SBS Resolution N° 01139-2025: Rule approving the Operations Register (RO) Instruction Manual for the OCP LA/FT regarding operations of Notaries nationwide (RO Instruction Manual) under the scope of Res. SBS N° 01754-2024, dictating various provisions and making modifications

Los Laureles Nº 214 - Lima 27 - Peru Tel. : (511)6309000 Lima, March 25, 2025 SBS Resolution N° 01139-2025 The Superintendent of Banking, Insurance and Private Pension Fund Administrators (a.i.) CONSIDERING:
That, Article 9-B of Law N° 27693, Law creating the Financial Intelligence Unit - Peru (UIF-Peru), incorporated by Article 2 of Legislative Decree N° 1249, Legislative Decree dictating measures to strengthen the prevention, detection and sanction of money laundering and terrorism, created the Centralized Anti-Money Laundering and Counter-Terrorist Financing Body – OCP LA/FT, in order to strengthen the notarial function in the fight against money laundering and terrorist financing; a body under the responsibility of the Lima Notaries Association and which integrates all notaries of the Republic of Peru in a centralized management regarding the prevention of money laundering and terrorist financing; maintaining the notary's responsibility as an obliged entity to report to the UIF-Peru; That, notaries and the OCP LA/FT, as obliged entities to report to the UIF-Peru, by express provision of Article 3 of Law N° 29038 and Article 36 of the Regulation of Law N° 27693, approved by Supreme Decree N° 020-2017- JUS, are supervised by this Superintendency, through the UIF-Peru, regarding the prevention of money laundering and terrorist financing, in accordance with the provisions of Articles 9-A and 36 of Law N° 27693 and the aforementioned regulation, respectively; That, Article Third of SBS Resolution N° 01754-2024, which approved the “Rule for the prevention of money laundering and terrorist financing applicable to notaries nationwide and to the Centralized Anti-Money Laundering and Counter-Terrorist Financing Body – OCP LA/FT; established that the provisions contained in Article 26 referring to the operations register (RO), will enter into force as established by the SBS Resolution that approves a new RO Template and its corresponding Instruction Manual; That, in accordance with the provisions of paragraphs
9.2 subsection q. and 9.8 of Article 9 of Law Nº 27693, the Superintendency is empowered, among other
aspects, to expand, reduce and/or modify the list of concepts that must be subject to the operations register (RO), based on the importance or ML/TF risk that these imply, as well as any other matter or topic related to the aforementioned operations register; That, in this context, it is necessary to approve the instructions for sending the Operations Register (RO) of the OCP LA/FT regarding the information of notaries nationwide, referred to in Article 26 of the Rule approved by SBS Resolution N° 01754-2024; including those contained in private documents (minutes), that have not been formalized into a public instrument; as well as to derogate certain operations subject to registration; Los Laureles Nº 214 - Lima 27 - Peru Tel. : (511)6309000 That, likewise, Article 24 of the rule approved by SBS Resolution N° 01754-2024, provides that the notary registers the information of their operations daily, through an IT tool (software), which must have the due security and confidentiality guarantees for the information; and, the weekly synchronization of the IT tool with the Centralized Information Base (BCI) is carried out progressively, within the deadlines established in the SBS Resolution that approves the RO template and instruction manual referred to in Article 26 of said rule, for which it is necessary to establish said deadlines; Having the approval of the Assistant Superintendencies of Legal Advisory and the UIF-Peru; and, In use of the powers conferred by Law N° 29038 and Law N° 26702, in concordance with Law N° 27693 and its modifying and regulatory norms, and in exception to the provisions of the Thirty-Second Final and Complementary Provision of Law N° 26702; RESOLVES:
Article 1.- To approve the Instructions for sending the
Operations Register (RO) of the OCP LA/FT regarding the information of the operations of Notaries nationwide (RO Instruction Manual) under the scope of SBS Resolution N° 01754-2024; which will be published on the SBS FTP on the date of publication of this rule in the Official Gazette El Peruano1.
