Modifying Circular 16/18 of the Single Insurance and Surety Circular

MODIFYING CIRCULAR 16/18 OF THE SINGLE INSURANCE AND SURETY CIRCULAR

The National Insurance and Surety Commission, based on the provisions of articles 366, fraction II, 372, fractions VI and XLII, 373, and 381 of the Law of Insurance and Surety Institutions, and

CONSIDERING

That in accordance with what is established in article 107 of the Law of Insurance and Surety Institutions, for insurance and mutual insurance companies, as well as surety institutions, to enter into reinsurance or surety contracts with any reinsurance or surety entity from abroad, it is necessary that said entity be registered in the General Registry of Foreign Reinsurers maintained by the National Insurance and Surety Commission.

That the aforementioned article also provides that registration in the General Registry of Foreign Reinsurers will be granted or denied at the discretion of the National Insurance and Surety Commission, to primary foreign reinsurers that meet solvency and stability requirements to carry out operations and fulfill the objectives referred to in article 256 of the Law of Insurance and Surety Institutions regarding the diversification and dispersion of risks and liabilities that insurance institutions and surety institutions assume when carrying out their operations, through the celebration of reinsurance or surety contracts with other institutions or foreign reinsurers.

That the second paragraph of Provision 34.1.2. of the current Single Insurance and Surety Circular establishes that compliance with the solvency and stability requirement referred to in the previous paragraph will be determined based on accreditation before the National Insurance and Surety Commission, by the requesting foreign insurance, reinsurance, or surety entity, of having obtained the minimum financial strength rating established in accordance with Chapter 34.3 of said Circular, which must be granted by one of the specialized rating agencies referred to in Chapter 34.3 of the same.

That for the renewal of the registration referred to, Provision 34.1.10. of the Single Insurance and Surety Circular establishes that the foreign reinsurance or surety entity registered in the General Registry of Foreign Reinsurers must provide the National Insurance and Surety Commission with a certificate accrediting the validity of the financial strength rating granted by one or more specialized rating agencies that served as the basis for obtaining its registration in said Registry or, in its case, the respective renewal, under the understanding that said certificate must show that it has, at minimum, the minimum ratings indicated in Chapter 34.3 of said Circular, which must be delivered to the Commission no later than the first business day of October of each year, with the understanding that if it is not presented in the form and terms established in said Circular, or if the minimum financial strength rating required is not accredited, renewal in the aforementioned Registry will not proceed.

That for the renewal of registration in an Atomic Pool, foreign entities belonging to it must obtain annually a document in which the leader or administrator of the Atomic Pool states that the respective foreign entity belongs to it, and that its participation within the Atomic Pool is valid, as well as stating that it has valid the clause of solidarity, subsidiarity, or some other analogous mechanism among its members to meet the obligations it incurs.

That the National Insurance and Surety Commission, after analyzing the information that foreign entities presented with their applications for registration or renewal regarding compliance with the requirements established by applicable regulations, makes known to the general public, through the modification to Annex 34.1.21-a of the current Single Insurance and Surety Circular, the foreign insurance and primary reinsurance entities registered in the General Registry of Foreign Reinsurers that met the mentioned requirements to obtain renewal in said Registry for the 2019 fiscal year, in order for Mexican insurers and surety companies to be able to enter into reinsurance or surety contracts with said foreign entities and carry out the cession of risks or liabilities they assume in compliance with the relevant provisions.

For the aforementioned reasons, the National Insurance and Surety Commission has resolved to modify the Single Insurance and Surety Circular in the following terms:

SINGLE.- Annex 34.1.21-a of the Single Insurance and Surety Circular is modified.

TRANSITORY

SINGLE.- This Modifying Circular will enter into force on January 1, 2019.

The above is made known to you, based on articles 366, fraction II, 372, fractions VI and XLII, 373, and 381 of the Law of Insurance and Surety Institutions.
