Decree of the President of the Republic of Uzbekistan

On Measures for the Implementation of the Program for the Construction and Reconstruction of Affordable Multi-Storey Buildings in Cities for 2017-2020

In order to further improve the living standards and quality of life of the population living in republican cities, including young families, those living in dilapidated housing, and other categories of citizens in need of improving housing conditions, by providing them with affordable, comfortable, and modern housing, and to strengthen their social support: [ OKOZ: 1. 09.00.00.00 Entrepreneurship and Economic Activity / 09.13.00.00 Urban Planning and Architecture / 09.13.04.00 Engineering and Transport Facilities and Communication Systems. Landscaping. Greening]

1. The construction and reconstruction of energy-efficient, affordable multi-storey buildings in the form of complexes with 5, 7, and 9 floors, equipped with relevant engineering and social infrastructure, shall be considered a priority direction for building structures and updating the cityscape in republican cities for 2017-2020.

2. The main parameters of the Program (hereinafter referred to as the Program) for the construction and reconstruction of energy-efficient, affordable multi-storey buildings in cities for 2017-2020 are approved in accordance with Appendix 1 .

It is established that, in accordance with the Program, apartments in energy-efficient, affordable multi-storey buildings constructed shall be primarily provided to young families, those living in dilapidated housing, as well as other categories of citizens in need of improving housing conditions. The Chairman of the Cabinet of Ministers of the Republic of Karakalpakstan, the Khakims (Governors) of the regions and the city of Tashkent, the Committee of "Davarxiteqturqurilish", the Agency of "Uzkommunxizmat", JSC "Uzbekenergo", JSC "Uztransgaz", JSC "Uzbektelekom", heads of main contracting organizations and commercial banks shall bear personal responsibility for the quality and timely execution of the approved parameters of the Program, taking into account the implementation of a set of measures ensuring:

timely engineering preparation of construction sites;

high-quality development of design and estimate documentation for multi-storey buildings;

reasonably formed prices for the construction and reconstruction of multi-storey buildings;

rapid construction of external engineering communications and social infrastructure facilities.

3. Within the framework of the implementation of the Program: [ OKOZ:

the function of selling apartments by providing loans to customers for the construction and reconstruction of multi-storey buildings, as well as by formalizing mortgage loans for borrowers to purchase apartments, is assigned to JSC "Ipoteqa Bank" as the financing commercial bank;

the function of technical supervision over the timely and high-quality execution of construction and reconstruction works, including the formalization of necessary design and estimate documentation, standard projects, and the targeted and efficient use of funds, is assigned to IK "Uzshahar Qurilish Invest" as the customer (hereinafter referred to as the customer);

based on the results of tender auctions conducted with the participation of contracting organizations included in the Registry of Contracting Organizations by the Interdepartmental Tender Commission (B.I. Zakirov) for the purchase of goods, works, and services within the framework of investment projects implemented in the utility sector, transport, capital construction, and construction industry, main contracting organizations for the construction and reconstruction of multi-storey building complexes together with engineering communications and social infrastructure facilities are designated.

The Interdepartmental Tender Commission (B.I. Zakirov) is permitted to identify contracting organizations for objects planned for construction in 2017 within the framework of the Program by selecting the best offers, as an exception.

4. JSC "Ipoteqa Bank": [ OKOZ:

within the framework of the implementation of the Program planned for 2019, open credit lines to IK "Uzshahar Qurilish Invest" for the construction and reconstruction of multi-storey buildings at an annual rate of 7 percent up to 95 percent of the object value until the approval of its design and estimate documentation;

accept as collateral for IK "Uzshahar Qurilish Invest"'s obligations on loans the funds to be received from the sale of apartments in multi-storey buildings in the future during the period until the apartments are sold to the population; [ OKOZ: 1. 07.00.00.00 Legislation on Finance and Credit. realize apartments to young families, those living in dilapidated housing, other categories of citizens in need of improving housing conditions, as well as military servicemen of the Ministry of Defense of the Republic of Uzbekistan by providing mortgage loans for a term of 20 years at an annual rate of 7 percent for the first 5 years (taking into account a 3-year preferential period), with a preferential period of one year when the Program planned for 2020 begins, and at a rate that increases uniformly to the refinancing rate of the Central Bank of the Republic of Uzbekistan during the first 5 years (with a strictly fixed annual rate of 7 percent), and at the refinancing rate of the Central Bank of the Republic of Uzbekistan for subsequent periods; Previous version.

