Bangladesh Bank has already taken various steps to build a private investment-dependent economy by increasing credit flow to productive sectors with the aim of creating employment and achieving sustainable economic growth. Under these steps, various incentives/policy supports are being provided through banks to borrowers in sectors such as agriculture, CMSME (Cottage, Micro, Small and Medium Enterprises), including the revival of closed export-oriented factories. However, it is observed that some customers, on one hand, are receiving incentives/policy support provided by Bangladesh Bank, while on the other hand, they are continuing with cases, including writ petitions, filed against the government, Bangladesh Bank, and the relevant banks. 2. In the described context, to resolve litigation in the country's banking sector, the following directive is being issued: Before providing any incentive package or any other policy support declared or to be declared by the government or Bangladesh Bank, if any cases, including writ petitions, previously filed by the applicant against the government, Bangladesh Bank, and the relevant banks remain unresolved, the application must be considered subject to the withdrawal of such cases. In this regard, an affidavit must be obtained from the customer stating that no cases previously filed by the applicant against the government, Bangladesh Bank, and the relevant banks remain unresolved, along with an attached list of the withdrawn cases. 3.
