REGULATION OF THE COMMODITY FUTURES TRADING REGULATORY AGENCY REPUBLIC OF INDONESIA NUMBER 1 OF 2026 CONCERNING TECHNICAL REQUIREMENTS FOR WAREHOUSES IN THE WAREHOUSE RECEIPT SYSTEM

BY THE GRACE OF THE ALMIGHTY GOD

HEAD OF THE COMMODITY FUTURES TRADING REGULATORY AGENCY REPUBLIC OF INDONESIA,

Considering: a. that to support the implementation of the warehouse receipt system in ensuring the safety, quality, and availability of goods stored in warehouses, regulations regarding technical requirements for warehouses in the warehouse receipt system have been established, regulated in the Commodity Futures Trading Regulatory Agency Regulation Number 1 of 2021 Concerning Technical Requirements for Warehouses in the Warehouse Receipt System; b. that the Commodity Futures Trading Regulatory Agency Regulation Number 1 of 2021 Concerning Technical Requirements for Warehouses in the Warehouse Receipt System as referred to in letter a is no longer in line with needs and legal developments, so it needs to be replaced; c. that based on the considerations as referred to in letters a, b, and to implement the provisions of Article 43 paragraph (4) of Government Regulation Number 36 of 2007 Concerning the Implementation of Law Number 9 of 2006 Concerning the Warehouse Receipt System as amended by Government Regulation Number 70 of 2013 Concerning Amendments to Government Regulation Number 36 of 2007 Concerning the Implementation of Law Number 9 of 2006 Concerning the Warehouse Receipt System, it is necessary to establish a Commodity Futures Trading Regulatory Agency Regulation Concerning Technical Requirements for Warehouses in the Warehouse Receipt System;

1. Law Number 9 of 2006 Concerning the Warehouse Receipt System (State Gazette of the Republic of Indonesia Year 2006 Number 59, Supplement to the State Gazette of the Republic of Indonesia Number 4630) as amended by Law Number 9 of 2011 Concerning Amendments to Law Number 9 of 2006 Concerning the Warehouse Receipt System (State Gazette of the Republic of Indonesia Year 2011 Number 78, Supplement to the State Gazette of the Republic of Indonesia Number 5231);
2. Law Number 7 of 2014 Concerning Trade (State Gazette of the Republic of Indonesia Year 2014 Number 45, Supplement to the State Gazette of the Republic of Indonesia Number 5512) as amended several times, lastly with Law Number 6 of 2023 Concerning the Determination of Government Regulation in Lieu of Law Number 2 of 2022 Concerning Job Creation into Law (State Gazette of the Republic of Indonesia Year 2023 Number 41, Supplement to the State Gazette of the Republic of Indonesia Number 6856);
3. Government Regulation Number 36 of 2007 Concerning the Implementation of Law Number 9 of 2006 Concerning the Warehouse Receipt System (State Gazette of the Republic of Indonesia Year 2007 Number 79, Supplement to the State Gazette of the Republic of Indonesia Number 4735) as amended by Government Regulation Number 70 of 2013 Concerning Amendments to Government Regulation Number 36 of 2007 Concerning the Implementation of Law Number 9 of 2006 Concerning the Warehouse Receipt System (State Gazette of the Republic of Indonesia Year 2013 Number 172, Supplement to the State Gazette of the Republic of Indonesia Number 5459);
4. Presidential Regulation Number 168 of 2024 Concerning the Ministry of Trade (State Gazette of the Republic of Indonesia Year 2024 Number 364);
5. Minister of Trade Regulation Number 6 of 2025 Concerning the Organization and Work Structure of the Ministry of Trade (State Gazette of the Republic of Indonesia Year 2025 Number 53);

DECIDES:

To Establish: A REGULATION OF THE COMMODITY FUTURES TRADING REGULATORY AGENCY CONCERNING TECHNICAL REQUIREMENTS FOR WAREHOUSES IN THE WAREHOUSE RECEIPT SYSTEM.

Article 1 In this Regulation, the following terms are defined:

1. Warehouse Receipt System is an activity related to the issuance, transfer, guarantee, and settlement of warehouse receipt transactions.
2. Goods are every movable object that can be stored for a certain period and traded generally.

