SBS Resolution No. 01917-2026: Modification of Instructions for Sending the Operations Registry (RO) of the OCP LA/FT and Extension of Deadlines

CONSIDERING:

That, through SBS Resolution No. 01754-2024, the Standard for the prevention of money laundering and terrorist financing applicable to notaries nationwide and to the Centralized Prevention Body for Money Laundering and Terrorist Financing - OCP LA/FT was approved; which establishes the obligations and procedures that, in their capacity as obligated subjects to report to the Financial Intelligence Unit of Peru (UIF-Peru), must comply with to implement their Anti-Money Laundering and Terrorist Financing Prevention Systems, among them, the obligation to register and send to UIF-Peru the operations that are subject to the Operations Registry (RO);

That, through SBS Resolution No. 01139-2025, the Instructions for sending the Operations Registry (RO) of the OCP LA/FT regarding the information of the operations of notaries nationwide (RO Instruction) were approved under the scope of SBS Resolution No. 01754-2024;

That, through SBS Resolution No. 03012-2025, the deadlines contained in articles 3 and 6 of SBS Resolution No. 01139-2025 were extended, providing that the OCP LA/FT sends to UIF-Peru in October 2026 the RO of September 2026, and similarly for subsequent periods, maintaining the notaries' obligation to register and send the RO to UIF-Peru under the structure and periodicity of the current format, until the period of August 2026, which must be sent in September 2026;

That, since it is the function of the OCP LA/FT to integrate all notaries in Peru into a centralized management in matters of AML/CFT prevention and to establish timely communication and coordination that allows all notaries nationwide to implement the necessary technical aspects in their respective information systems to adequately comply with sending the required information for the OCP LA/FT RO, it is necessary to extend the aforementioned deadlines so that notaries maintain the obligation to register and send the RO to UIF-Peru under the structure and periodicity of the current format;

That, likewise, it is necessary to modify the Instructions for sending the Operations Registry (RO) of the OCP LA/FT approved by SBS Resolution No. 01139-2025, regarding technical aspects, design and data structure of the operations subject to the OCP LA/FT RO, in order to assist notaries and the OCP LA/FT in the adequate compliance with the registration and reporting of the RO;

Los Laureles Nº 214 - Lima 27 - Perú Telf. : (511)6309000 That, Article Eight of SBS Resolution No. 02648-2024, published on August 1, 2024, which approved the Standard for the prevention of money laundering and terrorist financing applicable to Virtual Asset Service Providers (VASPs) under the supervision of UIF-Peru, provides that Chapter VIII referred to the Travel Rule, will enter into force two years after the publication of the aforementioned standard, that is, on August 1, 2026;

That, taking into consideration that, for the implementation of the Travel Rule, VASPs must adopt the necessary operational and technological measures to ensure the adequate obtaining, conservation and transmission of identification information of the originator and the beneficiary in virtual asset transfers, it is necessary to extend the deadline for the entry into force of the aforementioned Chapter VIII on the Travel Rule;

That, it is necessary to modify paragraph 16 of the serious infractions of Annex 1 of the Regulation on Infractions and Sanctions in Matters of Prevention of Money Laundering and Terrorist Financing, approved by SBS Resolution No. 8930-2012 and its modifying norms, considering criteria of proportionality and reasonableness in the classification of the severity and impact on the AML/CFT prevention system, so as to allow the Superintendency to have effective mechanisms for a better exercise of its sanctioning power;

Having the approval of the Adjunct Superintendencies of Regulation and Legal Affairs and UIF-Peru; and,

In exercise of the powers conferred by Law No. 29038 and the General Law of the Financial System and the Insurance System and Organic Law of the Superintendency of Banking and Insurance - Law No. 26702 and its modifying norms, in concordance with Law No. 27693 and its modifying and regulatory norms, and according to the exception of the Thirty-Second Final and Complementary Provision of the aforementioned Law No. 26702;

RESOLVES:

Article First.- Modify the Instructions for sending the Operations Registry (RO) of the OCP LA/FT regarding the information of the operations of Notaries nationwide (RO Instruction) under the scope of SBS Resolution No. 01754-2024, approved by article 1 of SBS Resolution No. 01139-2025 and its modifying norms, regarding technical aspects, design and data structure; which are published on the SBS FTP on the date of publication of this standard in the Official Gazette El Peruano.

Article Second.- Extend the deadlines established in article 3 of SBS Resolution No. 01139-2025 and its modifying norms, providing that:

a) The OCP LA/FT sends to UIF-Peru, in April 2028, the Operations Registry (RO) corresponding to March 2028, and similarly the records corresponding to subsequent periods.

b) Notaries maintain the obligation to register and send to UIF-Peru the Operations Registry (RO) under the structure and periodicity of the current format until the period of February 2028, which must be sent in March 2028.

Article Third.- Extend the deadlines established in paragraphs 3 and 4 of article 6 of SBS Resolution No. 01139-2025 and its modifying norms, providing that:

a) Article 1 of SBS Resolution No. 01139-2025 and Article 26 of the Standard for the Prevention of Money Laundering and Terrorist Financing applicable to notaries nationwide and to the OCP LA/FT, approved by SBS Resolution No. 01754-2024, enter into force on March 1, 2028.

b) The provisions contained in Chapter II of Title II of the Special Standards for the Prevention of Money Laundering and Terrorist Financing applicable to notaries, approved by SBS Resolution No. 5709-2012, are repealed as of April 1, 2028.

Article Fourth.- Extend until January 1, 2029 the validity of what is provided in Chapter VIII, referred to the Travel Rule, provided for in Article Eight of SBS Resolution No. 02648-2024, which approves the Standard for the Prevention of Money Laundering and Terrorist Financing applicable to Virtual Asset Service Providers (VASPs).

Article Fifth.- Incorporate infringement 4-A into the minor infractions and repeal infringement 16 of the serious infractions of Annex No. 1 of the Regulation on Infractions and Sanctions in Matters of Prevention of Money Laundering and Terrorist Financing, approved by SBS Resolution No. 8930-2012 and its modifying norms, according to the following text:

“Annex 1
Infractions applicable to obligated subjects under the scope of SBS Resolution No. 789-2018 and its modifications, as well as to obligated subjects under the supervision of UIF-Peru in matters of AML/CFT prevention, not included in Annexes 2 and 3 Minor Infractions (…) Regarding the manual and code of conduct for the prevention and management of AML/CFT risks (…) “4-A. Not having the minimum content of the manual for the prevention and management of AML/CFT risks established in the current regulations.”

Article Sixth.- This Resolution enters into force the day after its publication in the Official Gazette El Peruano.
