Amended Instructions for the Instructions of the Compensation Fund for Victims of Motor Vehicle Accidents for the Year 2018 Published on page 6155 of Official Gazette No. 5535 dated 2018/10/1

Article 1

• Issued by His Excellency the Minister of Industry, Trade and Supply, based on the letter from the Office of the Prime Minister No. 83/11/1/19838 dated 8/6/2014, which includes the Cabinet of Ministers' decision to approve, effective from 30/4/2014, the transfer of all authorities for managing the Insurance Authority as stipulated in the provisions of the Law Regulating Insurance Activities No. (33) of 1999 and its amendments, and the systems and decisions issued pursuant thereto, to His Excellency the Minister of Industry, Trade and Supply, and the transfer of all authorities of the Director General of the Insurance Authority as stipulated in Article (85) of the Law Regulating Insurance Activities No. (33) of 1999 and its amendments, and the systems and decisions issued pursuant thereto, to the Secretary General of the Ministry of Industry, Trade and Supply.

These instructions are titled (Amended Instructions for the Instructions of the Compensation Fund for Victims of Motor Vehicle Accidents for the Year 2018) and shall be read together with the referenced Instructions No. (6) of 2004 hereinafter referred to as the Original Instructions, along with any amendments thereto, as a single set of instructions, and shall be effective from the date of their publication in the Official Gazette.

Article 2 Article (13) of the Original Instructions is amended as follows:

First: By repealing the text of paragraph (a) thereof and replacing it with the following text: a. The beneficiary victim entitled to compensation in accordance with the provisions of these instructions shall notify the Fund in writing of the occurrence of the accident within a period not exceeding one year from the date of its occurrence, and shall complete all necessary papers and documents within a period not exceeding six months from the date

of obtaining the final judgment regarding the accident or from the date of issuance of the Public Prosecutor's decision approving the Public Prosecutor's decision in the event that item (2) of paragraph (b) of Article (3) of these instructions is met.

Second: By adding paragraph (b) thereto with the following text, and renumbering the existing paragraph (b) therein to become (c): b. In the event that the periods mentioned in paragraph (a) of this article are exceeded, the Fund shall not be permitted to accept the claim or disburse compensation amounts as appropriate.

Article 3 The provisions of Article (2) of the Amended Instructions shall apply to all claims notified to the Fund before the date of issuance of the Amended Instructions, provided that the periods mentioned in paragraph (a) of item (first) of Article (2) of the Amended Instructions for claims notified to the Fund before the date of issuance of the Amended Instructions shall be calculated from the date of publication of these instructions in the Official Gazette.
