Ministerial Decree of 8 December 2003 implementing the Royal Decree of 14 November 2003 determining the approval conditions for insurance companies and bodies

This decree designates the Banking, Financial and Insurance Commission as the competent service for approving insurance companies and bodies under the Royal Decree of 14 November 2003. It establishes the effective date of the decree as 1 January 2004. The measure applies to insurance entities seeking authorization to provide extra-legal benefits to workers and persons outside standard employment contracts.

FEDERAL PUBLIC SERVICE SOCIAL SECURITY N. 2003 — 4767 [C − 2003/23087] 8 DECEMBER 2003. — Ministerial Decree implementing the Royal Decree of 14 November 2003 determining the approval conditions for insurance companies and bodies for the purpose of carrying out the insurance activities referred to in the Royal Decree of 14 November 2003 concerning the granting of extra-legal benefits to the workers referred to in Royal Decree No. 50 of 24 October 1967 concerning the retirement and survivor's pension for workers and to the persons referred to in Article 32, first paragraph, 1° and 2°, of the Income Tax Code 1992, employed outside an employment contract.

The Minister of Employment, Having regard to the Law of 12 July 1957 concerning the retirement and survivor's pension for employees, in particular Article 22, § 2, replaced by the Law of 28 April 2003; Having regard to the Royal Decree of 14 November 2003 concerning the granting of extra-legal benefits to the workers referred to in Royal Decree No. 50 of 24 October 1967 concerning the retirement and survivor's pension for workers and to the persons referred to in Article 32, first paragraph, 1° and 2°, of the Income Tax Code 1992, employed outside an employment contract; Having regard to the Royal Decree of 14 November 2003 determining the approval conditions for insurance companies and bodies for the purpose of carrying out the insurance activities referred to in the Royal Decree of 14 November 2003 concerning the granting of extra-legal benefits to the workers referred to in Royal Decree No. 50 of 24 October 1967 concerning the retirement and survivor's pension for workers and to the persons referred to in Article 32, first paragraph, 1° and 2°, of the Income Tax Code 1992, employed outside an employment contract; Having regard to the opinion of the Inspector of Finances, given on 8 December 2003, Decides:

Article 1. For the purposes of this Decree, the following shall be understood: The Royal Decree of 14 November 2003: the Royal Decree of 14 November 2003 determining the approval conditions for insurance companies and bodies for the purpose of carrying out the insurance activities referred to in the Royal Decree of 14 November 2003 concerning the granting of extra-legal benefits to the workers referred to in Royal Decree No. 50 of 24 October 1967 concerning the retirement and survivor's pension for workers and to the persons referred to in Article 32, first paragraph, 1° and 2°, of the Income Tax Code 1992, employed outside an employment contract.

Art. 2. The service referred to in Article 3 of the Royal Decree of 14 November 2003 is the Banking, Financial and Insurance Commission.

Art. 3. This Decree shall enter into force on 1 January 2004.