Article 2.- The information of private documents
(minutes) entered into the notary's office, which have not been formalized into a public instrument (IPN) and whose date of entry into the notary's office is equal to or greater than two years old with respect to the year of sending to the UIF-Peru, shall be submitted in February, once, as part of the Operations Register (RO) of the OCP LA/FT for January of each year. The first submission of private documents (minutes) that have not been formalized into a public instrument, whose year of entry into the notary's office was 2025, form part of the Operations Register (RO) of the OCP LA/FT for January 2028. In 2029, along with the January RO, the minutes for 2026 will be sent, and so on.2
Article 3.- The electronic submission of the Operations
Register (RO) of the OCP LA/FT to the UIF Peru, shall be made no later than the last calendar day of the month following the month in which the operation was carried out before the notary in accordance with Article 36, paragraph 36.4 of the Regulation of Law N° 27693, approved by Supreme Decree N° 020-2017-JUS, through the Anti-Money Laundering and Counter-Terrorist Financing Portal - PLAFT Portal (https://plaft.sbs.gob.pe/). The OCP LA/FT shall send to the UIF-Peru in October 2026, the Operations Register (RO) for September 2026, and similarly for subsequent periods. 1 Modified by SBS Resolution N°03012-2025 effective from August 30, 2025. 2 Article derogated by SBS Resolution N°03012-2025 effective from August 30, 2025. Los Laureles Nº 214 - Lima 27 - Peru Tel. : (511)6309000 Notaries maintain the obligation to register and send to the UIF-Peru the Operations Register (RO) under the current format's structure and periodicity, until the period of August 2026, which must be sent in September 2026.3
Article 4.- To derogate operations 98. Appointment
of guardian, 99. Recognition of children (born), 100. Recognition of conceived, 113. Granting of public deed for other acts, 128. Opening of sealed wills; and, 138. Call for annual meeting or general meeting of shareholders, from paragraph 26.6. of Article 26 of the Rule for the prevention of money laundering and terrorist financing applicable to notaries nationwide and to the Centralized Anti-Money Laundering and Counter-Terrorist Financing Body – OCP LA/FT, approved by SBS Resolution N° 01754-2024.
Article 5.- To modify the second paragraph of Article 24
of the Rule for the prevention of money laundering and terrorist financing applicable to notaries nationwide and to the Centralized Anti-Money Laundering and Counter-Terrorist Financing Body – OCP LA/FT, approved by SBS Resolution N° 01754-2024, which is now drafted as follows:
“Article 24.- Registration and sending of information to the centralized information base (...)
Weekly synchronization of the IT tool between notaries nationwide and the BCI begins according to the deadline established in the SBS Resolution that approves the RO Template and instruction manual. (...)"
Article 6.- This resolution enters into force
as provided below:

1. Articles 2, 3 and 4 enter into force the day after their publication in the official gazette
   “El Peruano”.
2. Article 5, which modifies Article 24 of the Rule for the prevention of money laundering
   and terrorist financing applicable to notaries nationwide and to the Centralized Anti-Money Laundering and Counter-Terrorist Financing Body – OCP LA/FT, approved by SBS Resolution N° 01754-2024 enters into force on April 1, 2025, with an adaptation deadline until July 31, 2025.
3. Article 1, as well as Article 26 of the Rule for the prevention of money laundering and
   terrorist financing applicable to notaries nationwide and to the Centralized Anti-Money Laundering and Counter-Terrorist Financing Body - OCP LA/FT, approved by SBS Resolution N° 01754-2024, enter into force on September 1, 2026.4
4. On October 1, 2026, the provisions contained in Chapter II of Title II of the Special Norms for the prevention of money laundering and terrorist financing, applicable to notaries, approved by SBS Resolution N° 5709-2012, are derogated.5
