MODIFYING CIRCULAR 10/20 OF THE SINGLE INSURANCE AND SURETY CIRCULAR

MODIFYING CIRCULAR 10/20 OF THE SINGLE INSURANCE AND SURETY CIRCULAR

The National Insurance and Sureties Commission, based on what is established in articles 366, fraction II; 367, fraction II; 372, fractions VI and XLII, 373 and 381 of the Law of Insurance and Surety Institutions, and

CONSIDERING

That in accordance with what is established in articles 201, 210, 226, 246, 310 and 311 of the Law of Insurance and Surety Institutions, the actuaries who sign the valuation of technical reserves and valuation methods; those who prepare and sign the dynamic solvency test; those who prepare and sign technical notes; the independent external auditors who audit the financial statements; and the independent actuaries who issue opinions on the situation and sufficiency of the technical reserves that Institutions and Mutual Societies must constitute, must demonstrate that they have the knowledge for such purposes and register with the National Insurance and Sureties Commission, in the form and terms that the same determines through general provisions.

That Provisions 30.1.12, 30.2.7., 30.3.5, 30.4.5. and 30.5.5. of the Single Insurance and Surety Circular establish that the registration of external auditors, as well as the aforementioned actuaries, are formalized through the issuance of a card with indefinite validity. This, provided that they meet all the requirements that the applicable regulations demand.

That through the use of information technologies, this Commission is in a position to issue digital certificates that support the registration of both external auditors and actuaries, using for these purposes the Appointments and Registration System, with the same effects and validity as the previously issued cards, achieving agility and legal certainty of the registrations for the benefit of actuaries and external auditors by simplifying the corresponding registration procedure.

For the aforementioned reasons, this Commission has resolved to issue the following modification to the Single Insurance and Surety Circular in the terms specified below:

MODIFYING CIRCULAR 10/20 OF THE SINGLE INSURANCE AND SURETY CIRCULAR

(Provisions 30.1.12; 30.2.7.; 30.3.5; 30.4.5, 30.5.5.)

FIRST. Provisions 30.1.12, 30.2.7., 30.3.5., 30.4.5. and 30.5.5. of the Single Insurance and Surety Circular are modified to read as follows:

30.1.12.

The registration of the independent external auditor shall be formalized through the issuance of a digital certificate with indefinite validity as long as said registration is not revoked by the Commission and the validity of its certification is duly updated in accordance with what is established in fraction VI of Provision 30.1.10.

To obtain said certificate, the independent external auditor must comply, to the satisfaction of the Commission, with what is established in this Chapter and submit their application through the Appointments and Registration System referred to in Chapters 39.1 and 39.4 of these Provisions.

For the purposes of what is stated in this Provision, the independent external auditor must access the section "Download of certificates of registration of actuaries and external auditors" in accordance with the procedure provided in the "Instruction for use of the section for downloading certificates of registration of actuaries and external auditors", both available on the Commission's Website.

External auditors, Institutions and the general public may consult on the Commission's Website the list of external auditors with valid registration.

30.2.7.

The registration of the independent actuary shall be formalized through the issuance of a digital certificate with indefinite validity as long as said registration is not revoked by the Commission and the validity of its certification is duly updated in accordance with what is established in fraction VI of Provision 30.2.5.

To obtain said certificate, the independent actuary must comply, to the satisfaction of the Commission, with what is established in this Chapter and submit their application through the Appointments and Registration System referred to in Chapters 39.1 and 39.4 of these Provisions.

For the purposes of what is stated in this Provision, the independent actuary must access the section "Download of certificates of registration of actuaries and external auditors" in accordance with the procedure provided in the "Instruction for use of the section for downloading certificates of registration of actuaries and external auditors", both available on the Commission's Website.

Independent actuaries, Institutions and the general public may consult on the Commission's Website the list of independent actuaries with valid registration.

30.3.5.

The registration of the actuary who prepares and signs the valuation of the technical reserves of Institutions and Mutual Societies, as well as the methods for the valuation of these, shall be formalized through the issuance of a digital certificate with indefinite validity, as long as said registration is not revoked by the Commission and the validity of its certification is duly updated in accordance with what is established in fraction VI of Provision 30.3.3.

To obtain said certificate, the actuary must comply, to the satisfaction of the Commission, with what is established in this Chapter and submit their application through the Appointments and Registration System referred to in Chapters 39.1 and 39.4 of these Provisions.

For the purposes of what is stated in this Provision, the actuary must access the section "Download of certificates of registration of actuaries and external auditors" in accordance with the procedure provided in the "Instruction for use of the section for downloading certificates of registration of actuaries and external auditors", both available on the Commission's Website.

Actuaries, Institutions and the general public may consult on the Commission's Website the list of actuaries with valid registration.

30.4.5.

The registration of the actuary who prepares and signs the Dynamic Solvency Test of Institutions shall be formalized through the issuance of a digital certificate with indefinite validity, as long as said registration is not revoked by the Commission and the validity of its certification is duly updated in accordance with what is established in fraction VI of Provision 30.4.3.

To obtain said certificate, the actuary must comply, to the satisfaction of the Commission, with what is established in this Chapter and submit their application through the Appointments and Registration System referred to in Chapters 39.1 and 39.4 of these Provisions.

For the purposes of what is stated in this Provision, the actuary must access the section "Download of certificates of registration of actuaries and external auditors" in accordance with the procedure provided in the "Instruction for use of the section for downloading certificates of registration of actuaries and external auditors", both available on the Commission's Website.

Actuaries, Institutions and the general public may consult on the Commission's Website the list of actuaries with valid registration.

30.5.5.

The registration of the actuary who prepares and signs the technical notes of insurance products and technical notes of sureties that Institutions and Mutual Societies register shall be formalized through the issuance of a digital certificate with indefinite validity, as long as said registration is not revoked by the Commission and the validity of its certification is duly updated in accordance with what is established in fraction VI of Provision 30.5.3.

To obtain said certificate, the actuary must comply, to the satisfaction of the Commission, with what is established in this Chapter and submit their application through the Appointments and Registration System referred to in Chapters 39.1 and 39.4 of these Provisions.

For the purposes of what is stated in this Provision, the actuary must access the section "Download of certificates of registration of actuaries and external auditors" in accordance with the procedure provided in the "Instruction for use of the section for downloading certificates of registration of actuaries and external auditors", both available on the Commission's Website.

Actuaries, Institutions and the general public may consult on the Commission's Website the list of actuaries with valid registration.

SECOND. The "List of Documents and Information referred to in the Single Insurance and Surety Circular to which access is obtained through the Commission's web page" of the Single Insurance and Surety Circular is modified to read as follows:

TRANSITORY PROVISIONS

FIRST.

This Modifying Circular shall enter into force on the next business day following its publication in the Official Gazette of the Federation.

SECOND.

The registrations and the corresponding cards, issued prior to the entry into force of this Modifying Circular, will maintain their validity as long as they are not revoked by this Commission and the validity of the certification is duly updated in terms of the respective Chapters.

This is made known to you, based on what is established in articles 366, fraction II; 367, fraction II, 372, fractions VI and XLII, 373 and 381 of the Law of Insurance and Surety Institutions.
