Circular 15/2010 — Modifies Circular 2019/95

The Bank of Mexico amends the Transitory Provision of Circular 5/2010 to postpone the effective date of sections M.36.3 and M.36.31 of Circular 2019/95 to May 5, 2010. This modification delays the application of the commission charging scheme and the obligation for automated teller machine operators to display commission information, as originally established in Circular 17/2009. The change applies to multiple banking institutions and automated teller machine operators.

CIRCULAR 15/2010 Mexico, D.F., April 20, 2010. TO MULTIPLE BANKING INSTITUTIONS: SUBJECT: MODIFICATIONS TO CIRCULAR 2019/95.

The Bank of Mexico, based on Article 28 of the Political Constitution of the United Mexican States, sixth and seventh paragraphs; Article 24 of the Bank of Mexico Law; Article 22 of the Law for Transparency and Regulation of Financial Services; Article 48 of the Credit Institutions Law; and Articles 8 (third and sixth paragraphs), 10, 14 in relation with Article 25, fraction II; 17, fraction I, and 20, fraction IV, which establish the powers of the Bank of Mexico through the General Directorate of Analysis of the Financial System, the Directorate of Central Banking Regulations, and the Directorate of Operational and Payment Systems, to issue regulations, all of them from the Internal Regulations of the Bank of Mexico, Single Agreement on the Assignment of Administrative Units of the Bank of Mexico, fractions I, III, and IV, considering that on April 16, 2010, Circular 14/2010 was published in the Official Gazette of the Federation, which aims to modify the Third Transitory Provision of Circular 24/2009, in order to postpone by five natural days the application of the commission charging scheme, as well as the obligation of automated teller machine operators to display information regarding commissions, as provided in Circular 17/2009, has resolved to modify, effective April 20, 2010, the Single Transitory Provision of Circular 5/2010, to read as follows:

TRANSITORY PROVISION

“SINGLE. Sections M.36.3 and M.36.31 of Circular 2019/95 shall enter into force on May 5, 2010.”
