Circular 95/2010/TT-BTC amending the Regulation on Organization and Management of Securities Trading for Unlisted Public Companies at the Hanoi Securities Trading Center

CIRCULAR Amending and Supplementing the Regulation on Organization and Management of Securities Trading for Unlisted Public Companies at the Hanoi Securities Trading Center issued together with Decision No. 108/2008/QD-BTC dated November 20, 2008 of the Minister of Finance Based on the Securities Law No. 70/2006/QH11 dated June 29, 2006; Based on Government Decree No. 14/2007/ND-CP dated January 19, 2007 detailing the implementation of some articles of the Securities Law; Based on Government Decree No. 118/2008/ND-CP dated November 27, 2008 on the functions, tasks, powers and organizational structure of the Ministry of Finance; The Ministry of Finance guides the amendment and supplementation of some contents in the Regulation on Organization and Management of Securities Trading for Unlisted Public Companies at the Hanoi Securities Trading Center issued together with Decision No. 108/2008/QD-BTC dated November 20, 2008 of the Minister of Finance as follows: Article 1. Replace the phrases "Hanoi Securities Trading Center" and "HSTC" in Decision 108/2008/QD-BTC dated November 20, 2008 with the corresponding phrases "Hanoi Stock Exchange" and "HSX". Article 2. Article 7 is revised as follows: "Article 7: Conditions for Trading Registration Securities are registered for trading at the Hanoi Stock Exchange (HSX) when meeting all of the following conditions:

1. Securities of an unlisted public company as prescribed in Article 25 of the Securities Law at the HSX.
2. Securities that have been registered for custody at the Vietnam Securities Depository (hereinafter abbreviated as VSD)". Article 3. Delete Clause 2 of Article 8 regarding the dossier for trading registration. Article 4. Delete point d, Clause 1 of Article 13 regarding the suspension of trading for registered securities. Article 5. Revise Article 14 regarding trading methods as follows: "Article 14: Trading Methods:
3. The HSX organizes trading for registered securities through the trading registration system according to 2 methods: continuous matching method and negotiated trading method.
4. The HSX and Vietnam VSD shall specifically regulate the content of trading methods and the method of correcting trading errors in the continuous matching form after obtaining the approval of the State Securities Commission". Article 6. This Circular takes effect from the date of signing. Article 7. The amendment and supplementation of this Circular shall be decided by the Minister of Finance./. |To receive: |KT.