The repayment in full of loans granted to IK "Uzshahar Qurilish Invest" for the construction and reconstruction of multi-storey buildings, as well as the interest accrued on them, shall be carried out from the funds received from the sale of apartments; (Fifth subparagraph of paragraph 4, in the edition of the Decree of the President of the Republic of Uzbekistan No. PF-62 dated April 26, 2023 — , 27.04.2023, 06/23/62/0232) [ OKOZ: 1. 07.00.00.00 Legislation on Finance and Credit. if there are no applications from young families, those living in dilapidated housing, and other categories of citizens in need of improving housing conditions, sell apartments to other layers of the population in the manner established by law by providing mortgage loans for a term of 10 years at the refinancing rate of the Central Bank of the Republic of Uzbekistan (taking into account a 6-month preferential period) on the condition of prepayment of at least 50 percent of their value;

organize structural subdivisions at the bank's head office and branches for financing and monitoring the construction and reconstruction of multi-storey buildings, as well as for providing loans to the population. 5. JSC "Ipoteqa Bank" is granted a right of priority over unfinished multi-storey buildings, as well as over the disposal of apartments, until borrowers fully fulfill their credit obligations in accordance with the terms of the credit agreement. 6. The parameters and sources of financing for the implementation of the Program in 2017 are established in accordance with Appendix 2 , including: [ OKOZ:

funds in the amount of 751.1 billion soums, provided by ATB "Xalq Bank" on the basis of orders from JSC "Ipoteqa Bank" for providing loans to contracting organizations and mortgage loans to individuals participating in the implementation of the Program, in national currency, to a bank interbank deposit account at an annual rate of 6.5 percent for a term of 20 years (taking into account a 5-year preferential period); [ OKOZ: 1. 07.00.00.00 Legislation on Finance and Credit. initial payments of individuals in the amount of 25 percent of the apartment value;

own funds of non-governmental organizations expressing readiness to participate in financing the construction and reconstruction of housing for their employees in need of improving housing conditions.

8. Within the framework of the Program, the following are permitted as exceptions:

simultaneously developing design and estimate documentation for multi-storey buildings and carrying out construction works by April 1, 2017; [ OKOZ: 1. 07.00.00.00 Legislation on Finance and Credit. providing funds in the amount of 100 billion soums by ATB "Xalq Bank" in 2016 on the basis of orders from JSC "Ipoteqa Bank" to start work on creating reserves for the 2017 Program;

purchasing centralized basic construction materials and equipment delivered to contracting organizations for the construction of multi-storey affordable housing complexes by IK "Uzshahar Qurilish Invest" without conducting tender auctions, by selecting the best offers.

9. The Ministry of Finance of the Republic of Uzbekistan, together with the Ministry of Economy, the Ministry of Foreign Economic Relations, Investments and Trade, and the Central Bank, shall submit proposals to the Cabinet of Ministers by August 1 of each year regarding the specific sources of financing for the implementation of the Program in subsequent periods.

10. The composition of the Working Group for coordinating the implementation of the Program and monitoring it is approved in accordance with Appendix 3 .

The following main tasks are assigned to the Working Group:

systematic monitoring of the timely and high-quality execution of measures provided for in the Program, and, if necessary, making changes and additions to the main parameters and target lists for the construction and reconstruction of affordable multi-storey buildings;

coordination of the implementation of works on the construction and reconstruction of affordable multi-storey buildings included in the Program;

ensuring the implementation of a unified policy aimed at strict compliance with urban planning, ecological, sanitary, fire safety, and other mandatory norms and rules in the implementation of the Program.

11. The Cabinet of Ministers of the Republic of Karakalpakstan, the Khakims of the regions and the city of Tashkent shall ensure by February 1, 2017, the identification of potential borrowers within the framework of the 2017 Program, the formation of their initial payments, as well as, within the framework of preparing Program parameters for subsequent years annually:

by April 1 — formation of a list of land plots with the opportunity to use external engineering communications and social infrastructure facilities for the construction and reconstruction of multi-storey buildings, taking into account the approved master plans of cities, and their subsequent transfer to the customer for the construction of multi-storey buildings, in coordination with the State Committee of the Republic of Uzbekistan "Yergeodezkadestr" and the State Committee "Davarxiteqturqurilish";

by April 1 — identification of potential borrowers and the formation of their initial payments;

by June 1 — preparation of the project for the construction of multi-storey building complexes together with relevant engineering and social infrastructure in collaboration with design organizations;

by July 1 — adaptation of standard projects to local conditions and development of design and estimate documentation for the construction and reconstruction of multi-storey buildings, external engineering communications, and social infrastructure facilities, in collaboration with the State Committee "Davarxiteqturqurilish" of the Republic of Uzbekistan, design organizations, and other interested ministries and departments;

by August 1 — approval of target and title lists of construction.

