contained in Circular 26/2008, published in the Official Gazette of the Federation on June 25, 2008, to read as follows:
“TRANSITORY PROVISIONS

SECOND.- Starting June 5, 2009, Entities that have appointed or appoint Representatives and Operators under item 2 of these Rules, must submit their Requests to the Bank of Mexico exclusively through the MAE.
THIRD.- Starting September 1, 2009, the Bank of Mexico will only make known the Responses to Requests that Entities submit to it by any means, through the MAE.
Therefore, Entities to have access to said Responses must comply with what is provided in item 2 of these Rules.”
TRANSITORY PROVISION UNIQUE.- This Resolution will enter into force the day following its publication in the Official Gazette of the Federation.
