Modifications to the Agreement Establishing Temporary and Extraordinary Measures and Suspending Deadlines for Retirement Savings System Participants Due to COVID-19

MODIFICATIONS to the Agreement by which temporary and extraordinary measures are established and some deadlines are suspended for the attention of participants in the Retirement Savings Systems due to COVID-19

At the margin, a seal with the National Coat of Arms, which says: United Mexican States.- TREASURY.- Ministry of

MODIFICATIONS TO THE AGREEMENT BY WHICH TEMPORARY AND

EXTRAORDINARY MEASURES ARE ESTABLISHED AND

SOME DEADLINES ARE SUSPENDED FOR THE ATTENTION OF PARTICIPANTS IN THE

RETIREMENT SAVINGS SYSTEMS DUE TO COVID-19

The President of the National Commission of the Retirement Savings System, based on what is provided

in articles 1, 2, 5, fractions I, II, VII, VIII, IX and XVI, 11, 12 fractions I, II, VIII and XVI, 18, 58, 90

fractions I, II, VII, XI and XIII, 94 and 121 of the Law of the Retirement Savings Systems;

103, 104, 105 and 106

of the Law of the Institute of Security and Social Services for State Workers;

1 and 2, fraction I

of the Regulations of the Law of the Retirement Savings Systems, and 1, 2 fraction III, 8 first paragraph, 34 and 35

of the Internal Regulations of the National Commission of the Retirement Savings System; the AGREEMENT by

which the preventive measures that must be implemented to mitigate and control the

health risks implied by the disease caused by the SARS-CoV2 virus (COVID-19) and the DECREE by

which the Agreement by which the preventive measures that must be implemented

are sanctioned to mitigate and control the health risks implied by

the disease caused by the SARS-CoV2 virus

(COVID-19), and

CONSIDERING

That on March 30, 2020, the Agreement by which

the epidemic of disease caused by the

SARS-CoV2 virus (COVID-19) is declared as a health emergency due to force majeure, was published in the Official Gazette of the Federation, through which the General Health Council states that the Ministry of Health will determine the actions that are necessary to address this emergency;

That on March 31, 2020, the Ministry of Health published in the Official Gazette of the Federation the

Agreement by which extraordinary actions are established to address the health emergency generated by

the SARS-CoV2 virus, through which the immediate suspension from March 30 to April 30 of

2020 of non-essential activities is ordered with the aim of mitigating the dispersion and transmission of the virus

SARS-CoV2 in the community, to reduce the disease burden, its complications and death from COVID-19

in the population residing in the national territory;

That in view of the various reports presented by the Ministry of Health, with the aim of

continuing to help mitigate the dispersion and transmission of the SARS-CoV2 virus and to comply with the measures

decreed by the health authorities, it is necessary to align the validity of this Agreement with the

determinations issued by them;

That in order to help prevent and combat the COVID-19 pandemic and observe the

deadlines and terms established in the applicable legislation, I have deemed it appropriate to issue the following:

EXTRAORDINARY MEASURES ARE ESTABLISHED AND

SOME DEADLINES ARE SUSPENDED FOR THE ATTENTION OF

PARTICIPANTS IN THE RETIREMENT SAVINGS SYSTEMS DUE TO COVID-19

SINGLE.- The first paragraph of the FIRST Agreement, as well as the First Transitional Provision, both of

the "AGREEMENT BY WHICH TEMPORARY AND EXTRAORDINARY MEASURES ARE ESTABLISHED AND

SOME DEADLINES ARE SUSPENDED FOR THE ATTENTION OF PARTICIPANTS IN THE RETIREMENT SAVINGS

SYSTEMS DUE TO COVID-19", published in the Official Gazette of the Federation on March 26

2020, and its modifications published in the same official communication medium, on April 17

2020, are modified, to read as follows:

" FIRST.- In the period from the day the present Agreement is published in the

Official Gazette of the Federation until the date when the Ministry of Health or the General Health Council,

through publication in the same Official Gazette, order the orderly, staggered and regionalized return of

all non-essential activities, the deadlines regarding the acts and procedures that

are pending before the Commission are suspended.

" TRANSITIONAL PROVISIONS

FIRST.- This Agreement shall enter into force on the day of its publication in the Official Gazette of the

Federation and shall remain in force until the date when the Ministry of Health or the General Health Council,

through publication in the same Official Gazette, order the orderly, staggered and

regionalized return of all non-essential activities, and may be extended to the extent that the

public health contingency continues and as determined by the aforementioned health authorities. "

TRANSITIONAL PROVISION

FIRST.- These modifications shall enter into force on the same day of their publication in the Official

Gazette of the Federation.

SECOND.- All acts issued by the Commission that had considered the date of validity of

the measures established in the "AGREEMENT BY WHICH TEMPORARY AND

EXTRAORDINARY MEASURES ARE ESTABLISHED AND

SOME DEADLINES ARE SUSPENDED FOR THE ATTENTION OF

PARTICIPANTS IN THE RETIREMENT SAVINGS SYSTEMS DUE TO COVID-19", published

in the Official Gazette of the Federation on March 26, 2020 and modified by agreement published in the

same official communication medium on April 17, 2020, shall be understood as updated according to these

modifications.

THIRD.- With the entry into force of these modifications, all those

dispositions or acts that contravene these are repealed.