12. The following are designated as sources of financing within the framework of the implementation of the Program:

funds allocated by JSC "Ipoteqa Bank" for the part of developing standard projects for multi-storey buildings;

funds of local budgets of the Cabinet of Ministers of the Republic of Karakalpakstan, the Khakims of the regions and the city of Tashkent for the part of preparing the project for the construction of multi-storey building complexes together with relevant engineering and social infrastructure;

own funds of JSC "Uzbekenergo", JSC "Uztransgaz", and JSC "Uzbektelekom" respectively, for the part of constructing taking lines and area internal electricity supply, gas supply, and communication networks, taking into account the provision of continuous operation;

funds of local budgets of the Cabinet of Ministers of the Republic of Karakalpakstan, the Khakims of the regions and the city of Tashkent for the part of constructing taking lines and area internal water supply and sewerage networks, landscaping and greening of adjacent territories, taking into account the installation of irrigation water pipes, irrigation channels, and external lighting systems.

The Ministry of Finance and the Ministry of Economy of the Republic of Uzbekistan, based on justified calculations, shall provide for the relevant budget funds in the parameters of the State Budget of the Republic of Uzbekistan to the Cabinet of Ministers of the Republic of Karakalpakstan, the Khakims of the regions and the city of Tashkent for financing the aforementioned measures.

13. The State Committee "Davarxiteqturqurilish" of the Republic of Uzbekistan, together with interested design organizations, shall ensure the development and approval of standard projects for multi-storey buildings within two months, paying special attention to the following:

wide use of modern construction materials, structures, and products produced in our country, which ensure a qualitative increase in energy efficiency and a decrease in the comparative cost of construction and reconstruction; architectural and planning solutions for construction, taking into account the master plans of cities and natural-climatic conditions;

implementation of energy-saving technologies in organizing the stable delivery of drinking water, taking into account the construction of water supply structures, apartment lighting, heating systems, and mandatory installation of modern metering devices;

functional zoning of streets and courtyards of housing complexes under construction, taking into account the organization of recreation areas for residents of multi-storey buildings, rational placement and construction of playgrounds and waste collection points, equipped parking spaces, and landscaping of adjacent territories.

14. The Ministry of Finance of the Republic of Uzbekistan, together with the Central Bank, the Ministry of Economy, and JSC "Ipoteqa Bank", shall submit proposals to the Cabinet of Ministers of the Republic of Uzbekistan within two months to increase the authorized capital of JSC "Ipoteqa Bank" by 100 billion soums by increasing the state's share in the bank's statutory capital. 15. The State Committee of the Republic of Uzbekistan for Investments, together with the Ministry of Finance, the Ministry of Economy, and JSC "Ipoteqa Bank", shall attract international financial institutions, foreign government financing institutions, as well as long-term preferential credits of foreign countries for financing the implementation of the Program. 16. The following:

a) Individuals (debtors) shall be exempt from property tax on apartments purchased until the mortgage loans provided by JSC "Ipoteqa Bank", ATB "Uzsanoatqurilishbank", and ATB "Asaka Bank" within the framework of the implementation of the Program are fully paid off by July 1, 2020;

b) Within the framework of the implementation of the Program by January 1, 2020:

main contracting and subcontracting organizations — from payment of all types of taxes in the part of the volume of works performed by them for the construction and reconstruction of multi-storey building objects under "ready for handover" conditions;

organizations producing construction materials, equipment, construction machinery, and vehicles (located within the republic) — from value-added tax and unified tax payments in the part of the volume of construction materials, equipment, construction machinery, and vehicles sold to IK "Uzshahar Qurilish Invest" and contracting organizations for the construction of multi-storey building objects under "ready for handover" conditions;

