Circular 60/2008 — Modifications to Circular 27/2008

The Bank of Mexico adds a Sixteenth Rule to the General Rules governing credit information societies and their users, requiring these societies to provide the Bank with database information, special credit reports for legal entities, and generated indicators or indexes. The Bank of Mexico is authorized to request this information through the General Directorate of Financial System Analysis, and such requests are exempt from being recorded in special credit reports. This Circular entered into force on December 4, 2008.

TO CREDIT INFORMATION SOCIETIES:

SUBJECT: MODIFICATIONS TO THE GENERAL RULES TO WHICH THE OPERATIONS AND ACTIVITIES OF CREDIT INFORMATION SOCIETIES AND THEIR USERS MUST BE SUBJECT

The Bank of Mexico, based on Articles 28 of the Political Constitution of the United Mexican States, sixth and seventh paragraphs; 24 of the Bank of Mexico Law; 12 and 17 of the Law to Regulate Credit Information Societies; 22 of the Law for Transparency and Orderly Conduct of Financial Services; 8th, third and sixth paragraphs, 10, 14 in relation to 25 fraction II and 17 fraction I, which provide for the attribution of the Bank of Mexico through the General Directorate of Financial System Analysis and the Directorate of Central Banking Provisions, respectively, to issue provisions, all of the Internal Regulations of the Bank of Mexico; Unique, fractions III and IV of the Agreement on the Affiliation of the Administrative Units of the Bank of Mexico, with the objective of promoting the sound development of the financial system and considering that:

a) Timely information on the granting of credits contained in the database available to users is fundamental for the analysis by intermediaries and the financial system as a whole, and

b) Historical information on the credit behavior of individuals and legal entities allows for a more precise measurement of the credit risks of financial intermediaries,

has resolved to add a Sixteenth Rule to the “General Rules to which the operations and activities of Credit Information Societies and their Users must be subject,” in the following terms:

GENERAL RULES TO WHICH THE OPERATIONS AND ACTIVITIES OF CREDIT INFORMATION SOCIETIES AND THEIR USERS MUST BE SUBJECT

CHAPTER V

General Provisions

“SIXTEENTH.- Societies must provide the Bank of Mexico, through the General Directorate of Financial System Analysis, in the terms indicated by it, the following:

a) Information contained in their databases;

b) Special Credit Reports of legal entities, and

c) Indicators, indexes, and other reports they have generated.

Information requests made by the Bank of Mexico pursuant to the provisions of this Rule shall not be registered in the Special Credit Reports, as they are made in the exercise of the legal powers of the Central Institute.”

TRANSITORY

UNIQUE. This Circular shall enter into force on December 4, 2008.
