FINDINGS OF FACT

  1. On March 3, 2026, the Office issued an Administrative Complaint ("Complaint") against Respondents alleging violations of chapter 560, Florida Statutes, and seeking an administrative fine of $13,500.00, and revocation of the Money Services Business license number FT30800188. (Exhibit A)

  2. The Office served Respondents with the Complaint via U.S. Certified Mail at their address of record with the Office on March 7, 2026. (Exhibit B)

  3. Pursuant to the Notice of Rights contained within the Complaint, any written response to the Complaint was due on or before March 30, 2026.

  4. After the deadline, Respondents submitted a written response indicating that they did not dispute any of the Office's factual allegations and conclusions oflaw, were not requesting a hearing, and consented to the entry of a final order adopting the findings of fact and conclusions of law contained in the Complaint. (Exhibit C)

  5. The factual allegations as stated m the Complaint are incorporated herein by reference as if fully set forth herein, and being uncontested by Respondents, are accepted as true and correct and are adopted by the Office as Findings of Fact for purposes of this Final Order. CONCLUSIONS OF LAW

  6. The Office is responsible for the administration and enforcement of chapter 560, Florida Statutes, and has jurisdiction over the subject matter and of Respondents pursuant to chapter 560, Florida Statutes.

  7. The Findings of Fact that have been adopted herein serve as the basis of the entry of this Final Order against Respondents.

  8. Section 120.569(2)(a), Florida Statutes, and Rule 28-106.111(2), Florida Administrative Code, require, among other things, that a response or a petition to an action which affects the substantial interests of a party be filed with the agency within 21 days of receipt of written notice of the action. Further, pursuant to Rule 28-106.111(4), Florida Administrative Code, a failure to timely respond to written notice of the action constitutes a waiver of the right to an administrative proceeding.

  9. Irrespective of the timing of its submission, Respondents' written response shows Respondents' waiver of a hearing in this matter and consent to the imposition of the penalties sought in the Complaint.

  10. Based on the Findings of Fact adopted herein, the Office concludes that Respondents violated the specific statutes and rules charged in the Complaint and, as such, and 2

being uncontested by Respondents, the specific charges in the Complaint are adopted in this Final Order as Conclusions of Law. 11. The waiver of a hearing by Respondents, taken together with the Findings of Fact and Conclusions of Law adopted herein, constitute sufficient grounds for the Office to take administrative action against Respondents, including the imposition of an administrative fine and revocation of Money Services Business license number FT30800188. Based on the foregoing Findings of Fact and Conclusions of Law, it is hereby ORDERED: A. Within thirty (30) days of the date of this Final Order, KRUTI CORPORATION D/B/A E-Z WAY FOOD & BEVERAGE and KETANKUMAR PATEL shall pay an ADMINISTRATIVE FINE of Thirteen Thousand Five Hundred Dollars ($13,500.00).   1. Pursuant to sections 560.105 and 560.109, Florida Statutes, the Office is charged with administering and enforcing the provisions of chapter 560, Florida Statutes, and conducting examinations and investigations to determine whether any provision of chapter 560, Florida Statutes, has been violated.

  2. Pursuant to section 560.l 14(1)(a), Florida Statutes, failure to comply with any provision of chapter 560, Florida Statutes, or related rule or order, constitutes grounds for disciplinary action.

  3. Parts II, III, and IV of chapter 560, Florida Statutes, set forth the specific requirements of money services businesses and licenses.

  4. Pursuant to section 560.103(23), Florida Statutes, the term "money services business" includes any person located in or doing business in Florida or from Florida or into Florida from locations outside of Florida who acts as, among other things, a check casher.

  5. Pursuant to section 560.103(6), Florida Statutes, a "check casher" is a person who sells currency in exchange for payment instruments received, except travelers checks.

  6. Pursuant to section 560.103(29), Florida Statutes, a "payment instrument" means a check, draft, warrant, money order, travelers check, electronic instrument, or other instrument, used for the transmission, exchange, or payment of currency or monetary value, regardless of whether it is negotiable.

  7. Pursuant to section 560.103(12), Florida Statutes, "currency" means the coin and paper money of the United States or of any other country which is designated as legal tender and which circulates and is customarily used and accepted as a medium of exchange in the country of issuance.

  8. Pursuant to section 560.l 14(1)(a), Florida Statutes, an "affiliated party" is responsible for, among other things, complying with all provisions of chapter 560, Florida Statutes, and its related rules or orders.

  9. Pursuant to section 560.103(1), Florida Statutes, an "affiliated party" is, among other things, a control person, or a person who has a controlling interest in a money services business.

  10. Pursuant to section 560.103(10)(a), Florida Statutes, a "control person" is, among other things. the president, or the compliance officer, of a money services business.

  11. Pursuant to section 560.127, Florida Statutes, a person has a controlling interest in a money services business if the person, among other things, possesses the power, directly or indirectly, to direct the management or policies of the money services business.

