Resolution SBS No. 1158-2022: EDPYME Entities Have Until April 30, 2023 to Execute Corporate and Registry Acts to Change Their Name to Credit Companies

CONSIDERING:

That, by Legislative Decree No. 1531, the name of Small and Micro Enterprise Development Entity – EDPYME was replaced by that of Credit Company, providing that from the entry into force of the aforementioned Legislative Decree, any reference contained in the current legal framework to Small and Micro Enterprise Development Entity – EDPYME or whose wording implicitly includes it, including, among others, its tax treatment, must be understood as referring to the Credit Company of paragraph 5 of letter A of article 16 of the General Law of the Financial System and of the Insurance System and the General Law of the Superintendence of Banking and Insurance, Law No. 26702 and its amendments;

That, in this sense, it is necessary to establish a maximum deadline for Small and Micro Enterprise Development Entities - EDPYME to carry out the corporate and registry acts that are pertinent for the adaptation of their name to Credit Companies;

Having the approval of the Adjunct Superintendencies of Banking and Microfinance and of Legal Advice; and,

In exercise of the powers conferred by paragraphs 7 and 9 of article 349 of the aforementioned General Law, and based on the exception conditions established in article 14 of Supreme Decree No. 001-2009-JUS and its amendments;

RESOLVES:

Article First.- Small and Micro Enterprise Development Entities – EDPYME have until April 30, 2023, to carry out the corporate and registry acts that are necessary to change their name to Credit Companies.

Article Second.- This resolution enters into force the day after its publication in the Official Gazette El Peruano.