IK "Uzshahar Qurilish Invest" and main contracting organizations — from customs (excluding customs clearance fees) payments on raw materials, products, nodes, structures, construction materials, construction machinery, and equipment imported from abroad, as well as spare parts, motor vehicles, including road construction machinery, for which lists are approved in the established order for the construction of multi-storey building objects;

importing organizations — from customs (excluding customs clearance fees) payments on imported construction materials, products, raw materials, nodes, and structures, including wood-board materials and metal sheets for roofing, passenger elevators, individual heating boilers, equipment and spare parts for them, including spare parts and materials for their production (or assembly), as well as from value-added tax and unified tax payments in the part of delivering imported goods to the address of IK "Uzshahar Qurilish Invest" and main contracting organizations;

organizations performing works (services), including non-residents of the Republic of Uzbekistan — from value-added tax and unified tax payments in the part related to the implementation of the Program;

IK "Uzshahar Qurilish Invest" — from payment of all types of taxes;

c) IK "Uzshahar Qurilish Invest" shall be exempt from turnover value-added tax on the sale of housing (apartments in multi-storey buildings) constructed within the framework of the Program planned for 2017-2019 by July 1, 2020.

19. JSC "Ipoteqa Bank", starting from January 1, 2017: Previous version. be exempt from payment of state duty in courts of general jurisdiction regarding claims to resolve disputes with contracting organizations on issues of construction and reconstruction of multi-storey buildings, as well as regarding claims to recover creditor debts of borrowers on mortgage loans provided for the purchase of apartments in multi-storey buildings.

20. The Ministry of Economy of the Republic of Uzbekistan shall provide for the allocation of metal products and cement in the necessary volumes at prices announced for contracting organizations for the construction and reconstruction of multi-storey buildings within the framework of the Program and under direct contracts in annual material balances.

21. The State Committee "Davarxiteqturqurilish" of the Republic of Uzbekistan, together with the Cabinet of Ministers of the Republic of Karakalpakstan, the Khakims of the regions and the city of Tashkent, and design organizations, shall ensure in the established order:

architectural-construction, technical, and authorship supervision over the quality of construction and installation works and compliance with urban planning norms and rules;

annual agreement with the Ministry of Finance and the Ministry of Economy of the Republic of Uzbekistan on the cost of 1 square meter of housing in multi-storey buildings to be constructed in the forecasted period, taking into account other and unforeseen expenses.

22. The National Television and Radio Company of Uzbekistan, the Uzbekistan National Information Agency, the Agency for Information and Mass Communications under the Administration of the President of the Republic of Uzbekistan, together with the Ministry of Finance, the Committee "Davarxiteqturqurilish", the Central Bank, JSC "Ipoteqa Bank", the Cabinet of Ministers of the Republic of Karakalpakstan, and the Khakims of the regions and the city of Tashkent, shall organize wide coverage in the mass media of the goals and objectives of the Program, as well as the processes of its implementation, and ensure the placement of programs and articles on this topic in the form of social advertising information.

23. The State Committee "Davarxiteqturqurilish" of the Republic of Uzbekistan, together with the Ministry of Finance, JSC "Ipoteqa Bank", and other interested ministries and departments, shall submit to the Cabinet of Ministers in the established order:

within one month — the draft Regulation on the financing of construction and reconstruction of multi-storey buildings, as well as the procedure for selling multi-storey buildings to young families, those living in dilapidated housing, and other categories of citizens in need of improving housing conditions;

within one month — the calculation of the cost structure of the customer, contractor, and financing bank to determine the cost price of a multi-storey building;

within three months — proposals on improving the mechanism for granting mortgage loans to individuals.

24. The Ministry of Economy of the Republic of Uzbekistan, together with the Committee on State Architecture and Construction "Davarxitektqurilish", the Ministry of Finance, the Ministry of Justice, and other interested ministries and departments, shall submit proposals to the Cabinet of Ministers on amendments and additions to legislative acts arising from this decision within two months.

Ministries and departments shall align the normative legal acts adopted by them with this decision.

25. Supervision over the implementation of this decision shall be entrusted to the First Deputy Prime Minister of the Republic of Uzbekistan R.S. Azimov and the Deputy Prime Minister of the Republic of Uzbekistan B.I. Zakirov.

• Parameters shall be clarified based on the approval of project and estimate documents to be developed taking into account the calculated value of 1 sq.m. of total residential area at no more than 1.94 million soums in Tashkent City, and for 7-story buildings in republican cities at no more than 1.77 million soums, and for 5-story buildings at 1.94 million soums.