3. Warehouse is all immovable and non-movable rooms intended not to be visited by the public, but to be used specifically as a place for storing Goods that can be traded generally and meet other conditions established by the ministry responsible for government affairs in the field of trade.
4. Conformity Assessment Institution, hereinafter abbreviated as LPK, is an accredited institution that carries out a series of activities to assess or prove that certain requirements related to products, processes, systems, and/or personnel are met.
5. Warehouse Operator is a party conducting warehouse business, whether owning the warehouse or using someone else's, which performs storage, maintenance, and supervision of Goods stored by the owners of the Goods and is entitled to issue Warehouse Receipts.
6. Warehouse Receipt System Supervisory Agency, hereinafter referred to as the Supervisory Agency, is an organizational unit under the ministry responsible for government affairs in the field of trade, which is given authority to conduct guidance, regulation, and supervision of the implementation of the Warehouse Receipt System.

Article 2 (1) Warehouses used by Warehouse Operators in the Warehouse Receipt System must obtain approval from the Supervisory Agency. (2) In granting approval as referred to in paragraph (1), the Supervisory Agency considers the following technical requirements: a. the purpose of warehouse use, related to the ability to store types of Goods for a certain period; b. warehouse location; c. type of warehouse, including: silo, cold storage, closed warehouse, open warehouse, and tank; d. size, including: height, area, and warehouse capacity; e. construction, humidity, and air temperature of the warehouse; f. equipment; and g. the duration of warehouse control in the event that the warehouse used is not owned by the Warehouse Operator.

Article 3 (1) The purpose of warehouse use as referred to in Article 2 paragraph (2) letter a includes: a. the warehouse's ability to store to ensure the safety and quality of Goods that can be stored in the Warehouse Receipt System in accordance with applicable regulations; and

b. the warehouse management mechanism in the Warehouse Receipt System. (2) The warehouse location as referred to in Article 2 paragraph (2) letter b includes: a. being free from floods, landslides, or other natural disaster potentials; and b. adequate transportation access that can be traversed by motor vehicles or transport tools for the smooth distribution of Goods. (3) The type of warehouse as referred to in Article 2 paragraph (3) letter c and the warehouse size as referred to in Article 2 paragraph (3) letter d are related to the suitability of the type and classification of the warehouse with the Goods that can be stored in the Warehouse Receipt System. (4) The construction, humidity, and air temperature of the warehouse as referred to in Article 2 paragraph (3) letter e include: a. having a building structure, roof, walls, and floors that are sturdy, leak-proof, and capable of withstanding building loads, Goods loads, and external loads, including humans, wind, rain, and earthquake potentials, to ensure human safety and the safety and quality of Goods according to the type and characteristics of the Goods; and b. warehouse conditions with good air circulation and/or stable air temperature, and air humidity levels appropriate to the type and characteristics of Goods to maintain the safety and quality of Goods. (5) Warehouse equipment as referred to in Article 2 paragraph (3) letter f considers the types of equipment that must be available in the warehouse supporting storage, transportation, quality supervision, and security activities of Goods in the warehouse, including: a. loading and unloading equipment; b. storage equipment; c. measuring, weighing, and/or balancing equipment; d. environmental control equipment; e. warehouse security equipment; f. cleaning equipment; and/or g. communication, technology, and information equipment, according to the type and characteristics of Goods to maintain the safety and quality of Goods. (6) The duration of warehouse control as referred to in Article 2 paragraph (3) letter g is as stated in the cooperation agreement or lease agreement in the event that the warehouse used is not owned by the Warehouse Operator.

Article 4 (1) In addition to the technical requirements as referred to in Article 2 paragraph (2), Bappebti may require all or part of the requirements referring to the Indonesian National Standards regarding Warehouses. (2) The requirements as referred to in paragraph (1) become guidelines for LPKs in conducting conformity assessment of warehouses used in the Warehouse Receipt System. (3) In the event that Indonesian National Standards as referred to in paragraph (1) are not yet available, Bappebti may establish technical requirements for warehouses used in the Warehouse Receipt System. (4) The establishment of requirements as referred to in paragraph (1) and paragraph (3) is regulated in a Body Regulation.

Article 5 At the time this Body Regulation takes effect, the Commodity Futures Trading Regulatory Agency Regulation Number 1 of 2021 Concerning Technical Requirements for Warehouses in the Warehouse Receipt System is repealed and declared invalid.

Article 6 This Body Regulation takes effect on the date of establishment.
