Grand-ducal Regulation of 18 December 2015 implementing Article 1(5) of Regulation (EU) 2015/751 on interchange fees

The regulation exempts three-party payment card schemes from the obligations under Chapter II of Regulation (EU) 2015/751 for national payment transactions in Luxembourg until 9 December 2018. This exemption applies only to schemes whose card-based payment transactions made in Luxembourg do not exceed 3% of the total value of all such transactions annually. The Minister of Finance is responsible for executing this regulation, which is published in the Mémorial.

Grand-ducal Regulation of 18 December 2015 implementing Article 1(5) of Regulation (EU) 2015/751 of the European Parliament and of the Council of 29 April 2015 on interchange fees for card-based payment transactions. (Mém. A 2015, No 247) Article 1. Pursuant to Article 1(5) of Regulation (EU) 2015/751 of the European Parliament and of the Council of 29 April 2015 on interchange fees for card-based payment transactions (hereinafter, “Regulation (EU) 2015/751”), the three party payment card schemes referred to in said paragraph 5 are exempted, as far as national payment transactions in Luxembourg are concerned, from the obligations under Chapter II of Regulation (EU) 2015/751 until 9 December 2018. This exemption shall only apply to three party payment card schemes whose card-based payment transactions made in Luxembourg do not exceed, on a yearly basis, 3% of the value of all card-based payment transactions made in Luxembourg. Article 2. Our Minister of Finance shall execute this regulation which shall be published in the Mémorial.
