Order Designating the Federal Property "DDR y CADER Madera" to the Secretariat of Agriculture and Rural Development

ORDER designating to the Secretariat of Agriculture and Rural Development the federal property known as "DDR y CADER Madera", with a surface area of 762.3350 square meters, located at Calle Juárez between Calle 3rd and Calle 5th, number 1413, Colonia Madera Centro, Postal Code 31940, Municipality of Madera, State of Chihuahua, with Federal Real Estate Registry 8-5742-0.

A seal bearing the National Coat of Arms is placed at the margin, which reads: United Mexican States.- TREASURY.- Secretariat of Finance and Public Credit.- Institute of Administration and Appraisal of National Assets.- DST-13/2024.

VÍCTOR JULIÁN MARTÍNEZ BOLAÑOS, President of the Institute of Administration and Appraisal of National Assets, a Decentralized Administrative Body of the Secretariat of Finance and Public Credit, based on the provisions of articles 2, fraction I, 17, 26, 31, fractions XXIX and XXX of the Organic Law of the Federal Public Administration; 2, fractions II, IV, V, VI and VII, 3, fraction III, 4, paragraphs first and second, 6, fraction XXI, 11, fraction I, 13, 28, fractions I, III and VII, 29, fractions I and V, 59, fraction V, 61, 62, 66, 70 and 101, fraction V of the General Law of National Assets; 4, section G, fraction V, 48 and 49 of the Internal Regulations of the Secretariat of Finance and Public Credit; and 3, fractions VIII, IX and X, 4, fraction I, subsection a) and 6, fractions XXVI and XXXIII of the Regulations of the Institute of Administration and Appraisal of National Assets; and taking into account the following:

CONSIDERING

FIRST.- That among the assets subject to the public domain regime of the Federation, is the federal property known as "DDR y CADER Madera", with a surface area of 762.3350 square meters, with Federal Real Estate Registry 8-5742-0, located at Calle Juárez between Calle 3rd and Calle 5th, number 1413, Colonia Madera Centro, Postal Code 31940, Municipality of Madera, State of Chihuahua.

SECOND.- That the ownership of the federal property described in the preceding Consideration is accredited through public deed number 16 dated October 24, 1989, granted by Licentiate Armando Herrera Acosta, Public Notary Number Twelve of the Judicial District of Morelos, State of Chihuahua and of the Federal Real Estate Heritage, through which the Donation Contract was recorded by which Mr. Engineer Gustavo Granados Uranga, in his capacity as liquidator of the Decentralized Public Body "Productos Forestales de la Tarahumara", donated the property subject of this present, to the National Institute of Forestry and Agricultural Research, a Decentralized Administrative Body of the then Secretariat of Agriculture and Hydraulic Resources, currently the Secretariat of Agriculture and Rural Development, represented by Mr. Doctor Enrique Sánchez Granillo, the then Director of the Forestry and Agricultural Research Center in the State of Chihuahua, instrument which was duly authorized on November 13, 1989, which is registered under number 479, at folios 138, of Book number 240 of the First Section of the Public Property Registry of the District of Guerrero, State of Chihuahua, on November 22, 1989, and registered in the Federal Public Property Registry under Real Folio number 150786 dated March 28, 2018.

That said deed was Convalidated through Agreement with folio number 46/2015 dated July 23, 2015, registered in the Federal Public Property Registry under Real Folio number 150786/1, on March 28, 2018.

THIRD.- That Topographic Plan number 1 of 1, prepared at a scale of 1:200, approved and registered under number DRPCI/08-05742-0/5712/2016/T on June 30, 2016 and certified on October 20, 2017, by the Directorate of Public Registry and Real Estate Control attached to the General Directorate of Real Estate Policy and Management of the Institute of Administration and Appraisal of National Assets, records the surface area, measurements and boundaries resulting from the topographic survey of the property in question, stating in the notes table that "THE RECONSTRUCTION OF THE POLYGON ACCORDING TO THE PROPERTY BACKGROUND IN ITS BEST ADJUSTMENT YIELDED A SURFACE AREA OF 761.127 M2 AND THE TOPOGRAPHIC SURVEY YIELDED A SURFACE AREA OF 762.335 M2, FOR WHICH THERE IS A DIFFERENCE OF 1.21 M2 (0.16%) IN EXCESS WHICH IS WITHIN THE TOLERANCE ALLOWED BY INDAABIN, AND IS DERIVED FROM THE DIFFERENT MEASUREMENT METHODS".

FOURTH.- That through official letter number 401.3S.14-2017/TSL/202 dated July 10, 2017, the Delegate of the INAH Center Chihuahua of the National Institute of Anthropology and History, resolved that the property subject of this present instrument is not considered a Historical Monument, and it is not adjacent to one.

