Circular 30/2021/TT-BTC on extending the validity of Circular 14/2020/TT-BTC and amending Circular 127/2018/TT-BTC

The Ministry of Finance of Vietnam issued Circular 30/2021/TT-BTC to extend the validity of Circular 14/2020/TT-BTC, which provides reduced service fees for securities transactions to support entities affected by the COVID-19 pandemic, until December 31, 2021. This extension applies to service prices at the Vietnam Stock Exchange and the Vietnam Securities Depository, after which standard pricing under Circular 127/2018/TT-BTC resumes unless modified by the Minister. The Circular takes effect on July 1, 2021, and empowers the Minister to adjust fees based on pandemic and market conditions.

CIRCULAR

Extending the validity of Circular No. 14/2020/TT-BTC dated March 18, 2020 of the Minister of Finance amending and supplementing certain articles of Circular No. 127/2018/TT-BTC dated December 27, 2018 of the Minister of Finance regulating service prices in the securities sector applied at the Securities Exchange and the Vietnam Securities Depository to support relevant organizations and individuals affected by the COVID-19 pandemic

Pursuant to the Securities Law dated November 26, 2019; Pursuant to the Law on Fees and Charges dated November 25, 2015; Pursuant to the Price Law dated June 20, 2012; Pursuant to the Law on Public Debt Management dated November 23, 2017; Pursuant to Government Decree No. 177/2013/ND-CP dated November 14, 2013 and Government Decree No. 149/2016/ND-CP dated November 11, 2016 amending and supplementing certain articles of Government Decree No. 177/2013/ND-CP dated November 14, 2013 detailing and guiding the implementation of certain articles of the Price Law; Pursuant to Government Decree No. 155/2020/ND-CP dated December 31, 2020 detailing the implementation of certain articles of the Securities Law; Pursuant to Government Decree No. 87/2017/ND-CP dated July 26, 2017 of the Government regulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

At the request of the Director of the Price Management Department and the Chairman of the State Securities Commission;

The Minister of Finance promulgates the Circular extending the validity of Circular No. 14/2020/TT-BTC dated March 18, 2020 of the Minister of Finance amending and supplementing certain articles of Circular No. 127/2018/TT-BTC dated December 27, 2018 of the Minister of Finance regulating service prices in the securities sector applied at the Securities Exchange and the Vietnam Securities Depository to support relevant organizations and individuals affected by the COVID-19 pandemic.

Article 1. Extension of validity

The validity of Circular No. 14/2020/TT-BTC dated March 18, 2020 of the Minister of Finance amending and supplementing certain articles of Circular No. 127/2018/TT-BTC dated December 27, 2018 of the Minister of Finance regulating service prices in the securities sector applied at the Securities Exchange and the Vietnam Securities Depository to support relevant organizations and individuals affected by the COVID-19 pandemic, which had been extended in validity according to Circular No. 70/2020/TT-BTC dated July 17, 2020 of the Minister of Finance, is hereby extended until December 31, 2021.

After December 31, 2021, the service prices in the securities sector applied at the Securities Exchange and the Vietnam Securities Depository shall be implemented according to the provisions of Circular No. 127/2018/TT-BTC dated December 27, 2018 of the Minister of Finance mentioned above. Based on the development of the COVID-19 pandemic and the securities market situation, the Minister of Finance shall consider and promulgate amendments and supplements to service prices in the securities sector when necessary.

Article 2. Effectiveness

  1. This Circular takes effect from July 1, 2021.
  2. During implementation, if any difficulties arise, organizations and individuals are requested to promptly report to the Ministry of Finance for study and supplementary guidance.
