On the Approval of Selling Prices for Securities Held by Fiduciary Administrators

On March 1, 2024, the fiduciary administrators CF "BV Fiduciar Invest" SA, CF "Econ-Renaștere" SA and "Compania Fiduciară a Feroviariilor" SA submitted applications No. 38, No. 10 and respectively No. 10 dated March 1, 2024 (registered with the National Financial Market Commission (CNPF) under Nos. 1618, 1619 and respectively 1620), pertaining to the asset valuation acts for clients under fiduciary administration (approved at the liquidation commission meeting on March 1, 2024).

Therefore, pursuant to Article 1 paragraphs (3) and (4), Article 146¹ of Law No. 171/2012 on the capital market (Law No. 171/2012), Article 8 letter b), Article 20 paragraph (1), Article 22 paragraph (3) of Law No. 192/1998 on the National Financial Market Commission, point 8 subpoint 2), points 25, 26 and 27 of the Regulation on the procedure for initiating fiduciary investment administration activity (CNPF Decision No. 40/4/2018), points 16 and 19 of the Regulation on the organization and functioning of the National Financial Market Commission (CNPF Decision No. 57/11/2022),

The National Financial Market Commission DECIDES:

1. The selling prices of securities held by the fiduciary administrators CF "BV Fiduciar Invest" SA, CF "Econ-Renaștere" SA and "Compania Fiduciară a Feroviariilor" SA is approved, in accordance with the valuation acts, which are offered for sale as established by Article 146¹ paragraph (2) of Law No. 171/2012, according to the annex.

2. The Moldova Stock Exchange is permitted not to reflect in open positions the list of securities offered at auction as single packages, according to the annex.

3. In the event of exercising rights provided by Article 146¹ paragraph (3) of Law No. 171/2012, the chairmen of the liquidation commissions of fiduciary administrators "BV Fiduciar Invest" SA, "Econ-Renaștere" SA and "Compania Fiduciară a Feroviariilor" SA shall notify the CNPF within up to 3 working days from the date of submission of the redemption or sale application.

4. This Decision may be appealed by submitting a prior application to the CNPF (MD-2012, Chisinau city, Stefan cel Mare si Sfant Blvd., No. 77), within 30 days from the date of notification.

5. This Decision enters into force on the date of adoption, is communicated to recipients in accordance with legislation and is published on the official CNPF website (www.cnpf.md).