FIFTH.- That through official letter number 495 dated December 1, 2022, the Directorate of Public Works of the Municipal Government of Madera, State of Chihuahua, authorized that the property described in Consideration First of this Order, can be used exclusively for use as "... OFFICES IN COMPLIANCE WITH THE GENERAL LAW OF HUMAN SETTLEMENTS AND IN COMPLIANCE WITH THE ADMINISTRATIVE CODE LAW OF THE STATE OF CHIHUAHUA." (sic)

SIXTH.- That through official letter number 512.-0044-2023 dated January 31, 2023, the General Director of Material Resources, Properties and Services and Real Estate Manager of the Secretariat of Agriculture and Rural Development (SADER), requested that the Administrative Order of Destination of the federal property described in Consideration First of this Instrument be issued, to continue using it as Administrative Offices of the "DDR y CADER Madera".

SEVENTH.- That through official letter number 0413-C/0318 dated March 30, 2023, the Directorate of Architecture and Conservation of Immovable Artistic Heritage of INBAL of the National Institute of Fine Arts and Literature, informed the State Representation of Chihuahua of SADER that, the property subject of this present instrument, "... is not considered as artistic monuments or of artistic value ...".

EIGHTH.- That through a written document dated September 6, 2023, the Head of the Cadastre Department of the Municipal Government of Madera, State of Chihuahua, issued a Certificate of Alignment and Official Number in which it is recorded that the property subject of this present Order is located at Calle Juárez between Calle 3rd and Calle 5th., official number 1413, Centro Colonia in Ciudad Madera, Municipality of Madera, State of Chihuahua.

NINTH.- That the General Directorate of Administration of Federal Real Estate Heritage of the Institute of Administration and Appraisal of National Assets, in accordance with what is provided for in article 11, fraction V, of the Regulations of this Institute, knew and reviewed from a technical-legal point of view, the operation that is authorized. The legal and technical documentation supporting the legal and administrative situation of the property, as well as of this Order, is in the processing file integrated by said General Directorate and was duly compared with that which is in the Federal and Parastatal Real Estate Information System. Likewise, based on article 9, fraction XIV in relation to article 11, fraction V of the Regulations of this Institute, the Legal Unit issued an opinion proceeding regarding this present Order.

For the above and in accordance with the provisions established in articles 61, 62, 66 and 70 of the General Law of National Assets, and being the purpose of the Federal Executive the optimal use of the federal real estate heritage, prioritizing public institutions of the different levels of Government with federal properties for the provision of public services under their charge, I have deemed it appropriate to issue the following:

ORDER

FIRST.- The federal property known as "DDR y CADER Madera", located at Calle Juárez between Calle 3rd and Calle 5th, number 1413, Colonia Madera Centro, Postal Code 31940, Municipality of Madera, State of Chihuahua, with Federal Real Estate Registry 8-5742-0, with a surface area of 762.3350 square meters, is designated to the Secretariat of Agriculture and Rural Development, to continue using it as administrative offices of the "DDR y CADER Madera".

SECOND.- If the Secretariat of Agriculture and Rural Development gives the federal property designated to it a use different from that established by this Order, without prior authorization from the Secretariat of Finance and Public Credit, through the Institute of Administration and Appraisal of National Assets; or if it ceases to use it or needs it, said asset with all its improvements and accessions will be withdrawn from its service to be administered directly by this Institute, in accordance with what is provided in article 68 of the General Law of National Assets.

THIRD.- In case construction, reconstruction, modification, adaptation, conservation, maintenance, repair and demolition works are planned on the designated property, prior to its realization, the Secretariat of Agriculture and Rural Development must manage before local and federal authorities, the obtaining of licenses, permits, authorizations or any other similar that is required.

FOURTH.- The Secretariat of Agriculture and Rural Development must guard and supervise the property, being obliged to cover the necessary expenses for its conservation and maintenance, and other inherent services that, in their case, are generated, as well as the corresponding insurance against damage to the property, in accordance with what is provided in articles 32, fraction IV and 66 of the General Law of National Assets.

FIFTH.- The designation only confers upon the Secretariat of Agriculture and Rural Development, the right to use the designated property for the authorized use, but does not transmit ownership of it, nor grants any real right over it, in accordance with what is provided in article 70 of the General Law of National Assets.

SIXTH.- The Institute of Administration and Appraisal of National Assets within the scope of its attributes, through the General Directorate of Administration of Federal Real Estate Heritage, will supervise the strict compliance of this Order.

This Order will enter into force the day after its publication in the Official Gazette of the Federation.
