Instruction No. 2026-I-03 on the Frequency of Submission of the Regular Report to the Supervisor Replacing Instruction No. 2017-I-22 of December 19, 2017

The Prudential Control and Resolution Authority establishes that insurance entities and groups subject to regular reporting must submit reports annually, biennially, or triennially based on specific size and complexity thresholds defined in Instruction No. 2026-I-04. Entities qualifying as small and non-complex or falling below quarterly reporting thresholds are exempt from annual submission, with the Authority retaining the right to mandate annual reporting for non-exempt entities below those thresholds. This Instruction replaces Instruction No. 2017-I-22 and enters into force on January 30, 2027.

Instruction No. 2026-I-03 on the frequency of submission of the regular report to the supervisor replacing Instruction No. 2017-I-22 of December 19, 2017

The Prudential Control and Resolution Authority, Having regard to Delegated Regulation (EU) 2015/35 of the Commission of October 10, 2014 supplementing Directive 2009/138/EC of the European Parliament and of the Council on the taking up and pursuit of the business of Insurance and Reinsurance (hereinafter "Solvency II"); Having regard to Delegated Regulation (EU) 2026/269 of the Commission of October 29, 2025 amending Delegated Regulation (EU) 2015/35 as regards technical provisions, measures relating to long-term guarantees, own funds, equity risk, spread risk on securitisation positions, other capital requirements under the standard formula, disclosure and publication of information, proportionality and group solvency; Having regard to the Insurance Code, in particular Articles L. 355-1, L. 356-21 and R. 355-5-2; Having regard to the Monetary and Financial Code, in particular Article L. 612-24; Having regard to the Mutual Code; Having regard to the Social Security Code; Having regard to the opinion of the Prudential Affairs Advisory Committee (CCAP) dated June 26, 2026, DECIDES

Article 1: I. - Pursuant to Article R. 355-5-2 of the Insurance Code, entities and groups subject to the submission of a regular report to the supervisor are required to transmit it annually if they exceed the thresholds for the application of quarterly reporting defined respectively in Article 3 and in Article 4 of Instruction No. 2026-I-04 of July 10, 2026.

II. – By way of derogation from Paragraph I of this Article, entities and groups subject to the submission of a regular report to the supervisor that have obtained authorization from the Prudential Control and Resolution Authority to apply a reduction in the frequency of submission of the regular report to the supervisor pursuant to Article 4 of Instruction No. 2026-I-12 on proportionality are required to submit it at a biennial frequency.

III. – Pursuant to Article R. 355-5-2 of the Insurance Code, entities and groups subject to the submission of a regular report to the supervisor that meet at least one of the following two conditions are required to submit it at a triennial frequency:

  • if they benefit from the status of small and non-complex enterprises pursuant to Article L. 357-1 of the Insurance Code,
  • if they do not exceed the thresholds for the application of quarterly reporting defined respectively in Article 3 and in Article 4 of Instruction No. 2026-I-04 of July 10, 2026. The requirements defined in the preceding paragraphs also apply to group supervision at the level of the parent undertaking in France decided by the Prudential Control and Resolution Authority pursuant to Article L. 356-4 of the Insurance Code. By exception to point 2 of Article 3 of Instruction No. 2026-I-04 of July 10, 2026, the fact that an individual entity subject to supervision belongs to an insurance group subject to group supervision does not modify the frequency of submission of the regular report to the supervisor defined in this Article.

Article 2: The provisions of Article 1 of this Instruction are without prejudice to the possibility for the Prudential Control and Resolution Authority to require, pursuant to Article R. 355-5-2 of the Insurance Code, annual submission for entities and groups that do not exceed the thresholds for the application of quarterly reporting defined respectively in Articles 3 and 4 of Instruction No. 2026-I-04 of July 10, 2026 and that would not benefit from the status of small and non-complex enterprise.

Article 3: This Instruction replaces Instruction No. 2017-I-22 of December 19, 2017. References to Instruction No. 2017-I-22 of December 19, 2017 shall be understood as references to this Instruction.

Article 4: This Instruction enters into force on January 30, 2027.
