FOR CONSULTATION: Securities Commission of The Bahamas Draft Securities Industry (Fees) Rules, 2026 Page 2 of 7 SECURITIES INDUSTRY ACT, 2024 (NO. 39 OF 2024) SECURITIES INDUSTRY (FEES) RULES, 2026 The Securities Commission of The Bahamas (“the Commission”), in its capacity as the regulator of capital markets businesses, has issued the Securities Industry (Fees) Rules, 2026 (“the Rules”) for public consultation. The draft Rules can be found on the Commission's website at: scb.gov.bs/legislative￾framework/consultation-documents/. Summary/Purpose The draft Rules prescribes the fee requirements for regulated persons carrying on capital markets business, including Contracts for Differences (“CFDs”) in or from The Bahamas and would replace the Securities Industry (Fees) Rules, 2024 (No. 39 of 2024). These Rules increase certain fees applicable to capital markets businesses registered under the Securities Industry Act, 2024. Scope These Rules would apply to persons regulated under the Securities Industry Act, 2024. FOR CONSULTATION: Securities Commission of The Bahamas Draft Securities Industry (Fees) Rules, 2026 Page 4 of 7 SECURITIES INDUSTRY ACT, 2024 (NO. 39 OF 2024) SECURITIES INDUSTRY (FEES) RULES, 2026 The Securities Commission of The Bahamas, in exercise of the powers conferred by section 31 of the Securities Industry Act, 2024 (No. 39 of 2024), makes the following rules —

1. Citation and commencement. (1) These Rules may be cited as the Securities Industry (Fees) Rules, 2026. (2) These Rules shall come into operation on 1 January, 2027.
2. Fees. (1) The fees set out in the Schedule shall — (a) apply in relation to the Act unless exempted by the Commission; (b) be paid to the Commission; and (c) not be refundable. (2) All annual renewal fees set out in the Schedule shall be payable on or before the 31st day of January in each year. (3) Annual renewal fees payable on the grant of registration shall be pro-rated from the date of registration to the 31st day of December of that year.
3. Exemption for contract for differences activity. A person registered to deal under the Act and desirous of conducting contract for differences (CFD) activity under the Securities Industry (Contract For Differences) Rules, 2020 (S.I. No. 78 of 2020) shall be required to pay the application, registration and annual fees for the contract for differences activity as shown in the Schedule but shall be exempt from the application, registration and annual fees applicable to dealing, arranging deals, managing or advising on capital markets instruments.
4. Revocation of S.I. No. 107 of 2024. The Securities Industry (Fees) Rules, 2024 (S.I. No. 107 of 2024) are hereby revoked.
