Order on Relevant Regulations for Securities and Futures Industries Regarding Inter-Financial Institution Data Sharing

Securities and futures industries are permitted to share customer data among financial institutions for risk identification, risk control, reducing duplicate data entry, and cooperative business operations, provided they obtain prior customer consent and disclose privacy policies on their websites.   1. To enhance the convenience of customers of securities and futures industries, strengthen risk management of financial institutions, and promote cross-industry cooperation among financial institutions, under the principle of information security, securities and futures industries may reasonably utilize customer data to enhance consumer rights and interests.

  2. When securities and futures industries conduct inter-financial institution data sharing, they shall establish internal control standards approved by the board of directors. The scope and procedures for data sharing, except where other laws and regulations permit sharing, shall require prior customer consent and the disclosure of privacy policies on the company's website, and shall be handled in accordance with the Personal Data Protection Act and the following provisions:

(1) Securities and futures industries may conduct data sharing between financial holding companies and their subsidiary financial institutions, among the various subsidiary financial institutions of a financial holding company, between non-financial holding company financial institutions and their subsidiary financial institutions, and among the various subsidiary financial institutions of non-financial holding company financial institutions, for the purposes of identifying risks, conducting risk control, facilitating customer operations by reducing duplicate data entry, or conducting cooperative business.

(2) Securities and futures industries may conduct data sharing between financial institutions other than those specified in the preceding paragraph for the purposes of facilitating customer operations or conducting cooperative business.

(3) The internal control standards for inter-financial institution data sharing conducted by securities and futures industries, the content to be explicitly agreed upon for shared data, and the types of data that may be shared shall comply with the Commission's "Guidelines for Inter-Financial Institution Data Sharing."

  1. This order takes effect from the date of issuance; the Commission's Order No. Jin Guan Zheng Quan Zi No. 1100365499 dated January 20, 2022 (Republic of China Year 111), is hereby repealed effective from the date of issuance.
