Decision No. 63/2005/QD-BTC on the Issuance of the Accounting Regime for Securities Investment Funds

DECISION

On the Issuance of the Accounting Regime for Securities Investment Funds

MINISTER OF THE MINISTRY OF FINANCE

Pursuant to the Law on Accounting No. 03/2003/QH11 dated June 17, 2003, and Government Decree No. 129/2004/NĐ-CP dated May 31, 2004, detailing and guiding the implementation of certain articles of the Law on Accounting in business activities;

Pursuant to Government Decree No. 77/2003/NĐ-CP dated July 1, 2003, defining the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Pursuant to Government Decree No. 144/2003/NĐ-CP dated November 28, 2003, on Securities and the Securities Market;

At the proposal of the Head of the Accounting and Audit Department, the Chairman of the State Securities Commission, and the Chief of the Ministry of Finance Office,

DECIDES:

Article 1:

To issue the "Accounting Regime for Securities Investment Funds" to be applied to the accounting work of Securities Investment Funds. The Accounting Regime for Securities Investment Funds consists of 4 parts:

Part One: System of Accounting Documents;

Part Two: System of Accounting Accounts;

Part Three: System of Accounting Books and Applied Accounting Forms;

Part Four: System of Financial Reports.

Article 2:

The Accounting Regime for Securities Investment Funds issued by this Decision applies to all Securities Investment Funds nationwide and replaces the Accounting Regime for Securities Investment Funds approved according to Official Dispatch No. 2913/TC/CĐKT dated November 8, 2004, of the Ministry of Finance.

Securities Investment Fund Management Companies shall close the accounting books of each Securities Investment Fund at the time of December 31, 2005, to calculate the transfer of account balances from old accounting accounts to new accounting accounts effective from January 1, 2006, according to the Accounting Regime issued by this Decision.

Other accounting provisions not specified in this Decision shall be implemented in accordance with the Law on Accounting and Government Decree No. 129/2004/NĐ-CP dated May 31, 2004, detailing and guiding the implementation of certain articles of the Law on Accounting in business activities.

Article 3:

This Decision takes effect 15 days after the date of gazette publication.

Article 4:

The Director of the Securities Investment Fund Management Company is responsible for directing and organizing the implementation of separate accounting work for each fund managed by the Company according to the provisions in this Decision and the provisions of the Law on Accounting and Government Decree No. 129/2004/NĐ-CP.

The Management Company must ensure the organization and implementation of the accounting work of the Securities Investment Fund are separated from the organization and implementation of the accounting work of the Fund Management Company itself.

Article 5:

The Head of the Accounting and Audit Department, the Chairman of the State Securities Commission, the Chief of the Office, the Head of the Finance and Banking and Financial Organizations Department, and the heads of relevant units are responsible for guiding and inspecting the implementation of this Decision.