  12. At all times material, Kruti Corporation d/b/a E-Z Way Food & Beverage ("Kruti") is and has been licensed as a Part III Money Services Business pursuant to chapter 560, Florida Statutes, operating as a check casher, holding license number FT30800188. 2

  13. At all times material, Ketankumar Patel ("Patel") is and has been the President, Compliance Officer, and Sole Owner of Kruti, and by operation of law, pursuant to section 560.103(1), Florida Statutes, Patel is an affiliated party who is liable for all violations ofKruti.

  14. The Office conducted an examination (No. 131097) to ascertain Respondents' compliance with chapter 560, Florida Statutes.

  15. Pursuant to section 560.l 14(1)(a), Florida Statutes, each money services business and its affiliated parties must comply with all provisions of chapter 560, Florida Statutes, and its related rules and orders, and the Office may revoke a money services business license for failure to comply.

  16. Pursuant to section 560.1141, Florida Statutes, the Office has adopted disciplinary guidelines that include ranges of designated penalties applicable to each ground for disciplinary action.

  17. Pursuant to Rule 69V-560.1000(5), Florida Administrative Code, the range for an "A" level administrative fine is between $1,000.00 and $3,500.00.

  18. Pursuant to Rule 69V-560.1000(5), Florida Administrative Code, the range for a "C" level administrative fine is between $7,500.00 and $10,000.00. COUNTI

  19. The above general allegations are hereby re-alleged and incorporated by reference as if fully stated herein.

  20. Pursuant to section 560.114(1)(a), Florida Statutes, it is grounds for disciplinary action if a money services business or an affiliated party fails to comply with any order entered pmsuant to chapter 560, Florida Statutes.

  21. On December 30, 2024, the Office entered Final Order No. OFR 2024-791 against Respondents in Case No. 120247, for violations of chapter 560, Florida Statutes. By that Final 3

Order, license number FT30800188 was suspended for a period of Twenty-Eight (28) days, effective ninety (90) days from the date of the issuance of the Final Order. 22. As part of its examination, the Office reviewed Respondents' check log, bank statements, cashed payment instruments, and quarterly reports, and found that Respondents cashed 31 payment instruments during the period of March 30, 2025, through April 27, 2025, while license number FT30800188 was suspended. 23. Respondents failed to comply with the provisions of the Office's Final Order No. OFR 2024-791 entered in Case No. 120247 on December 30, 2024, in violation of section 560.l 14(1)(a), Florida Statutes. 24. Pursuant to the Disciplinary Guidelines for Money Services Businesses Form OFR￾560-09, incorporated by reference in Rule 69V-560.1000, Florida Administrative Code, violation number 3, a person receiving a first citation for violating section 560.114(1)(a), Florida Statutes, is subject to an "A" level administrative fine and revocation of license. 25. Therefore, the Office is seeking an administrative fine of$3,500.00, and revocation of license number FT30800188. COUNT II 26. The above general allegations are hereby re-alleged and incorporated by reference as if fully stated herein. 27. Pursuant to section 560.310(1), Florida Statutes, and Rule 69V-560.704(2)(a), Florida Administrative Code, a licensee engaged in check cashing must maintain a legible copy of the front and back of each cashed payment instrument for a period of at least 5 years. 28. As part of its examination, the Office reviewed Respondents' check log, bank statements, cashed payment instruments, and quarterly reports and found that Respondents cashed 31 payment instruments during the period of March 30, 2025, through April 27, 2025. 4

  1. As part ofits examination, the Office requested that Respondents provide a copy of the front and back of those 31 payment instruments.
  2. In response, Respondents stated that they were unable to locate the requested copies after a diligent search of all areas in which the relevant books and records are maintained or stored, and that Respondents had no reasonable basis to believe that any other books or records exist that would provide such information.
  3. Respondents failed to maintain legible copies of the front and back of each payment instrument cashed, in violation of Rule 69V-560.704(2)(a), Florida Administrative Code, and section 560.310(1 ), Florida Statutes.
  4. The Office previously found Respondents in violation of section 560.310(1 ), Florida Statutes, by Final Order No. OFR 2024-791, docketed on December 30, 2024, and by Final Order OFR 2017-275, docketed on May 8, 2017; thus, Respondents' instant violation is a third citation for violating section 560.310(1 ), Florida Statutes.
  5. Pursuant to the Disciplinary Guidelines for Money Services Businesses Form OFR￾5 60-09, incorporated by reference in Rule 69V -560 .1000, Florida Administrative Code, violation number 94, a person receiving a third citation for violating section 560.310(1), Florida Statutes, is subject to a "C" level administrative fine and revocation of license.
  6. Therefore, the Office is seeking an administrative fine of $10,000.00, and revocation of license number FT30800188. WHEREFORE, Respondents, KRUTI CORPORATION D/B/A E-Z WAY FOOD & BEVERAGE and KETANKUMAR PATEL, are hereby notified that the Office intends to enter a Final Order imposing an administrative fine totaling $13,500.00, and revocation of license number FT30800188. 5
