Resolution SBS No. 01786-2026: Amending the Regulation for the Classification of Financial System and Insurance Companies

The Superintendent of Banking, Insurance and Private Pension Fund Administrators amends the Regulation for the Classification of Financial System and Insurance Companies by replacing Articles 8, 20, and 21. The changes require risk rating companies to submit detailed registration information and mandate that financial system and insurance companies publish definitive classifications on their official websites within five business days, retaining the data for at least four years. These digital publication obligations replace previous printed requirements and apply to semi-annual risk classifications issued by rating agencies.

The Superintendent of Banking, Insurance and Private Pension Fund Administrators

CONSIDERING:

That the General Law of the Financial System and the Insurance System and the Organic Law of the Superintendence of Banking and Insurance, Law No. 26702 and its amendments, hereinafter the General Law, establishes in articles 136 and 296 that financial system companies that capture public funds and insurance companies must have a classification from at least two rating agencies every six months;

That the Thirty-Fifth Final and Complementary Provision of the General Law establishes that publications referring to said law for various administrative actions may be carried out via electronic or digital means;

That, through SBS Resolution No. 18400-2010, the Regulation for the classification of financial system companies and insurance companies was approved, hereinafter, the Regulation;

That it has been considered necessary to modify the method of publication of the classification of financial system companies and insurance companies, requiring that it be published digitally, eliminating the obligation of its printed publication;

That, likewise, it has been considered necessary to incorporate the obligation for financial system and insurance companies to publish the classification in digital form;

That, according to the above, it is necessary to make modifications to the Regulation;

That, for the purpose of collecting opinions from the general public on the proposal, through SBS Resolution No. 01045-2026, the publication of the draft norm was ordered on the Digital Headquarters of the Superintendence, under the provisions of the Thirty-Second Final and Complementary Provision of the General Law, as well as Supreme Decree No. 009-2024-JUS;

In exercise of the powers conferred by numeral 7 of article 349 of the General Law;

RESOLVES:

Article First.- Modify the Regulation for the classification of financial system companies and insurance companies, approved by SBS Resolution No. 18400-2010, according to the following:

  1. Subsection a) of article 8 is replaced as follows:

“Requirements for Registration Article 8.- For registration in the Register, risk rating companies must submit an application attaching, at least, the information detailed below: a) In the case of risk rating companies registered in the Public Registry of the Capital Markets of the Superintendence of the Capital Markets (SMV):

i. Name of the company, registered office, share capital, shareholders and percentage of participation, directors, managers, employees in charge of classification projects, and full and alternate members of the classification committee.

ii. Document accrediting their status as a risk rating company registered in the Public Registry of the Capital Markets of the SMV.

iii. One (1) copy of the classification methodology/methodologies for each type of financial system company and for insurance companies, detailing the corresponding technical criteria, ratios and weights.

iv. Additional information that the Superintendence considers pertinent.”

  1. Article 20 is replaced as follows:

“Publication Article 20.- Risk rating companies, financial system companies and insurance companies must publish the definitive classification on their official website within five (05) business days following its issuance. This information must be available to the public for a period of no less than four (04) years from its publication.

A definitive classification is considered to be one where, having passed the period provided for in article 19, no request for review of the classification opinion has been made. In the event that a review request exists, the definitive classification will be the one issued by the rating agency's classification committee convened to review the opinion.

In the case of semi-annual risk classifications of financial system companies and insurance companies, provided for in article 6, the publication must be made no later than the last business day of September and March for updates made with information as of June 30 and December 31 of each year, respectively.

The publication on the official websites of financial system companies and insurance companies must be done without referring to a hyperlink or link to another website external to the company's website.

The Superintendence may establish other mechanisms for the dissemination of the classifications of financial system companies and insurance companies.”

  1. Article 21 is replaced as follows:

“Minimum Information of Publications Article 21.- The publication provided for in article 20 must contain at least the following information: a) Identification of the classified company; b) Identification of the rating company; c) The assigned classification indicating the description of the category and, if applicable, the subcategory, and, if applicable, the previously granted classification; d) Date of the classification committee at which the respective opinion was issued;

In addition to what is stated in the preceding subsections, rating companies must indicate that the classification expresses an independent opinion of the risk rating company regarding the ability of financial system companies and insurance companies to manage risks.

Article Second.- This resolution enters into force the day following its publication in the Official Gazette “El Peruano”.
