Regulation of the Commodity Futures Trading Regulatory Agency Number 2 of 2026 Concerning the Determination of Warehouse Requirements for Goods Stored in the Warehouse Receipt System

Warehouses participating in the Warehouse Receipt System must comply with specific Indonesian National Standards (SNI) for storage facilities, including SNI 7331:2021, SNI 8278:2021, SNI 19-1674-1989, SNI 8446:2022, SNI 9174:2023, and SNI 8661:2023, as detailed in the regulation's appendix. Conformity Assessment Institutions are required to reference these standards when issuing warehouse certificates. Existing approved warehouses must adjust to these new requirements within one year, while pending applications must immediately adhere to the new provisions. This regulation repeals the previous 2021 regulation regarding Controlled Atmosphere Storage warehouses and takes effect on July 15, 2026.

REGULATION OF THE COMMODITY FUTURES TRADING REGULATORY AGENCY REPUBLIC OF INDONESIA NUMBER 2 OF 2026 CONCERNING THE DETERMINATION OF WAREHOUSE REQUIREMENTS FOR GOODS STORED IN THE WAREHOUSE RECEIPT SYSTEM

BY THE GRACE OF GOD THE ALMIGHTY

HEAD OF THE COMMODITY FUTURES TRADING REGULATORY AGENCY REPUBLIC OF INDONESIA,

Considering: a. that not all goods that can be stored in the warehouse receipt system have complete technical requirement regulations for warehouses, so as to guarantee the safety, quality, and availability of goods, as well as certainty for conformity assessment institutions in issuing warehouse certificates, it is necessary to implement the requirements contained in the Indonesian National Standard regarding warehouses as technical requirements for warehouses for goods stored in the warehouse receipt system; b. that based on the considerations referred to in letter a, it is necessary to establish a Regulation of the Commodity Futures Trading Regulatory Agency concerning the Determination of Warehouse Requirements for Goods Stored in the Warehouse Receipt System;

Recalling: 1. Law Number 9 of 2006 concerning the Warehouse Receipt System (State Gazette of the Republic of Indonesia Year 2006 Number 59, Supplement to the State Gazette of the Republic of Indonesia Number 4630) as amended by Law Number 9 of 2011 concerning Amendments to Law Number 9 of 2006 concerning the Warehouse Receipt System (State Gazette of the Republic of Indonesia Year 2011 Number 78, Supplement to the State Gazette of the Republic of Indonesia Number 5231); 2. Law Number 7 of 2014 concerning Trade (State Gazette of the Republic of Indonesia Year 2014 Number 45, Supplement to the State Gazette of the Republic of Indonesia Number 5512) as amended several times, lastly with Law Number 6 of 2023 concerning the Determination of Government Regulation in Lieu of Law Number 2 of 2022 concerning Job Creation into Law (State Gazette of the Republic of Indonesia Year 2023 Number 41, Supplement to the State Gazette of the Republic of Indonesia Number 6856); 3. Government Regulation Number 36 of 2007 concerning the Implementation of Law Number 9 of 2006 concerning the Warehouse Receipt System (State Gazette of the Republic of Indonesia Year 2007 Number 79, Supplement to the State Gazette of the Republic of Indonesia Number 4735) as amended by Government Regulation Number 70 of 2013 concerning Amendments to Government Regulation Number 36 of 2007 concerning the Implementation of Law Number 9 of 2006 concerning the Warehouse Receipt System (State Gazette of the Republic of Indonesia Year 2013 Number 172, Supplement to the State Gazette of the Republic of Indonesia Number 5459); 4. Presidential Regulation Number 168 of 2024 concerning the Ministry of Trade (State Gazette of the Republic of Indonesia Year 2024 Number 364); 5. Minister of Trade Regulation Number 6 of 2025 concerning the Organization and Work Structure of the Ministry of Trade (State News of the Republic of Indonesia Year 2025 Number 53);

DECIDING:

Establishing: REGULATION OF THE COMMODITY FUTURES TRADING REGULATORY AGENCY CONCERNING THE DETERMINATION OF WAREHOUSE REQUIREMENTS FOR GOODS STORED IN THE WAREHOUSE RECEIPT SYSTEM.

Article 1 In this Regulation of the Agency, the following terms are defined:

Warehouse Receipt System is an activity related to the issuance, transfer, guarantee, and settlement of warehouse receipt transactions.
Goods are any movable objects that can be stored for a certain period and are traded generally.
Warehouse is all immovable and non-movable rooms intended not to be visited by the general public, but to be used specifically for storing Goods that can be traded generally and meet other requirements established by the Minister.
Conformity Assessment Institution, hereinafter abbreviated as LPK, is an accredited institution that carries out a series of activities to assess or prove that certain requirements related to products, processes, systems, and/or personnel are met.
Indonesian National Standard, hereinafter referred to as SNI, is a Standard established by a non-ministerial government agency responsible for standardization and conformity assessment, applicable within the territory of the Unitary State of the Republic of Indonesia.
Warehouse Receipt Regulatory Agency, hereinafter referred to as the Regulatory Agency, is an organizational unit under the ministry that conducts government affairs in the field of trade, which is given the authority to conduct guidance, regulation, and supervision of the implementation of the Warehouse Receipt System.

Article 2 (1) Warehouses to be used in the Warehouse Receipt System must meet requirements in accordance with SNI: a. SNI 7331:2021; b. SNI 8278:2021; c. SNI 19-1674-1989; d. SNI 8446:2022; e. SNI 9174:2023; and f. SNI 8661:2023, with details as stated in the Appendix which is an inseparable part of this Regulation of the Agency. (2) In the event that the SNI referred to in paragraph (1) letters a through f have been revised, the determination of Warehouse requirements as Warehouses used in the Warehouse Receipt System shall refer to the SNI revision.

Article 3 In issuing Warehouse certificates, LPKs conducting conformity assessments, in addition to referring to Bappebti regulations regarding technical requirements for Warehouses in the Warehouse Receipt System, must also refer to the requirements stated in the Appendix which is an inseparable part of this Regulation of the Agency.

Article 4 (1) Warehouses that have obtained approval from Bappebti as Warehouses in the Warehouse Receipt System prior to the implementation of this Regulation of the Agency shall remain valid and must adjust to this Regulation of the Agency within a maximum period of 1 (one) year. (2) Applications for Warehouse approval that are being processed by Bappebti prior to the implementation of this Regulation of the Agency may continue to be processed by first adjusting to the provisions in this Regulation of the Agency.

Article 5 Upon the implementation of this Regulation of the Agency, the Regulation of the Commodity Futures Trading Regulatory Agency Number 2 of 2021 concerning Technical Requirements for Controlled Atmosphere Storage (CAS) Warehouses in the Warehouse Receipt System is repealed and declared invalid.

Article 6 This Regulation of the Agency shall come into force on the date of establishment.
