The resolution amends Article 7 of the General Provisions to establish a 50-calendar-day deadline for the CNBV to notify the resolution of the Technical Opinion, with positive resolution implied if no notification is received within that period. It also repeals the third and final paragraphs of Article 8 of the same provisions. These changes apply to exchange centers, money transmitters, and non-regulated multiple-object financial companies and enter into force the day after publication in the Official Gazette.

RESOLUTION modifying the General Provisions for obtaining the technical opinion for exchange centers, money transmitters and non-regulated multiple-object financial companies

The National Banking and Securities Commission, based on the provisions of Articles 86 Bis and 87-P of the General Law of Credit Auxiliary Organizations and Activities; Articles 4, fraction XXXVI, 16, fraction I, and 19 of the Law of the National Banking and Securities Commission, and
CONSIDERING
That it is necessary to expedite and make more efficient the procedure for obtaining the technical opinion in matters of prevention of operations with resources of illicit origin and financing of terrorism, has resolved to issue the following:
RESOLUTION MODIFYING THE GENERAL PROVISIONS FOR OBTAINING THE TECHNICAL OPINION FOR EXCHANGE CENTERS, MONEY TRANSITTERS AND NON-REGULATED MULTIPLE-OBJECT FINANCIAL COMPANIES
SOLE.- Article 7 is REFORMED and the third and final paragraphs of Article 8 of the "General Provisions for obtaining the technical opinion for exchange centers, money transmitters and non-regulated multiple-object financial companies", published in the Official Gazette of the Federation on April 4, 2014, are REPEALED, to read as follows:
"Article 7.- The Commission shall have a period of fifty calendar days counted from the next business day after the Obligated Subject has received the acknowledgment referred to in Article 9 of these provisions, to notify the resolution of the Technical Opinion. In the event that the Obligated Subject is not notified within the cited period, it shall be understood that the request for the Technical Opinion has been resolved in a positive sense. At the request of the interested party, a certificate of such circumstance shall be issued within two business days following the submission of the respective request to the Commission.

SOLE.-
This Resolution shall enter into force the day following its publication in the Official Gazette of the Federation.
