Executive Order No. 743 Promoting Fair and Lawful Access to Financial Services

The policy of the State of Alabama is that no person shall be denied access to financial services due to their beliefs, affiliations, political views, or engagement in lawful activity. The order adopts this policy to ensure state-chartered banking institutions understand they are held to expectations that the provision of banking services should be based on material, measurable, and justifiable business risks. The order is effective immediately and aligns with the principles declared in Executive Order 14331 issued on August 7, 2025.

EXECUTIVE ORDER NO. 743 P R O M O T I N G F A I R A N D L A W F U L AC C E S S T O F I N A N C I A L S E R V I C E S WHEREAS ensuring reliable access to financial services is fundamental to the economic stability and continued success of the State of Alabama; WHEREAS the Alabama Banking Code provides that state-chartered banking institutions shall be financially sound and shall serve the convenience and needs of local communities by providing services to law-abiding customers; WHEREAS banking institutions should not restrict access to financial services based on customers’ beliefs, affiliations, political views, or engagement in lawful activity; WHEREAS practices such as these undermine public trust in banking institutions and the understanding that the provision of banking services should be based on material, measurable, and justifiable business risks; WHEREAS, on August 7, 2025, President Donald J. Trump issued Executive Order 14331, Guaranteeing Fair Banking for All Americans, declaring that no American should be denied access to financial services because of their constitutionally or statutorily protected beliefs, affiliations, or political views; WHEREAS this principle aligns with the long-held position of the State of Alabama, and it is prudent to adopt a formal policy to ensure that state‑ chartered banking institutions understand they are held to such expectations; NOW, THEREFORE, I, Kay Ivey, Governor of the State of Alabama, by virtue of the authority vested in me by the Constitution and laws of the State of Alabama, do hereby promulgate this executive order, effective immediately.

  1. General policy. It is the policy of the State of Alabama that no person shall be denied access to financial services due to their beliefs, affiliations, political views, or engagement in lawful activity.
