The Board of Directors of the Central Bank of Bolivia denies the appeal filed by the Vice Ministry of Treasury and Public Credit against Resolution 102/98 because it was submitted after the statutory deadline expired. The appeal, which challenged administrative fees for accounting documents, was filed on February 18, 1999, exceeding the thirty-day limit established by Article 55 of Law 1670. The Presidency and General Management are tasked with executing this decision.
BOARD RESOLUTION NO. 009/99 SUBJECT: BOARD – DENIAL OF THE APPEAL FILED BY THE VICE MINISTRY OF TREASURY AND PUBLIC CREDIT REGARDING BOARD RESOLUTION NO. 102/98.

CONSIDERING: That the Vice Ministry of Treasury and Public Credit, through letter D.C.B. OF. 05- 00-99 of February 19, 1999, filed an appeal against the Board Resolution of the BCB No. 102/98 issued on November 17, 1998, while requesting its revocation as it allegedly violated the resources of the General Treasury of the Nation.
That said appeal refers to section C) Recovery of Various Expenses, item 2.- Administrative expenses for the issuance of accounting documents for third parties, of the BCB Commission and Other Income Table for the 1999 fiscal year.
That according to Article 55 of Law 1670, the Board must rule within twenty (20) days following the filing of an appeal for revocation.
That the Vice Ministry of Treasury and Public Credit became aware of the Board Resolution of the BCB No. 102/98 on January 4, 1999 and, consequently, had thirty (30) days until February 3, 1999 to file the respective appeal.
//2. R.D. No. 009/99 That the aforementioned appeal was filed only on February 18, 1999, after the term established for this purpose by Article 55 of Law 1670 had expired.
That since the appeal was filed outside the period set by law, it does not correspond to process the requested revocation.
THEREFORE, THE BOARD OF DIRECTORS OF THE CENTRAL BANK OF BOLIVIA RESOLVES:
Article 1.- Deny the appeal for revocation filed by the Vice Ministry of Treasury and Public Credit against Board Resolution No. 102/98, as it was filed outside the period established in Article 55 of Law 1670 of October 31, 1995.
Article 2.- The Presidency and General Management are charged with the execution and compliance of this Resolution.
