Royal Decree of 21 December 2017 withdrawing the designation of the securities settlement system managed by BNY Mellon CSD

This Royal Decree withdraws the designation of the securities settlement system operated by BNY Mellon CSD (enterprise number 501 804 457) as a securities settlement system under the Law of 28 April 1999. The withdrawal follows a positive opinion from the National Bank of Belgium dated 24 October 2017 regarding the revocation of the original designation made on 30 July 2013. The decision takes effect retroactively from 1 October 2017, and the Minister of Finance is charged with its execution.

Having regard to the Constitution, Article 108; Having regard to the Law of 28 April 1999 transposing Directive 98/26/EC of 19 May 1998 concerning the finality of settlement in payment and securities settlement systems; Having regard to the Royal Decree of 30 July 2013 designating the securities settlement system operated by the Belgian law public limited company BNY Mellon CSD as a securities settlement system within the meaning of the Law of 28 April 1999 transposing Directive 98/26/EC of 19 May 1998 concerning the finality of settlement in payment and securities settlement systems;

Considering that on 24 October 2017, the National Bank of Belgium issued a positive opinion on the withdrawal of the designation, dated 30 July 2013, of the securities settlement system operated by the Belgian law public limited company BNY Mellon CSD as a securities settlement system governed by Belgian law; On the proposal of the Minister of Finance, We have decided and do decide:

Article 1. The designation of the securities settlement system operated by the Belgian law public limited company BNY Mellon CSD, enterprise number 501 804 457, as a securities settlement system within the meaning of the Law of 28 April 1999 transposing Directive 98/26/EC of 19 May 1998 concerning the finality of settlement in payment and securities settlement systems, is withdrawn.

Art. 2. This Decree shall take effect as of 1 October 2017.

Art. 3. The Minister responsible for Finance is charged with the execution of this Decree.
