The ACPR extends the European Banking Authority's guidelines (EBA/GL/2026/01) regarding the identification of activities under Article 4(1)(18) of Regulation (EU) No 575/2013 to financing companies. This notice requires these entities, which are not classified as financial institutions under Regulation (EU) No 1093/2010 but are subject to Directive 2013/36/EU and Regulation (EU) No 575/2013, to make every effort to comply with the specified EBA guidelines.

This notice aims to extend to financing companies the European Banking Authority (EBA) guidelines (EBA/GL/2026/01) specifying the criteria for identifying the activities referred to in Article 4(1)(18) of Regulation (EU) No 575/2013, to which the Prudential Supervision and Resolution Authority (ACPR) has declared itself compliant (cf. Notice published on 23/07/2026).
The ACPR expects financing companies, which do not fall within the definition of "financial institutions" referred to in Article 4(1) of Regulation (EU) No 1093/2010 establishing the EBA but to which the requirements of Directive 2013/36/EU and Regulation (EU) No 575/2013 apply, to make every effort to comply with the EBA guidelines EBA/GL/2026/01.
