The Office of Financial Regulation revokes the mortgage broker license (MBR7203) of Vista Capital Services Inc. and the loan originator license (LO53610) of Xiomara Aurora Medina effective July 16, 2026. This action results from the Respondents' failure to pay a $3,500 administrative fine imposed in October 2025 and their subsequent waiver of the right to an administrative hearing by not responding to the Amended Administrative Complaint within the required 21-day period.

FINAL ORDER /16/2026 LEG~L Case Number: 135734 The State of Florida, Office of Financial Regulation ("Office"), being authorized and directed to administer and enforce chapter 494, Florida Statutes, hereby enters this Final Order with Notice of Rights ("Final Order") as authorized by the provisions of chapters 120 and 494, Florida Statutes, against VISTA CAPITAL SERVICES INC., and XIOMARA AURORA MEDINA ("Respondents"). FINDINGS OF FACT
The Office has jurisdiction over the subject matter of this case and the parties hereto.
At all times material, Vista Capital Services Inc., is and has been licensed in Florida as a mortgage broker, having been issued license number MBR7203, pursuant to chapter 494, Florida Statutes.
At a11 times material, Xiomara Aurora Medina has been licensed with the Office as a loan originator, having been issued license number L053610.
On October 27, 2025, the Offic.e entered a Final Order against Respondents in case number 130046 which imposed an administrative fine of $3,500.00 and required payment within 30 days of the Final Order (i.e., November 26, 2025). To date, Respondents have not paid this administrative fine.
On June 2, 2026, the Office issued an Amended Administrative Complaint ("Complaint") (Exhibit A) seeking license revocation.
The Complaint contained a Notice of Rights, which fully advised Respondents that they had twenty-one (21) days after the receipt of the Complaint within which to petition the Office for an administrative hearing to contest the allegation set forth in the Complaint, in accordance with sections 120.59 and 120.57, Florida Statutes, including the following information: TO PRESERVE THE RIGHT TO A HEARING, A WRITTEN RESPONSE MUST BE FILED WITH THE OFFICE OF FINANCIAL REGULATION WITHIN TWENTY-ONE (21) DAYS AFTER THE RECEIPT OF THE ADMJNISTRA TIVE COMPLAINT. SAID RESPONSE MUST BE RECEIVED BY THE OFFICE NO LATER THAN 5:00 P.M. ON THE TWENTYFIRST DAY AFTER THE RECEIPT OF THE ADMINISTRATIVE COMPLAINT. A FAILURE TO TIMELY RESPOND IN WRITING WILL CONSTITUTE A WA IVER OF THE LICENSEE'S RIGHT TO REQUEST A HEARING AND A FINAL ORDER MAY BE ENTERED WITHOUT FURTHER NOTICE.
Respondents were served the Complaint via U.S. Certified Mail on June 5, 2026, (Exhibit B). As such, a response was due no later than Friday, June 26, 2026. To date, the Office has neither received a written response to the Complaint nor have Respondents made a claim of equitable tolling.
The Findings of Fact alleged in the Complaint are hereby incorporated by reference and adopted as Findings of Fact in this Final Order. CONCLUSIONS OF LAW
Pursuant to sections 494.0011 and 494.0012, Florida Statutes, the Office is charged with administering and enforcing the provisions of chapter 494, Florida Statutes, and conducting examinations and investigations to determine whether any provision of chapter 494, Florida Statutes, has been violated. Thereby, the Office has jurisdiction over the subject matter of this case and of the parties hereto. 2
Section 120.569(2)(a), Florida Statutes, and Rule 28-106.111 (2), Florida Administrative Code, require, among other things, that a response or a petition to an action which affects the substantial interests of a party be filed with the agency within 21 days of receipt of written notice of the action.
Section 120.569(2)( c ), Florida Statutes, provides that a petition for hearing shall be dismissed if it has been untimely filed (not within 21 days).
Pursuant to Rule 28-106.111(4), Florida Administrative Code, the failure of Respondents to timely respond to the Complaint constitutes a waiver of Respondents' right to an administrative proceeding.
The doctrine of equitable tolling can be applied in administrative cases when a party has been misled or lulled into inaction, i.e., has in some extraordinary way, been prevented from asserting his rights, or has timely asserted his rights in the wrong forum. Machules, v. Department of Admin., 523 So. 2d 1132 (Florida 1988).
Without any evidence of equitable tolling, it is appropriate for the Office to conclude there was none. Patz v. Dept. of Health, 864 So.2d 79, 80 (Fla. 3d DCA 2003).
When Respondents failed to submit a response to the Office on or before June 26, 2026, Respondents did not timely file a petition or any other document in response to the Complaint. Respondents also presented no claim, or evidence of equitable tolling. Therefore, it is appropriate for the Office to conclude there was no equitable tolling and Respondents waived their right to an administrative proceeding.
Based on the Findings of Fact adopted herein, the Office concludes that Respondents violated the specific statutes and rules charged in the Complaint and, as such, the specific charges in the Complaint are adopted in this Final Order as Conclusions of Law.
The Findings of Fact and Conclusions of Law that form the basis for the Complaint, together with the waiver of a hearing by Respondents, constitute grounds for the Office to revoke 3

Pursuant to section 494.0011 (l ), Florida Statutes, the Office is charged with administering and enforcing the provisions of chapter 494, Florida Statutes.
Pursuant to section 494.00255(1 )(u), Florida Statutes, failure to comply with any provision of chapter 494, Florida Statutes, or the rules promulgated thereunder constitutes grounds for disciplinary action.
Pursuant to section 494.001(23), Florida Statutes, a "mortgage broker" means a person conducting loan originator activities through one or more licensed Joan originators employed by the mortgage broker or as independent contractors to the mortgage broker.
Pursuant to section 494.001(30), Florida Statutes, a "principal loan originator., is the licensed loan originator in charge of, and responsible for, the operation of a mortgage broker.
Vista Capital Services Inc., ("Vista Capital Services") has been licensed with the Office as a mortgage broker (license no. MBR7203) since July 5, 2022.
Xiomara Aurora Medina ("Medina") has been licensed with the Office as a loan originator (license no. LO53610) since May 22, 2018.
Medina is the designated principal loan originator and sole owner of Vista Capital Services.
As such, pursuant to section 494.001(30), Florida Statutes, Medina is responsible for the daily operations of Vista Capital Services.
Pursuant to section 494.00255(1 )(x), Florida Statutes, failure to timely pay any fee, charge, or fine imposed or assessed pursuant to this chapter or related rules constitutes grounds for disciplinary action.
On October 27, 2025, the Office entered a Final Order against Vista Capital Services and Medina, in Case No. 130046 for violations of chapter 494, Florida Statutes. In the Final Order entered by the Office against Respondents on October 27, 2025, Respondents were ordered to pay an administrative fine of $3,500.00 within 30 days (i.e. by November 26, 2025).
The administrative fine was not received by the Office within thirty (30) days, as required by the Final Order (130046).
Respondents have failed to pay the fine assessed by the Office within 30 days after the due date as stated in the Final Order, in violation of section 494.00255(l)(x), Florida Statutes.
Pursuant to the Disciplinary Guidelines for Mortgage Loan Originators and Mortgage Entities Fonn OFR-494-14, Incorporated by Reference in Rule 69V-40.111, Florida Administrative Code (2024), violation number 40, the Office may impose a fine of $1,000 up to $3,500 and suspend a license up to 90 days or revoke a license for a violation of section 494.00255(l)(x), Florida Statutes.

broker license, MBR7203 and Xiomara Aurora Medina's loan originator license, LO53610.
