Circular to the Industry on the Publication of the Crypto-Asset Service Provider Return

The Malta Financial Services Authority issued this circular to inform licensed Crypto-Asset Service Providers of the publication of the CASP Return. Authorised Persons must compile and submit the return through the MFSA LH Portal initially by 30 April 2025 and subsequently according to the Markets in Crypto-Assets Rulebook. Entities are responsible for ensuring data accuracy and timely submission, with non-compliance potentially resulting in regulatory enforcement actions.

Circular Triq l-Imdina, Zone 1 Central Business District, Birkirkara CBD 1010 +356 2144 1155 communications@mfsa.mt www.mfsa.mt Circular to the Industry on the Publication of the Crypto-Asset Service Provider Return The Malta Financial Services Authority (‘MFSA’ or ‘the Authority’) is hereby issuing a communication to inform all Crypto-Asset Service Providers licensed under the Markets in Crypto- Assets Act (‘the Act’) of the publication of the Crypto-Asset Service Provider Return (‘CASP Return’). The latest version of the CASP Return (v25-01-a) may be accessed through the MFSA website. Authorised Persons are reminded to regularly check the MFSA website for further updates to ensure that the most current version of the CASP Return is compiled and submitted. Applicability of the Reporting Requirements The new CASP Return is to be compiled and submitted through the MFSA LH Portal initially by 30 April 2025 and subsequently in line with the deadlines stipulated in the Markets in Crypto-Assets Rulebook and outlined in the CASP Regulatory Documentation Table thereafter. It is the responsibility of the Authorised Person to ensure the timely submission of the CASP Return and the accuracy of all data provided, in accordance with the applicable regulatory framework. Failure to comply with the above requirements may result in regulatory action in line with the Authority’s enforcement procedures. Should any difficulties arise in compiling the CASP Return, Authorised Persons are advised to schedule a meeting with the Authority by sending an email to SUFintech@mfsa.mt for further assistance. 4 April 2024
