Instruction No. 33/2018 establishes the rules and the model for communication to the Bank of Portugal of information relating to credit contracts regulated by Decree-Law No. 74-A/2017, of June 23, which partially transposed Directive No. 2014/17/EU of the European Parliament and of the Council, of February 4, relating to credit agreements for consumers relating to immovable property.

The information collected through the aforementioned Instruction has allowed the Bank of Portugal, in the exercise of its behavioral supervision functions, to monitor and supervise the housing credit and mortgage credit market.

However, considering that it is now possible to extract the information obtained through Instruction No. 33/2018, with an identical level of granularity and precision, from the Credit Liability Central, it is considered that the maintenance of the aforementioned reporting obligation is not justified.

Thus, in the exercise of the powers conferred upon it by Article 17 of its Organic Law, approved by Law No. 5/98, of January 31, and by Article 120 of the General Regime of Credit Institutions and Financial Companies, approved by Decree-Law No. 298/92, of December 31, the Bank of Portugal determines the following:

Article 1. Revoking Norm

Instruction No. 33/2018 of the Bank of Portugal, published in the Official Bulletin No. 12/2018 (Supplement) on December 19, 2018, is revoked.
