MODIFICATIONS to the Agreement by which temporary and extraordinary measures are established and some deadlines are suspended for the attention of participants in the Retirement Savings Systems due to COVID-19

MODIFICATIONS TO THE AGREEMENT BY WHICH TEMPORARY AND

EXTRAORDINARY MEASURES ARE ESTABLISHED AND

SOME DEADLINES ARE SUSPENDED FOR THE ATTENTION OF

PARTICIPANTS IN THE RETIREMENT

SAVINGS SYSTEMS DUE TO COVID-19

The President of the National Commission of the Retirement Savings System, based on what is provided

in articles 1, 2, 5 fractions I, II, VII, VIII, IX and XVI, 11, 12 fractions I, II, VIII and XVI, 18, 58, 90

fractions I, II, VII, XI and XIII, 94 and 121 of the Law of the Retirement Savings Systems; 103, 104, 105 and 106

of the Law of the Institute of Security and Social Services for State Workers; 1 and 2 fraction I

of the Regulations of the Law of the Retirement Savings Systems, and 1, 2 fraction III, 8 first paragraph, 34 and 35

of the Internal Regulations of the National Commission of the Retirement Savings System; the AGREEMENT by

which preventive measures that must be implemented to mitigate and control the risks to health implied by the disease caused by the SARS-CoV2 virus (COVID-19) are established and the DECREE by

which the Agreement by which preventive measures that must be implemented

to mitigate and control the risks to health implied by the disease caused by the SARS-CoV2

virus (COVID-19) is sanctioned, the Agreement by which extraordinary actions are established to address the health emergency generated by the SARS-CoV2 virus and the Agreement by which a strategy is established for the reopening of

social, educational and economic activities, as well as a regional traffic light system to

evaluate weekly the epidemiological risk related to the reopening of activities in each federal entity, as well as extraordinary actions are established and

CONSIDERING

That on March 30, 2020, the Agreement by which the epidemic of disease generated by the

SARS-CoV2 virus (COVID-19) was declared as a health emergency due to force majeure, was published in the Official Gazette of the Federation, through which the General Health Council states that the Ministry of Health will determine the actions that are necessary to address said emergency;

That on March 31, 2020, the Ministry of Health published in the Official Gazette of the Federation the

Agreement by which extraordinary actions are established to address the health emergency generated by

the SARS-CoV2 virus,

through which the immediate suspension from March 30 to April 30 of

2020 of non-essential activities is ordered with the aim of mitigating the dispersion and transmission of the SARS-CoV2 virus in the community, to reduce the disease burden, its complications and death from COVID-19

in the population residing in the national territory;

That on March 26, 2020, this Commission published in the Official Gazette of the Federation the

Agreement by which temporary and extraordinary measures are established and some deadlines are suspended for

the attention of participants in the retirement savings systems due to COVID-19, which

would remain in force until April 19, 2020;

That on April 17, 2020, this Commission published in the Official Gazette of the Federation the

Modifications to the Agreement by which temporary and extraordinary measures are established and some deadlines are suspended for

the attention of participants in the Retirement Savings Systems due to

COVID-19, through which the validity of the same was extended until April 30 of the same year;

That on April 28, 2020, this Commission published in the Official Gazette of the Federation the

Modifications to the Agreement by which temporary and extraordinary measures are established and some deadlines are suspended for

the attention of participants in the Retirement Savings Systems due to

COVID-19, through which it was established that the validity of the same would be subject to the date on which the

Ministry of Health or the General Health Council, through publication in the same Official Gazette,

ordered the orderly, staggered and regionalized return of all non-essential activities;

That on May 14, 2020, the Ministry of Health published in the Official Gazette of the Federation the

Agreement by which a strategy is established for the reopening of social, educational and

economic activities, as well as a regional traffic light system to evaluate weekly the epidemiological risk

related to the reopening of activities in each federal entity, as well as extraordinary actions are

established, through which the Ministry of Health establishes the strategy for the

reopening of social, educational and economic activities, as well as a regional traffic light system to

evaluate weekly the epidemiological risk related to the reopening of activities in

each federal entity, as well as establish extraordinary actions, modified on May 15, 2020;

That on May 29, 2020, the Ministry of Health published in the Official Gazette of the Federation the

Agreement by which the Specific Technical Guidelines for the Reopening of Economic Activities are established;

That as a result of the above and given that the reopening of social activities has begun,

educational and economic, according to the epidemiological risk traffic light of the Ministry of Health, it is necessary to resume ordinary deadlines and the normality of procedures and services related to the Retirement Savings System;

That it is necessary to establish a certain date to conclude the effects of the Agreement by which

temporary and extraordinary measures are established and some deadlines are suspended for the attention of participants in the retirement savings systems due to COVID-19 published in the Official Gazette of the

Federation on March 26, 2020, with its modifications published in the same official communication medium, on days 17 and 28 of April 2020;

That in order to contribute to the prevention and combat of the COVID-19 pandemic and observe the

deadlines and terms established in the applicable legislation, I have deemed it appropriate to issue the following:

MODIFICATIONS TO THE AGREEMENT BY WHICH TEMPORARY AND

EXTRAORDINARY MEASURES ARE ESTABLISHED AND SOME DEADLINES ARE SUSPENDED FOR THE ATTENTION OF

PARTICIPANTS IN THE RETIREMENT SAVINGS SYSTEMS DUE TO COVID-19

SINGLE.- The first paragraph of the FIRST Agreement, as well as the First Transitional Provision, both

of the "AGREEMENT BY WHICH TEMPORARY AND EXTRAORDINARY MEASURES ARE ESTABLISHED AND

SOME DEADLINES ARE SUSPENDED FOR THE ATTENTION OF PARTICIPANTS IN THE RETIREMENT SAVINGS

SYSTEMS DUE TO COVID-19", published in the Official Gazette of the Federation on March 26

of 2020, and its modifications published in the same official communication medium, on days 17 and

28

of April 2020, are modified, to read as follows:

" FIRST.- In the period from the day on which this Agreement is published in the Official

Gazette of the Federation until July 15, 2020, deadlines are suspended with respect to acts and

procedures that are pending before the Commission.

" TRANSITIONAL PROVISIONS

FIRST.- This Agreement shall enter into force on the day of its publication in the Official Gazette of the

Federation and shall remain in force until July 15, 2020, with the exception of the administrative facilities that may have been granted in accordance with the same.

The date indicated in the previous paragraph shall be used as the basis for calculating the start of those

deadlines and terms that, under the present Agreement, had been suspended or extended.

The administrative facilities that the Commission may have granted in accordance with the present Agreement and whose validity date has been associated with that of this Agreement, shall continue in operation until the Commission, through official letter, notifies the Administrators of the date on which they must definitively interrupt their operation.

Without prejudice to the foregoing, the validity of said facilities shall not exceed one calendar year, counted from

the date of

their granting.

TRANSITIONAL PROVISION

FIRST.- These modifications shall enter into force on the same day of their publication in the Official

Gazette of the Federation.

SECOND.- With the entry into force of these modifications, all those

provisions or acts that contravene these are repealed.
