On making amendments to the Regulation on the Procedure for Granting Credit by Commercial Banks to Farmer Households against Future Harvest as Collateral

This Resolution was removed from the state register based on the Order of the Minister of Justice of the Republic of Uzbekistan No. 347-mh dated August 19, 2019, "On removing departmental normative legal acts from the state register" (registration number 1337-5, 19.08.2019).

In accordance with the Laws of the Republic of Uzbekistan "On the Central Bank of the Republic of Uzbekistan", "On Banks and Banking Activities", Decrees of the President of the Republic of Uzbekistan No. PF-4354 dated August 24, 2011, "On additional measures to create a favorable business environment for further development of small business and private entrepreneurship", and No. PF-4453 dated July 16, 2012, "On measures for radical reduction of statistical, tax, financial reporting, types of licensed activities and permitting procedures", the Board of the Central Bank of the Republic of Uzbekistan resolves:

1. Amendments shall be made to the Regulation on the Procedure for Granting Credit by Commercial Banks to Farmer Households against Future Harvest as Collateral, approved by the Resolution of the Board of the Central Bank of the Republic of Uzbekistan No. 563 dated March 1, 2004 (registration number 1337, April 16, 2004) (Collection of Legislation of the Republic of Uzbekistan, 2004, No. 15, Article 182), in accordance with the Appendix.

2. This Resolution shall enter into force from the date of its official publication.

APPENDIX

Amendments being made to the Regulation on the Procedure for Granting Credit by Commercial Banks to Farmer Households against Future Harvest as Collateral

1. The preamble of the Regulation shall be stated in the following edition:

«This Regulation defines the procedure for granting credit (hereinafter — credit) by commercial banks to farmer households against future harvest as collateral, in accordance with the Civil Code of the Republic of Uzbekistan, the Laws of the Republic of Uzbekistan "On the Central Bank of the Republic of Uzbekistan", "On Banks and Banking Activities", "On Farmer Households", Decrees of the President of the Republic of Uzbekistan No. PF-3342 dated October 27, 2003, "On the Concept of Farmer Household Development in 2004-2006", No. PF-4478 dated October 22, 2012, "On further improving the organization of farming activities in Uzbekistan and measures for its development", and Resolution of the Cabinet of Ministers of the Republic of Uzbekistan No. 476 dated October 30, 2003, "On measures for implementing the Concept of Farmer Household Development in 2004-2006".».

2. The second paragraph of clause 1 shall be stated in the following edition:

«Crediting of farmer households that do not produce agricultural products for state needs shall be carried out on the basis of the Regulation on the Procedure for Crediting Small Business Entities in National Currency (registration number 2546, December 27, 2013).».

3. The fifth paragraph of clause 6 shall be stated in the following edition:

«borrower's balance sheet (Form 1) for the last reporting period submitted to the relevant state tax inspection, as well as reconciliation acts for debts overdue by more than 90 days, report on financial results (Form 2);».

4. The words "from 10 working days" in clause 8 shall be replaced with the words "from 3 working days".

5. These amendments have been agreed upon with the Ministry of Finance of the Republic of Uzbekistan, the Ministry of Agriculture and Water Resources, the State Committee for Privatization, Demonopolization and Development of Competition, the State Committee for Land Resources, Geodesy, Cartography and State Cadastre, and the Council of Farmers of Uzbekistan.
