Instruction No. 2010-01 of February 1, 2010, on the designation of declarants and correspondents by manual money changers

The Banking Commission, Having regard to the Monetary and Financial Code, in particular Articles L. 524-1 and following, L. 561-15, L. 613-8, R. 561-23 and R. 561-24; Having regard to the Order of September 10, 2009, relating to the activity of manual money changer, in particular Article 7; Decides:

Article 1 Manual money changers referred to in Article L. 524-1, II of the Monetary and Financial Code are subject to this Instruction. This Instruction also applies to the persons referred to in Article 11 of the aforementioned Order who have submitted to the Prudential Supervision and Resolution Authority the attestation of exercise referred to in the same Article.

Article 2 The persons subject to this Instruction shall report information relating to the identity of the declarants and correspondents respectively referred to in Articles R. 561-23 and R. 561-24 of the aforementioned Code on the tables attached to this Instruction. The tables are signed by the manager of the person subject to this Instruction and sent in paper format to the General Secretariat of the Prudential Supervision and Resolution Authority by February 28 of each year at the latest. By way of derogation, the submission in 2010 of the tables attached to this Instruction must be carried out by April 30, 2010 at the latest.

Article 3 In the event of cessation by one or more declarants or correspondents of their functions or in the event of the appointment of one or more declarants or correspondents during the year, new statements are communicated without delay to the General Secretariat of the Prudential Supervision and Resolution Authority according to the same transmission methods. Similarly, upon obtaining the authorization to exercise their activity, manual money changers communicate without delay the tables attached to the General Secretariat of the Prudential Supervision and Resolution Authority.
