Resolution 152/2007 Approving Fee and Fine Tables for 2008

The Board of Directors of the Central Bank of Bolivia approves the 2008 Fee Table and Fine Table, which enter into force on January 2, 2008. This resolution revokes previous resolutions 096/2006, 012/2007, and 119/2007, establishing specific commission rates for international transfers, letters of credit, and monetary operations, as well as fixed fines for service suspensions, information delays, and fund insufficiencies for financial entities.

BOARD OF DIRECTORS RESOLUTION NO. 152/2007 SUBJECT: INTERNATIONAL OPERATIONS MANAGEMENT – APPROVES FEE TABLE FOR SERVICES AND FINE TABLE OF THE CENTRAL BANK OF BOLIVIA FOR THE 2008 MANAGEMENT PERIOD.

VIEWED: The Law No. 1670 of October 31, 1995, of the Central Bank of Bolivia (BCB). The Statute of the BCB approved by Board of Directors Resolution No. 128/2005 of October 21, 2005, modified by Board of Directors Resolution No. 031/2006 of April 18, 2006. The Board of Directors Resolution No. 096/2006 of November 7, 2006, which approves the Service Tariffs and the Fine Table of the Issuing Entity for the 2007 management period. The Board of Directors Resolution No. 012/2007 of February 6, 2007, which modifies service tariffs of the BCB for the 2007 management period. The Board of Directors Resolution No. 119/2007 of September 25, 2007, which approves the commission for transfers from abroad to the private sector, excluding export operations through the Issuing Entity. The Report of the International Operations Management GOI No. 015/2007 of December 6, 2007. The Report of the Legal Affairs Management SANO No. 318/2007 of December 7, 2007.

CONSIDERING: That according to Article 54, subsection n) of Law No. 1670, it is the responsibility of the Board of Directors to formulate policies regarding the internal management of the BCB, supervising their execution. That according to article 11, numeral 45) of the BCB Statute, the Board of Directors has among its powers the authority to set annually the table of commissions to be charged for the services it provides. That the International Operations Management, according to Report GOI No. 015/2007, states that the commissions charged by the Issuing Entity for the provision of banking and financial services are intended to cover their respective operating costs, and to this effect it is also necessary to periodically adjust these commissions, in order to adapt them to current market conditions.

That as expressed in Report SANO No. 318/2007, in the opinion of the Legal Affairs Management, there is no legal impediment for the Board of Directors to consider the approval of the Fee Table and Fine Table of the BCB for the 2008 management period.

THEREFORE, THE BOARD OF DIRECTORS OF THE CENTRAL BANK OF BOLIVIA RESOLVES:

Article 1.- Approve the Fee Table for Services and Fine Table of the Central Bank of Bolivia for the 2008 management period, which forms part of the present Resolution as an annex, and which will enter into force as of January 2, 2008.

Article 2.- As of January 2, 2008, Board of Directors Resolutions No. 096/2006, No. 012/2007, and No. 119/2007, and all provisions contrary to the present Resolution, are hereby repealed.

Article 3.- The Presidency and General Management are charged with the execution and compliance of the present Resolution.
